      I applied for Brookside Manor Apartments on January 10, 2023, and such application was approved the day of January 11, 2023. I immediately sent the money for each application and then the $350.00 for deposit. On the same day I was called and informed that the apartment was mine and that the move in was on February 1st, 2023. I was sent the lease via email and had to be signed online, which for my understanding in most places leases has to be done in person and with Ids in hand to be sure of the people signing the lease. On February 1st, 2023, i went to pick up the apartment key and check the apartment out and see if everything was fine with it. When we entered the first thing noticed was the horrible smell of cigar, it had a couple of walls damaged, the balcony was dirty and not painted. The closet door where the A/C is located had fallen sideways. Probably they are just ************** but i have a 3-year-old sister and i understand when an apartment is given, it should be given in its best conditions possible, painted, clean and with the appliances in function. The same day I decide to go back to the office and notify them of my concern, also I showed them the pictures of all the damages seen in the apartment. The answer of the manager was to send her the pictures by email and that she was going to let her supervisor know. That same day February 1st, 2023, I let them know that I was going to be out of the state for a week, and that they had that time to fix the damages and by the time we came back we could move in. On February 6, 2023, I received an email saying that we were refusing to move in due to cosmetic damages, which is false since I was notified about my trip, and they had all those days to fix it. As I said earlier, I have a 3-year-old sister and if that fallen door would have fallen on her, I believe that it's not for us to fix damages that the tenants left in the apartment, it's the administration of the place. Due to this situation of them not wanting to fix the damages I let them know that I did not want the apartment, and that to please refund me the money amount of $2,965.00, which I was notified would be given back as soon as they found another tenant. On February 7, 2023, I decided to go personally to their office and talk to the manager and give her keys back. On the same day they repeated to me that I'll get all the money back except for the $350.00 of the deposit, meaning it would be $2,965.00 if they rented the apartment during or before the end of February. This was all said verbally, which I said I needed a letter notifying all that was mentioned, which was very unprofessional of them, and they made it by hand, without any stamp or logo of the apartments. In the letter you can see that it notifies what I mentioned before that I was responsible for the lease until it was re rented during the month of February and to be like that all the money would be returned. Days after I sent an email and I got notified that by February 28, 2023, new tenants were going to move in the apartment. Meaning they already had people ready to move in before the month of February ended. On February 21, 2023, I got sent an email saying the same thing mentioned before, that by February 28, 2023, somebody was going to be moving in. Precisely on February 28, 2023, I received in the mail a letter with a check of $185.00 only, and the rest of the money? Notifying that was the amount I was going to receive because we were being charged of the month of February rent and the deposit. But why if the damages that were in the apartments was from the before tenants, I immediately opt to go to the office to show the letter and to the personnel, they washed their hands saying that they had nothing to do anymore with that and that we had to send a letter to corporate. We notified this the same day of the move in, they did not want to fix any damages because it was not priority, on the 6th we notified that since they didn't want to fix anything we did not want the apartment, they had time to find new tenants. And the worst of this whole situation was that they said every time that we were getting our money back. Now we need that money to be able to move to another place. I got orientation legally and told that I had to get my money back, because I did not even live one day there. I lived in a different apartment complex for 4 years and never had a problem like this with any of the personnel of the administration, they were professional, they had everything fixed. I this can be solved because we are not talking about $185.00 if not $2,965.00 on the contrary, I will take legal action because we need that money back urgently.

      ******************** applied and was approved to move in to Brookside Manor Apartments and signed a lease agreement.  The unit was taken off the market at that time.
      ******************** picked *********** to the unit on 2/1/23. She contacted the office to report maintenance items that needed repair.  She immediately stated that she felt the unit was unlivable and was not taking the apartment.  At that time, we explained that the maintenance items were cosmetic and could be easily rectified.  ******************** would not allow ** to repair the maintenance items and stated we just want our money back.
      We explained to her that she would be breaking the lease and would be held responsible until the unit was re-rented.  Someone moved into the unit on 2/28/23.

      I am rejecting this response because: the fact that I have evidence and a letter was made by them saying that if the apartment was rented before the end of February any money paid was going to be given back. The money is needed urgently to find a place to live. I know people that are managers in apartment complex and theyve had the same situation with tenants and they give the money back because it can cause a *** for them.

      The letter ******************** and ************** received from our office stated that they would be responsible until the unit is re-rented or until the end of the lease term. The apartment was re-rented for February 28, so the lessees were held responsible for the unit until February 28.

      I am rejecting this response because: then how come the letter which I am attaching to this says clearly that if the apartment was re rented before the end of February any money paid was going to be given back. As I said before I know people that work in apartment complex and had the same situation with tenants and they have to give all the money back because it can get them to get sued. We are not talking of a couple of dollars we talking about $2,965. And thats money that I need to find a place to live.
