      Hired JC Marine Services to move my 21.5' Hurricane Deck boat from ***************, ** to *************, **. Signed contract and gave deposit of $400 on April 19, 2024.Had numerous conversations that we needed the boat taken out of the ****** in ** before **** 21st. Were told that there would be no problem in getting boat to ** by the date requested.On May 1st, we contacted him, and he said that it would be delivered within 2 to 3 weeks On May ********************************************************************** two On May 18 contacted him again he said he had not heard back from his driver and whoever was closest would be there to move the boat On May 24 contacted again he said it would be another week before he was able to get the boat On May 28, he told me it would be 2 additional weeks before he could get the boat On May 28 he offered to give back my deposit because I was not happy with his service I told him yes; I want my deposit back. He wanted me to send an email stating that we would not file a report with the BBB against him or bad mouth him on social media. He threatened that if we did, he would put a lien the boat. He then went on about my being in breach of contract, but he would let me out as long as I did not say negative things about his company. He also stated that he was not about to give up a large paying job for my small job which he was now calling a back haul. Back haul was never mentioned in any email's, texts, or contracts prior to my complaining about him not showing up to do what I hired him to do.I sent the email he requested, and he said he would ***** me the $400 deposit back and I would have on Monday, June 3.On June 3 I texted asking about the deposit refund, he asked for the Zelle number again and said I would have the next day, June 4. I have still not received my deposit money back. (June 5)I have retained all emails and text proving all of the above is accurate.

      At no time was he promised a date

      hd was given a back haul price and show me anywhere he was promised may 2nd to the contrary he was told

      numerous times he was reminded what a back haul was and we are in the middle of the busiest time of year like others he heard what he wanted to hear and to h*** with pricing or what a back haul is he was a week away and read a gossip page about me  a couple people who had no legit complaint and HE canceled and I did agree for a refund as long as he didnt do exactly this 

      I let him out of his contract 

      show me where he was promised a date and after HE asked to cancel I agreed as long as he didnt go on line slandering me

      This is all in the public arena and I also informed him if he dropped it he would be issued 

      I was on the road and as this took ten days to respond I dont have time

      to babysit and coddle when I have clients booked out for months who understand the timing and logistics involved and yes ina *** of zero accountability if you breach a contract no one has to pander to you  he went on line and filed this over 400 bucks ? He can rectify the situation and handle like he said. I was in touch with him **** near daily from the road and dont need this aggravation or the smallest hall of the season doing  a back haul for someone who lies puts words in my mouth snd then demands time other people waited for patiently Show me where it says May 2 just like he was told if I was going to allow him to BREAK A contract id refund his deposit. Doesnt mean its at his demands heck when I leave a hotel they hold my money up to a week. I knew he wasnt going to keep his word and he didnt

      I am rejecting this response because: Of the following:


      The agreement for moving the boat was for on or around May 21st May 2nd was never an option, or a request was made
      I was never told I was backhaul nor is that said in the "contract"
      I never asked to cancel - on one of his rants he said "what, do you want your money back? and I said yes. I never said don't come take my boat or and never used the word cancel
      Contract was not broken by me.  As far as he's concerned, I am still waiting for him to come and get my boat. He has never shown up, he is in breach of contract.
      Threatens to hold my money hostage - after he offered it back only "IF I DID NOT PUT IN A COMPLAINT"
      $400 may seem like a small amount to him, however, it is a large amount to some people.
      This is now about business integrity, Would I like to get recoup my deposit, absolutely. Do I ever think I will, absolutely NOT. 
      At no time ever, should a consumer feel bullied or threatened by a business owner. Texts and emails laced with profanity and lies is unacceptable behavior. Deceitful business practices should never be accepted.
      I can and will USE all available avenues i.e. BBB, DOT, Consumer Complaints - WITHOUT the fear of retribution.
      I am also attaching copies of several of his text messages showing what I am claiming is the truth and I have many more to share if needed.

      The only time I got upset was when I was either in traffic or Id ask them to give me a little time to respond. I haul very large boats that are oversize and have the public safety in mind.

      Now hes just flat out go ahead show me where it said Ill pick it up at certain date I was able to open any link of the BBB wants to intervene by all means please go ahead you knew you were Back Haul nobody would just go all the way out to the middle of nowhere to lake for 200 mile **** We discussed that once twice many times you had to be fit between two ****s. Now if I have to go through all my texts to find it, you wanna start telling the truth now.? This is why I get annoyed because people twist things to their liking. We do have text that say Back Haul and Haul dont go to your lying to the BBB.

      Now youre trying to say waiting for me?  you found out that nobody will haul that boat for the price I  gave ? out in the middle of nowhere with all your demands?
      You absolutely said cancel it. Why would I haul for somebody whos making complaints about me? Why?so next you can make a complaint and say I scratched your boat next?Obviously something not adding now you want refund, the boat hauled do you want me to wax it and fill it ? how am I breach your contract? If you said yes, cancel it? You dont even make any sense this needs to be closed. This is not legit complaint you want to refund and you want the Boat Haul and its all because of me what are you gonna charge me for extra storage you had to have it the week that you flipped out and Im not gonna talk to somebody in public or youre not even making any sense, so which one do you want plain and simple you want to refund 

      you could always put it back up. If I dont come through Im not hauling that boat. I wouldnt touch that boat. Im sure a lot of other guys wont either see you are a backhaul or slash in between ****s means you got special pricing because you wait until one of my trucks is in the area you know this *** youre not stupid youre just playing stupid

      I am not lying to the BBB I take my words and my emails very seriously.  The texts I have sent to the BBB are only a small amount of what I have.  I will gladly forward the rest to the BBB if requested.  I have nothing to hide and I have nothing to lose.  I can also forward a copy of the contract, showing that it does not say Backhaul anywhere on it.


      Saying that you wouldnt touch my boat is a moot point wouldnt let you within 1000 feet of it.

      We could go round, and round on this with the BBB playing mediator forever.  I will not take my complaint down until I receive my deposit money back. Once I have a cleared check in my bank account, I will tell the BBB that I am satisfied with the outcome of my complaint, and I will never contact you again.
