      This title company sold me non accessible land. I am being physically block and land locked from my property. This company told me they would do all they could to allow me to get my money back due to this injustice, up until I actually requested it back due to their negligence due diligence and not warning me of a potential threat or hazardous neighbor involved. They stated today they will not help and so I have filed a claim in hopes they will honor their original word. What they have done is illegal on a couple aspects and they have not been willing to help regardless of my many requests.

      Business Response /* (1000, 6, 2022/07/20) */ Mr. ********* purchased property and obtained title insurance from our office. During the process there was a question as to if he would have "Legal" access to the property. Our underwriter attorney determined he did have "Legal access". After the purchase, he discovered that a neighbor was refusing anyone to travel to their property past his property and has now refused him Physical access. He contacted us and we explained he has a legal recourse to obtain access to his property and we have done all we can do to help him, but title insurance does not guarantee physical access as we only research the chain of title to insure there is a legal right of entry and have no way of knowing what an adjacent land owner's action might be after the closing. We have reached out to county officials on his behalf in an effort to get him assistance with the adjacent land owner but have had no success. We have previously explained how title insurance works but have been unsuccessful in getting Mr. ********* to understand. He has called my office and discussed that he had talked to an attorney and what they would need to pursue the case. We have sent him copies of the docs from his file to give to the attorney. In the last communicate he stated he could not go through the legal process and he became very irritated and would only scream into the phone and refused to listen or communicate. Consumer Response /* (3000, 8, 2022/07/20) */ (The consumer indicated he/she DID NOT accept the response from the business.) The agent went defensive and told me that they would not help me further and that is when I became frustrated. The county still says I do not have legal access to my property. This company is illegally saying because they write on a piece of paper that I have access but the least, the county, the state & the other property owner are all doing things in line with a title insurance claim due to negligence on their behalf. This company is fraudulent and has not taken responsibility for this occurrence. I was told that I would get my $10k back if that's what it came down to. As written above, the county cannot agree with this title insurance company on their claims. I should not have to pay for an attorney of the county attorney says that this title insurance is not correct in their findings. This company is using here say and the county is telling them otherwise. This company obviously does not want to answer for their wrong doings. Business Response /* (4000, 10, 2022/07/21) */ Mr. ********* now complains that Holmes County does not maintain the road to his property. Our company has no control over whether a county maintains a roadway and we do not insure title based on county maintenance records. County maintenance of a roadway is not the same as having legal access to a property. As we have explained before to Mr. *********, he has legal access to his property based on rights established in an unrecorded plat, and this is backed up by a title insurance policy issued by our underwriter. This means that if anyone makes a claim against his property based on title transactions in the public records, the title underwriter will defend his title. Title insurance does not ever guarantee physical access to insured property, however, and we have explained this multiple times to Mr. *********. Our company never promised Mr. ********* that he could get a refund for his purchase. As a title company, our job was to conduct a real estate closing by escrowing and disbursing funds to appropriate parties, which we did. We have no ability to get Mr. ********* a refund of his purchase. He would have to make that demand directly to the seller. Mr. ********* has been advised that he needs to seek legal advice regarding the post-closing conduct of his neighbors to block his access or regarding any claims he might have against the seller of the property for undisclosed problems with access. There is nothing more that we can do to assist Mr. *********. Consumer Response /* (4200, 12, 2022/07/21) */ (The consumer indicated he/she DID NOT accept the response from the business.) Please notice that this company openly admitted that the county courthouse does not agree with this company's findings & they admittedly said that their underwriter and the county attorney did not come to an agreement. There obviously is no integrity when it comes to this title company and I would recommend disbandment of licenses due to their insufficient work ethic and commitment to upholding their word. They said from the start that if they made the mistake they would pay out, they cannot prove they are legitimate in their findings and they should not be able to practice title insurance with their failure to uphold the law or their word.
