On July 19, 2021 my husband signed a contract with Mr. Tom Q. for the pavement of our driveway. We gave Mr. Q. a down deposit of $5,500 (50% of the agreed cost of the services to be rendered $11,000). He promptly cashed the check. On July 19, 2021 my uncle signed a contract with Mr. Q. for the pavement of his driveway and gave him a check for $1,850 (50% down payment of the contracted amount $3500). Mr. Q. worked on the property for a couple of days and then didn't show up again. He didn't call or explain why he was not completing his job. I called him multiple times and sent him text messages. He responded on Aug. 9 indicating his "roller" was broken and he would finish the job when the equipment was fixed. After one week I texted him again and he informed me he would come out on Aug. 16, then it was on Aug. 24. Every week I would follow up with him and he would tell me next week. His last communication with me was on September 27 telling me he'd finish the following week. He never showed up. It's now been over three months since we signed the contracts and he has not shown up or met the terms of the contract. We now want a full refund of our deposit so that we can hire someone that is reliable to do the job. We have to start from scratch as what he did is useless as too much time has passed. I am uploading copies of both contracts and copies of the cancelled checks.Business response

Business Response /* (1000, 5, 2021/11/05) */ My aslphalt paver burn up on my lot. I had to get the. I talk to them. We are going to get together go over motor rebuild & transmission all new hoses. I couldn't get some parts for my asphal power. I look around for another asphalt paver. I couldn't find one. They on back order. I couldn't fine one in the country. I check with my brother & he had psphalt paver. I went to St. Louis to pick it up. I been staying in touch with them. They send me a text right before they got a hold of you. I get a lot of texts. I didn't see there text I talk to them. We are going to get together go over the job & start work next week.
