      ****** * ******* Jr, a fully disabled 67-year-old PA resident, seeking long-term care by pursed the services of Respondent, a Delaware LLC. Pursuant to Respondent’s brochure of services (Exhibit ) Claimant sought, beginning in August 2021, (Exhibit B and C) Respondent’s services for “free” senior living placement services, including but not necessarily limited to appropriate placement based on clinical and financial needs and scheduling tours of senior living communities within Delaware and southern Pennsylvania (Exhibit D) for placement in first quarter 2022 (Exhibit E). Respondent claims to have specific long-term care knowledge and “ . . . is an all-inclusive resource that navigates families through all care options” (Exhibit F) Claimant, following his initial “free” consultation, provided Respondent listings of all current medical providers and medications including, doctor prescribed methadone (Exhibit G). Claimant, requiring a skilled nursing long-term care facility, finalized his contract, in November via payment to Respondent for placement services for a flat fee of $4,500.00 (Exhibit H and I). Claimant’s wish, as an initial private pay patient, was to be placed in a skilled nursing, long-term care facility which would provide him with a private room and the transition to a Medicaid bed as funds diminished. Given Claimant’s medical related limitations, Rebecca Tyrrell as POA began to visit skilled nursing facilities in New Castle County Delaware. Claimant was purportedly accepted to Kentmere Rehabilitation and Health Care Center in Wilmington Delaware (Exhibit J). Kentmere was able to fulfill Claimant’s desires for a private room and Medicaid transition plan. While purportedly wait-listed at Kentmere, acceptance was revisited by the facility and Claimant was denied admittance. Following Kentmere’s denial, Respondent elected to terminate Claimant’s contract and retain all associated fees. (Please see Exhibit K – Elite Termination email).

      I have reviewed the response made by the business in reference to my complaint and have determined that this does not resolve my  issue.  For your reference, details of the offer I reviewed appear below.

      **In order for the bureau to continue to assist you, you MUST provide your view on the matter or your complaint will be closed as answered.
       I spoke to ***** at the DAG office yesterday 6/16/2022.  She advised that the DAG needs to complete their assessment since this is addressed to the DAG.

      I have attached my response letter to the DOJ and I have attached the response from the DOJ that they have closed the case and found no fault on the part of ELITE Senior Advisers.
