deOn 3/23/22 I gave Long and Foster of Greenville, De a check in the amount of $2,400 as a deposit on a house in New Castle county, DE. The contract stated if I do not obtain financing by 3/19/22, the deposit would be returned to me. I was not approved for financing and a letter of denial was sent and accepted by the firm representing this real estate transaction. I contacted this company, Giordano, DelCollo and Werb for the return of this money, and they are stating unless Long and Foster agree to release the funds they are going to hold them. On April 19th, 2022, I got a call from the realtor Joe Jacobs who drew up the sale, and said he was glad to hear I was getting my deposit back. The next day April 20, 2022, I received a cc on an email from the sellers attorney, stating that he will not agree to release the funds. The next day 4/22/22, my closing attorney, Ed ******, released another email stating he can not release the funds until a mutual release is signed. I am being advise by Mr. ****** and attorney ****** ***** that they feel that this a very bad misrepresentation of contract. I am forced ( with no money) to go to New Castle court and file a suit for my money. I cannot proceed with a home purchase, due to lack of funds. I have to be out of my house on the 27th of May, only because the people buying my house were kind enough to wait on settlement due to this matter. Sincerely,
