      This involves the property at *********************************************************************************. It was brokered by LPT Realty LLC, specifically, ******************* and his wife *****. This complaint is against *******************************, Century 21 Beggins, ***************, ** who was our (buyer's) realtor in this transaction. We lived in ******** in the spring of 2023. We were interested in this house, knowing we were going to move to ******* in June, 2023. We worked with *******************************. She showed us the property via Zoom. We fully trusted her (and ************** filed a complaint against her also). ***** and ***** were working together to try to get us to buy this house. Even assisting with minor repairs. We are elderly and were too trustful of both realtors. We put down an offer while we were still out of state. This was **** on our part, trusting these two individuals. We told ***** that we wanted to see the house once we got to *******. She told ** constantly that she requested this from *****, with no results. We were finally allowed to see it as a "final walk-through" on June 23, 2023 . This was our FIRST walk through. We were to close on June 26th. This house was nothing like we thought it was. Everything needed redone. As two senior citizens with health issues, we didn't have the time or money to get it in a decent condition. We opted out and we lost our ******* money ($3000) plus our inspection ($489.00) and appraisal ($550.00) money. We want this back. We were scammed by both realtors. This house was empty the entire time. There was no reason for us not to see it other than being scoped out as an easy target by both. ***** tried to give us all of the keys to this house on June 23rd, 3 days before we were to close. This raised a red flag for us as well and we declined. Was this part 2 of this scam? ***** and ***** should both lose their realtor license. No morals from either "realtor".       My Agent (*****) response is below.  I'm curious why nearly 3 months after they breached the contract they're asking for a refund of their expenses.  They are the ones who decided not to honor the contract.  The seller and both agents were damaged as well because of the buyers decision not to honor the contract.

      This is the lady ***** and I had that long phone conversation about previously, months ago.


      March 13th- Sent Lifestyle profile via ****** Forms to her and received back. 
      March 15th- stated she could not make an offer until her house in NE closed (June). and would look in person once arriving at interested homes.

      I sent her the 2 ******* contracts blank for review and read them to her before we ever filled one out. We talked about all things ******* (insurance etc.).
       May 2nd zoom 
      May 5th 2 zoom showings
      May 9th 2 zoom showings
      May 11th- She did not want to wait to get in contract until she was in *******, so they decided of their own will to offer while still selling their home in ********. Thus, we did several Zoom showings/meetings and discussed terms. *I asked if she was sure they did not want to wait and told her I was not wanting to put in an offer until they were past inspections and possibly appraisal for a home sale contingency.


      She ended up using ******* from Survey Eagle after she requested a $500 or less home inspection. He spoke with her about her inspection report also to see if she had any questions.
      May 20th- was thinking about cancelling
      May 22nd- ******************* negotiated back and forth and we moved forward
      May 25th- Thanked ***** and I for  "going above and beyond" / "we appreciate both your efforts" 
      June 25th- I advised via email to have written records as proof - this is a legally binding contract and they should consult an attorney for any potential ramifications of cancelling. (They already had been read via phone of critical date timelines/ loan approval/ and inspection period on the as-is contract that the sellers wanted.




      **The lending team at Regions was ready to drop her as a client with all the issues they had and attitude and can vouch for the delays the ***** made happen, requiring 2 extensions and almost not getting approved anyway. Many issues along the way. ******************* and I pitched in to help with a non-essential repair and a water heater valve Buyers did not follow lending instructions and thus needed additional paperwork every day, causing their extended hotel stay. I believe with her looming health situation and timeframe, frustrations of ******* being a lot of unexpected culture shock and staying in a hotel was very stressful and made them unhappy. The house was not their dream home and they had buyer's remorse. They decided to back out and would not return calls.

      I am rejecting this response because:  There are a lot of discrepancies in *****'s response.  We had one zoom call for the house on Fort Duquesna.  We arrived in ******* on June 5th.  We were not allowed to see this house in person until June 23rd as the Final Walk Through.  Why were we not allowed to see it??  ************ loan officer *********************** and her loan processor asked us for different items on a daily basis.  I provided everything in a timely manner and waited for the next request.  It was one of the most disorganized transactions I've ever encountered.  We never were told that there were any problems with ************ with them not approving us during this process.  We would wait days until they finally reviewed our last response with what they wanted and then for them to send the next email with requests.  ****** and ***** were personal friends (****** told me about visits at *****'s house), and I believe ****** knew about the prolonging of the timeline until it was too late for us to see the house and still fulfill the contract.  ****** called me after she heard that we backed out.  She begged me to make an offer with ********************  That ***** would take any offer at this point and that the ball was in my court and how we had the advantage.  I told her I wouldn't take this house if it was free. This wasn't from someone that wanted to back out of her funding us.  I don't care how much time has passed since then, the bottom line is we were involved in a scam between two realtors that wouldn't let us see a house that we had signed a contract for.  They should both be ashamed.

      I'm sorry we're at an impass.  My agent has documented proof of multiple zoom meetings.  Granted, buying a home in another State sight unseen can be difficult.  I stand my my agent.  She delivered contracts in advane of making offers and reviewed the contract terms that would be in effect once a contract was signed and further recommended to wait until binding a contract until the primary home was sold.  Yet, the buyers still wanted to go to contract sight unseen.  They had, and were explained, a timeline in which they could cancel with no penalty.

      I can't speak to why the seller would not allow access, but that was the case.  The Buyers still had time to cancel if they didn't want to move forward.  In the end, the buyers breached the contract.  They failed to close after the AS-IS inspection period ended.  I'm sorry they will not recoup their inspection money, but in the end, they ended up realizing that this property was not what they wanted.  Had they not spent the money, they may have ended up owning a property they did not want.  Not only did the agents not earn thier commission, they also came out of pocket $500 each to fix issues that were crucial to closing.  These buyers were not disadvantaged buy my agent, in fact my agent worked diligently on their behalf.  I'm sorry they can't see that.  This matter is closed on our end.  We will not be reimbursing them any expenses since it was their decsion to not honor the contract they signed.  I hope they find the home of their dreams and agent they like to work with.  I feel sorry for my agent ******* do deal with their negative reviews and loss of personal funds trying to satisfy a customer who doesn't own up to their responsibilities.

      I am rejecting this response because:  First of all, ***** lied to you on how many zoom showings we had at this property.  We had ONE.  We did Zoom with her on previous properties, but she didn't spell that out on her first reply as to where these previous zooms were made.  Our complaint is that ***** and ***** broke their standard of ethics that they signed up for when becoming realtors, by not showing us this house.  This house was empty the entire time.  I never heard back from *****'s requests to ***** (if there were any requests at all) to ask for us to see it.  What realtor would agree to this?!  *****, many people told me how good you are on responding to emails.  We poured our heart out to you via an email at the end of June and you didn't bother to reply.  And by the way, we have 6 months to file a complaint concerning the breach of duty that has taken place with ***********  Be it known, this is just our first avenue of intention to be refunded.  We thought it ironic the many times that ***** told us that she had to "stay in her lane", concerning reaching out to the bank, of which her friend ****** was in charge of our mortgage processing.  The level of detail that she quoted earlier (even though most of it was incorrect) on our application status again was breaking the code of conduct as a realtor.  Our complaint stands with the Better Business Bureau.
