4/5/22 around 11:45am - I ordered 2 bagel sandwiches at Clearwater Bagel. While waiting to receive the food, my daughter wanted to wash her hands. They refused my daughter to use the bathroom. I reminded them, that they are to provide one to the public. He (would not provide the name) got belligerent with me. I asked for a refund because she would not be able to wash her hand before she ate. He told me no and they were closed now, and I had to leave. He said that they have had a carry-out permit for 16 years, and he knows laws; he was not letting her use one. I never got loud; I was just on the phone getting the statute number so I could show him. Luckily there were no other customers, because it was embarrassing that he would act like that over a 12-year-old wanting to wash her hands. He started slamming stuff and walked aggressively to me, so I left. The 2021 Florida Statutes Florida law requires each public food service establishment to maintain public bathroom facilities according to the Florida Building Code, which requires public food service establishments "serving food or drink on a take-out, carry-out or delivery basis only which provide no seating... to provide a minimum of one bathroom accessible to the public" (Building, Section 426.4.1.1). 509.221 Sanitary regulations (1)(a) Each public lodging establishment shall be supplied with potable water and shall provide adequate sanitary facilities for the accommodation of its employees and guests. Such facilities may include, but are not limited to, showers, handwash basins, toilets, and bidets. Such sanitary facilities shall be connected to approved plumbing. .... (2)(a) Each public lodging establishment and each public food service establishment shall maintain public bathroom facilities in accordance with the Florida Building Code as approved by the local building authority. **************************
