Solar panels were installed > 1 year ago by this company They now need to be removed due to roof damage Energy Smart has not returned any of the dozens of calls made over the past few months in effort to secure an appointment for removal of the panels. The roofing contractor has now removed himself from the project due to gross negligent delay on this company's partBusiness response

Business Response /* (1000, 5, 2021/11/19) */ Contact Name and Title: *****, President Contact Phone: XXXXXXXXXX Contact Email: *************@gmail.com First of all, the person making the complaint is not the customer and she lives in another state. We have spoken with her several times regarding her request to remove the solar panels for re-roofing. She does not call the company directly. Her communications is with the salesperson, who has not been affiliated with our company for the past year. The roof was inspected by our company and there is evidence of BULLET holes on the shingles, which is why the roof needs to be repaired. She was advised of the costs of new attachment hardware because the existing roof attachment hardware cannot be reused, due to the amount of time and effort to clean the sealant. However, she wants to pay a fraction of the cost of the materials and also demands that the labor be free of charge. She has chosen to file complaints because she cannot have her way and get free services from us. He is elderly and non computer literate & has noone else to advocate for him but me. I am suspicious that this company has taken advantage of my father due to his elderly age. I have contacted Energy Smart myself directly from my mobile phone multiple times (see attached) & have only been able to successfully make contact w/ contractor w/ aid of a prior company affiliate. I was told that panels would be removed, a cost was quoted & agreed upon, & company has neither presented for said work nor formallyvrescheduled. We are not negotiating costs - we have been advised of a **** fee for service which was verbally agreed to without issue. Solar panels have been placed by this company, there is damage to the roof and these panels need to be removed in order for roof repair. The home houses my elderly father & 2 mentally handicap residents. Continued leaking/safety threats continue until resolution ensues. We are desperate for assistance in having the contractor responsibly & rightfully upholding verbal agreement for service Any help is urgently needed. ****** ******* ***** Business Response /* (4000, 17, 2021/11/22) */ This customer is running a home care service from his home, therefore having multiple handicapped residents in the house is part of the business being conducted on the premises. We are not obliged to remove any panels. No one took advantage of your father as he is capable of making decisions if he is capable of providing home care for multiple residents, which *** or may not be legal. Please find another contractor to remove the panels. As for your agreed price of ***** you should consult with the company rather than an ex salesman, who does not have authority to enter into any contracts or agreements on our behalf. As for damage to your fathers roof, they were caused by the multiple bullets that were on the roof and penetrated the shingles. Please find another contractor to full fill your needs as we are not obligated to provide any services after one year and it's been over two years. You are free to file as many complaints as you wish. Consumer Response /* (4200, 20, 2021/11/23) */ 've honestly never encountered business etiquette like this before The company that placed the panels agreed to remove them and now is refusing to remove them because I had to seek help to initiate a response after dozens of unanswered calls (?). We weren't asking for a freebie or favor...we are paying customers that were advised that the work would be done. As readily as Energy Smart replied to BBB it could have responded to us as clients to advise of a change in plans or an issue with the proposal or whatever. After ignoring multiple -multiple attempts to secure contact they now refuse to proceed and I'm honestly dumbfounded; truly. I am totally dissatisfied with this offensive and uncalled for response.
