I was looking for a daycare for my toddler. My work hours aren't flexible as I am a finance director at a car dealership and we work long hours so it was hard to find someone flexible. I came across Mayelin at Home daycare. She was super sweet and reassuring that she could accommodate my needs. Her normal business hours are from 7am-6:30pm and anything after that charged hourly at a $10 rate and required cash at pickup. She also told me that she could watch my daughter on holidays outside of Thanksgiving, Christmas and New year if needed. This is exactly what I needed so I enrolled my daughter under those pretenses. Every time I needed her after 6:30 I was provided with an excuse. Her husband wouldn't allow her or that she just couldn't even though that's what we agreed to. I was stuck trying to figure it out on my own. The paperwork she made me sign stated she got two weeks off per year and so did I unpaid. For the week I needed in December, she still made me pay. Even though not written on paper she stated Dec was off-limits for taking a vacation even though that was never discussed to me prior to enrolling or in any of the documentation she just threw in my face to sign. There were days she would make me pick up my daughter early last minute so she could attend her child's school game and still charge me for a full day. Extra days that she would take off that weren't ever mutually agreed on that she would still charge me for and leave me scrambling last minute for a backup plan. My daughter was sick and out of respect for the other kids I took her out of daycare that week. She wouldn't let me use that as one of my vacation weeks and still made me pay. She makes us pay a week in advance. Today, I go to drop my daughter off at daycare to find out that even though she stated she can watch her on holidays outside of major ones that she can't. I decided this wasn't a good fit for me anymore and now she's refusing to refund me my money for a service I am not using.Business response

Consumer Response /* (3000, 7, 2022/02/03) */ (The consumer indicated he/she DID NOT accept the response from the business.) No , this is absolutely incorrect and i as well HAVE documentation. You cannot ask someone who doesn't speak your language to sign "contracts" in Spanish and understand them. FURTHERMORE we had a verbal agreement as well as text messages back and forth that I needed you on ALL holidays besides thanksgiving and Christmas . You also told me that you were flexible on hours after 6pm for $10/ hr due at pick up being that I don't have what most consider "normal" business hours, hence why you probably don't have these issues with other parents . This was the exact reason why I enrolled my child into her daycare . It was all lies from the jump. She never once watched my child after hours or on any holiday , in fact would give the excuse of "my husband won't allow me" . No one should be allowed to run a daycare with someone that controlling in the same household . She not only wasted my time but she caused me a lot of income loss with having to make extra accommodations due to her lack of honesty and integrity . She would contact us last minute and ask that we pick our child up so she could attend her child's game at school. Take random days off so she could spend time with her family . I understand she's entitled to a life but if you operate and run a daycare parents need to be able to rely on you and you're no where near reliable or professional. She would slander other parents and their children to me...ANOTHER PARENT. Tell me their kids are driving her insane. How is a parent supposed to feel comfortable keeping their child there when she's clearly under a lot of duress ? That's besides the point ! She states she has all this proof but I do as well . My child went to her daycare with a teddy bear nearly everyday and there was a reason it had a hidden camera and recorder in it which proved a lot about the type of woman and business owner that she is. I simply want my $150 back for service that was NEVER provided . I'm not mad because she didn't watch my child on one holiday . I'm mad at all the lies that I was fed and the lack of proper care my daughter received while at her daycare that my weeks of footage CAN AND WILL PROVE! I'm not trying to ruin her daycare . I'm not trying to cause her a "great deal of stress" as much as she has caused me but what I am not going to do is allow someone to steal from me maliciously out of pure spite because I DID pull my child out of her daycare due to evidence of yelling , screaming and being mistreated . That is my ABSOLUTE right as a parent . My job isn't to protect you , it's to protect MY child which I did . If other parents don't see that on their end they're blind and that's not my problem at all because their children are NOT mine . Let's however not act as if 3 other parents didn't pull their kids out of your daycare too.... I'm sure for similar reasons and maybe they won't speak up but I will until I get the solution that I want .
