On 04/26/24, we paid $361.90 for the delivery of 2 cubic-yards of limestone rock to Cape Landscape Supply, *****************************, **. The breakdown of $361.90 is $146 for 2 cu-yds of no. 57 limestone, $109 for a weed mat, $85 for delivery of load, and $5 for 2 sets of 6" stakes. The business failed to provide 2 cu-yds of limestone rock. What they provided was 2 cu-yds of limestone rock (55%), and ********** (45%). First of all, we trusted the company to bring us quality product (limestone rocks, not sand, silt and clay **** particles). Because we trusted them, we asked them to dump the material onto our carefully placed underlayment next to the driveway. When the truck was dumping the material, there was no way to see how much dirt was mixed in. As we were spreading the product, we noticed the load that was dumped was filled from top to bottom with dirt. This could of been rectified when we kindly asked them to come get the product and asked for a full refund. They refused to get the product, and refused any refund. They arrogantly said its just a little dirt and just hose it off. They told us to shovel it back into a pile on the driveway so that they would come pick it up. We are in our 60's and I recently had two surgeries. They committed fraud by delivering a completely inferior load of limestone! Our neighbors agreed that the pile had an enormous amount of dirt throughout the pile. My wife and I are shoveling the material back onto the driveway, which will take days. The amount of work we now have to do is MUCH more than just spreading out pure limestone gravel. We have to separate the dirt from the pile. In the end, there will be nearly 1 cu-yd of dirt and 1 cu-yd of limestone rock. The amount of pain, suffering, and emotional stress they have caused our family is unspeakable! We are documenting everything, and this will more than likely go to court to seek damages in the thousands of dollars that will be far beyond what we paid them in the first place.Business response

We already spoke with this customer: more product was offered, this offer still stands. There are no returns and no refunds since the product is already laid down. We already explained that there is nowhere near the amount of sand he is describing, offered another guy to go out and spread it but he declined. He feels that grass will still grow through the sand, we explained no matter what he puts down there may still be some growth he has to still maintain.

I am rejecting this response because:
Cape Landscape Supply is a complete joke. Their business practice and how they treat
customers are beyond words. They only offered to give us more of the same product!
Photos do not lie (see below)! What they did was scrape the bottom of the pile and
gave us DIRT. Nearly 45% of the load contained dirt.
I have a doctorate in geology and teach porosity and permeability to my students, and
totally understand physical properties of rocks, minerals, and soil. My wife and I spent
days trying to separate the dirt from the load, using water, air blowers, rakes, shovels,
etc.. After two or more weeks, we finally completed the separation. In the end, we only
had 1 cu-ft of limestone, not 2 cu-ft as purchased. So, my estimation of 45% dirt was
on the money. The owner described the matrix as sand. No, it was dirt, which is sand,
silt and ***** I checked the grain sizes under one of my microscopes to verify. When
using the blower, there were clouds of **** particulate matter in the air, which was
endless. They only offered to spread the initial load which is what we did not want,
since it had DIRT, lots of DIRT.
If we spread the initial product, grass grows in dirt, not in pure limestone rocks. We
have spread the word about their business practice and how they treat their customers
to our neighbors et.al., who ALL agreed as to the amount of dirt that their load
contained.
