      Date of Transaction was January 28th 2023. I paid about $7500 for a used car. The owner mentioned that the car report checked out meaning everything was in great condition. In a weeks time frame the car did not blow cold AC and a fuse exploded as I got home. I have a witness that was with me in the car. The owner tried to fix it, but was unsuccessful and basically stopped picking up my calls and never resolved the issue. I went the whole summer with no AC and two kids which is inhumane. A few months later I started hearing a sound towards my right tire. Found out brake pads were extremely low, calipers and rotors needed to be replaced. I replaced them $1000+). The other day I went to get a diagnostic for my AC and the amount of things that need fixing is ridiculous. Also, found out my brake fluid is leaking. To fix the AC and Brake fluids come out to almost $4000. That would be $5000 spent in 7 months with the car that I bought for $7500. I don't understand how someone knowing I had kids can sell a car that messed up to me. I'm asking for a replacement!

      To whom it may concern,

           The customer bought a 2008 Hyundai Tucson on January 28, 2023 (approximately 8 months ago). The customer checked the car personally and took the vehicle for a test drive prior to purchase. We are a used car dealership. The cars we sell are sold AS IS. The customer was made fully aware that the vehicle would be purchases AS IS and with NO WARRANTY. Please see the attached signed document. In March, the customer contacted us regarding issues with the air conditioning after purchase of the vehicle. We made every effort to assist the customer to help and fix his air conditiong. We took the car to a certified mechanic shop for the customer and paid for the diagnostic service for him. Please see attached for the receipt/document from the mechanic shop. We answer all of our phone calls and we had multiple conversations with the customer. Regarding the brakes, it is important that the customer maintain them routinely. Brake pads need to be changed on a routine basis. The car does not come with a lifetime warranty or coverage of "wear and tear" issues such as the brakes. Again, it was purchased "AS-IS". We wish the customer all the best.

      I am rejecting this response because: John, i'm not here to say you sold me a bad car. I like the car, it's perfect for me. I think you have amazing knowledge about the industry, plus you're a genuine guy. I know you will do the right thing. The AC wasn't blowing cold air when I drove it off the lot. That's my mistake for not checking. I came to you with full confidence that you would help me. You're absolutely right about trying to help me because you did. Did anything get resolved? Not necessarily. Therefore, I went and got a second opinion about the AC at Sloan's automotive. John told me that the reason the AC wasn't working was because of the control panel. I told Sloan's automotive about the control panel not working properly and they said it works just fine. I attached a screen shot of the full report they did on the AC. I understand that this car was sold AS IS and with No warranty, but I'm not asking for a replacement for this vehicle. I'm simply asking for the AC to be fixed. You cannot live in Florida without AC. Thank you!

      On sept 6, 2022 we purchased a vehicle and that was presented as having no problems. On Sept 7, 2022 we had issues with car and took to a mechanic who advised us the repairs were more than the cost of the vehicle. On Sept 8, 2022 we contacted dealer to have his mechanic look at the vehicle to determine if he agreed with assessment. John states he would look into it and then in the evening said that we had to deal with the lein holder to resolve the issue. We were willing to find an agreeable solution however feel he knowingly sold us an vehicle that we would not be able to drive. We now have a car payment on a car we can't drive.

      Business Response /* (1000, 5, 2022/09/14) */ John's Motors sold a 2003 Kia Sorento to this customer. The customer inspected the vehicle on the lot and also took it for a test drive. We emphasized to the customer that we never sell a car without having the customer inspect and test drive the vehicle. After the test drive, he said that he liked the car and wanted to purchase it. The customer was made aware that the car has no warranty. The customer signed the "AS IS warranty disclaimer". Additionally, he signed the Buyer's Guide indicating "as is no warranty". The customer chose to finance this vehicle. After his approval, the car finance company became the lienholder and has the title of the car until the customer pays it off. The car no longer belongs to us but rather the finance company. Please see attached for the warranty disclaimer and Buyers Guide for your review. Thank you for your time.
