      I had my pool put in by **** Hutto at Yeti Pools. 6 months later my deck has been starting to fall apart already and has now become a safety hazard. I have attempted to reach out to **** numerous times with no response. I have 1 year warranty on the deck and pool which I need to get settled because that 1 year is coming up. I will send a letter certified mail also but really need your help.

      Written items need to be addressed about contractual agreements and facts. 
      * Defamation of Character- which includes both libel and slander - is written or spoken injury to a person or organization's reputation.
      * Libel is written act of defamation  -  Libel actions have been taken against myself and Yeti Pools.

      First,  Mr.  Papasodero has been in breach of contract since 12/8/21 over 11 months

      Me to ************************: (12/8/21) Good morning **** If were going to cancel the screen enclosure you would get back $7,200.oo.

      ************************ to Me:  (12/8/21) Ok.  Let's just keep everything the same till I meet with him to do the cage.  He will be coming back by next week.

      At that point ************************ signed a legal binding agreement  for a screen enclosure of $ 8,500.oo dollars.

      $1,300.oo  Monies owed since 12.8.2021

      The understanding person I am, we just kept working on ************************ pool hoping he would pay monies owed or maybe hoped I would forget.

      11. Default / Termination: In the event Owner fails to materially perform any of the terms or conditions, contained herein,  the Contractor may at its sole option declare Owner In default and terminate this Agreement, white retaining all payments and deposits. This remedy Is in addition to any other remedies available under law. If It becomes necessary to retain the services of legal counsel or Institute legal, proceedings to enforce the terms and conditions of this Contract, Owner shall be responsible. for the payment of all costs and reasonable attorney's fees Incurred by Contractor as Incident thereto.

      A.) Contractor disclaims any warranty coverage in the event that the pool and/or related equipment Is not maintained in strict accordance with all recommendations of the manufacturer and the Contractor, or If the pool and/or related equipment Is damaged as a result of an act of God, inadequate or inappropriate soil conditions, misuse, abuse, alterations to Contractor's work, or any other circumstances beyond the control of the Contractor. ( Yeti Pools is not responsible for soil conditions or Acts of God, I underlined it right here since ************************ has not read his contract that he signed.)

      First ************************ has received this message from my Auto-Reply on sent by my phone date:  3.01.2022.

      Texts are periodically read with no notifications.  Please call if you would like a response.

      (All persons receive this message if they choose to text) Any adult would call if there is an urgent need, we are not a teenager based social media platform, we are a pool construction company.  

      Second, ************************ has never called the business and tried to speak with me, I have the call log.

      Third, I have now gone to my texts and viewed **************************** texts.  

      The first text was 10/13/2022  after hurricane **** my deck is becoming uneven.  (  Act of God water and soil damage, still in breach of contract monies owed since 12/8/21)

      Two more texts on a  Friday night and also on a ********* ******* hours are Monday thru Friday 9am - 4pm.
      NO phone call from *************************

      ************************ has been in breach of contract for monies owed there will be no work done on ************************ property.

      ************************ has now owed Yeti Pools $1,300.oo  for over 11 months and Yeti Pools completed his pool with monies owed.

      Should ************************ would like to continue his Defamation of Character through libel written words because he broke the legal agreement we have together.  Then I will contact my legal console to pursue all monies owed and attorney fees in which he signed a legal binding contract that he will pay for.

Multiple items need to be fixed before inspection is scheduled. This has been ongoing for 6-10 months. He is now threatening and harassing by text and in -person employee. I have a signed contract, videos, texts and voicemails with him and his subcontractors and bank statements. Multiple written items need to be addressed about contractual agreements and facts. * Defamation of Character- which includes both libel and slander - is written or spoken injury to a person or organization's reputation. * Libel is written act of defamation / Slander is the oral act of defamation . Both actions have been taken against myself and Yeti Pools. * Definition of Threat - a statement of an intention to inflict pain, injury or hostile action. Mrs. Customer malice actions are now in written word, on the internet and texts. * Definition of Harassing - subjecting someone to aggressive pressure or intimidation. No such actions have been taken, Mrs. Customer is always portraying victim. Malice actions by Mrs. Customer again. 1.) Signed contract with Mrs. Customer not Mr. Customer 2.) Yeti Pools took over Mrs. Customer pool construction project from another pool contractor because it was not going to be completed within the customers time frame. Yeti Pools ordered Mrs. Customer pool tile and after advising customer of the time frame, customer decided to go and find the tile on the internet and pay extra for the tile and to have it shipped to their residence on their behalf. After Yeti Pools received the tile ordered for the Mrs. Customers pool Yeti Pools had to pay 20% restocking fee. Also ordered a custom handrail for Mrs. Customer, 2nd time not within customers time frame another 20% restocking fee occurred. Started projected on 8/17/2021 filled pool with water the first week of November 2021. ( 3 months extremely fast considering material issues) Mr. Customer and Mrs. Customer were thrilled with the speed and quality of work at that time. Mrs. Customer is not disclosing all facts and trying to make her look like the victim. Mrs. Customer told Yeti Pools screen company not to come on her property again after being out to her property four times (documented through texts also I was onsite and the screen company brought a witness with them on the fourth trip because of Mrs. Customers hostile attitude) to come up with a solution to address a shed connected to the home. Mrs. Customer then went and hired another screen company on her own and took the monies owed to Yeti Pools to pay the other screen company. (Breach of Contract-no change order) Customer called the police on another person that was working on the property because Mrs. Customer was being toxic to him and she did not want to hear what he had to say. (Breach of Contract - communicate with or Interact in any way with any subcontractor, suppler or materlalman - of the Contractor) Mrs. Customer has advised Yeti Pools via text that anyone associated with Yeti Pools is not to be on her property. (Breach of Contract ) Mrs. Customer is now libel for phone texts and in written word to the BBB for accusing Yeti Pools of sending persons to her home to threaten her and intimidate her. These are not acceptable actions by Mrs. Customer. If this was to be true Mrs. Customer would have called the police like she has done in the past. Mr. and Mrs. Customer were well aware that someone was coming to put alarms on her door for the final inspection with the local municipality. Again twisting the truth to make her look like a victim. 3.)Yeti Pools has cashed all payments after customers agrees to payment through each stage of the building process per contract. Customer has a total of six payment draws and only pays each draw to move forward after satisfactory work has been completed to customers standards and Yeti Pools standards. Customer accepted all work at each draw time and paid with pleasure, no complaints. 4.) Yeti Pools has been to the customers residence three times since the pools has been filled with water to fix items that the Mr. and Mrs. have asked to be addressed. On one occasion Yeti Pools repaired issues the other screen company Mrs. Customers hired had created. (Paid for out of my pocket again). Have also sent out other companies to address pool equipment that the customer had said was not working but was working. Cleaned equipment and moved forward. 5.) All inspection have passed and met all municipality and State of Florida regulations and standards. 6.) Mrs. Customer has been a bully and toxic using the I'm the customer/client verbiage through the entire time working with her. Any more interaction with Mrs. Customer will be done through my attorney **** **** Legal Group. At that point Yeti Pools will pursue legal action to collect all monies owed and defamation of character. (Yeti Pools has texts, voicemails and now even more false libel written word to backup all facts)
