We have a service contract with All Year Cooling. The contract has already been paid for, but we cannot get them to honor their end of the contract. Here are the specific details of the issue. On Sunday, 9/3, I called the service line because one of our covered units was freezing up. The scheduler set up an appointment for Wednesday evening. Wednesday 9/6 - Confirmation call in the morning. We waited home all evening and no one showed. We finally had to call the service line ourselves at 930p, and we were then told they were not coming and we were rescheduled for 9/7.Thursday 9/7 - Confirmation call in the morning. My wife took off work to be there for the technicians. No one ever showed. She called and was told that the technician could not come and we were rescheduled for 9/8. Friday 9/8 - Confirmation call in the morning. My wife took off work AGAIN to be there for the technicians. No one ever showed during the 2p-4p window. We finally called at 530p and were told that the technician wasnt coming and we were rescheduled for 10a-12p on 9/9. We were assured that we were first on the list.Saturday 9/9 - Confirmation call in the morning. At ****a, we called to get a status and we were told the technician was on the way. As of ****p, there was no technician and I called back. I was told that they were 30 minutes away. I spoke to a manager who had no explanation and said that she could do nothing more than say she's sorry. I have requested a call back from the general manager. We have paid our part of the service contract and All Year Cooling seems to have utter disregard for their commitment or customers.

I paid $5,600 for a new A/C unit about a month ago and they were supposed to send a ********* to fix the door where the A/C is. I have called multiple times and they have made an appointment twice and nobody has showed up at the house. They took my money and have not finished their work. If they can finish the job, they should pay me for getting their job done. I should also receive a bill credit for this.

Date of the transaction: 12/20/22 Amount of money paid to the business: $6,759 What the business committed to provide you: All Year Cooling committed to providing equipment installation and other related services as specified in the contract.Nature of dispute: The dispute arises from multiple issues and breaches of contract by All Year Cooling. These include:Misrepresentation of the equipment: All Year Cooling recommended and sold a variable speed **** unit, promising that it would function as a variable speed along with its benefits However, the unit was not set up properly and still does not operate as intended.Compatibility issues and misleading information: The company falsely claimed that the existing thermostat was compatible with the variable speed unit, leading to further complications and additional expenses.Inadequate installation: The system lacks a properly functioning return air system, which is a key component required for proper system operation and efficiency. The absence of a functional return air system prevents adequate air circulation, filtration, and dehumidification.Non-compliance with code: The installation performed by All Year Cooling does not meet standard code requirements. This failure to comply with industry standards and regulations compromises the safety, efficiency, and overall functionality of the **** system.Excessive humidity and compromised air quality: Due to the inadequate installation, the current humidity levels in my home exceed 50%. This has caused significant discomfort and potential damage to the property. Failure to address concerns and lack of customer service: All attempts to contact the company regarding these issues have been ignored, indicating a lack of responsiveness and failure to resolve the problems.Whether the business has tried to resolve the problem: Other than selling us a compatible thermostat and free installation, which wasn't completed, all issues remain.

I am rejecting this response because:

Subject: BBB Complaint - Rejection of [Company Name] Business Response Due to Lack of Communication and Uncovered Breach of Contract Regarding Work Permit

      Dear [BBB Representative],

I am writing to express my dissatisfaction and formally reject the business response provided in regards to my complaint. After conducting further investigation, I have uncovered a major breach of contract concerning the lack of a required work permit for [nature of the project], which has breached contract and caused issues with my entire **** system.

At the time of the original complaint, I was unaware of the companies failure to obtain the necessary work permit for the **** project. As new information came to light, I discovered that their actions not only violate local regulations but also constitute a significant breach of our contract.

The absence of a proper work permit is a clear violation of the terms and conditions we agreed upon, and it has put me in an extremely vulnerable position as a customer. The nullification of my **** system due to this negligence has raised significant safety concerns, which the company has failed to address adequately in their response.

Furthermore, the substandard quality of workmanship provided by them as evidenced by their neglect to follow the basic checklist needed for **** contractors, has led to numerous performance issues with the system.

Despite the gravity of the situation and my attempts to communicate my concerns, they has not reached out to address the uncovered breach of contract or the city's fines, exacerbating my frustration as a customer seeking resolution.

I urge your assistance in seeking a more comprehensive resolution, as my primary concerns revolve around ensuring my **** system's safety and functionality. The gravity of this breach of contract cannot be understated, and I firmly believe that [Company Name] must be held accountable for their actions.

I trust that the BBB's involvement will help urge Florida ****  to take these issues seriously, initiate a dialogue with me to address my concerns, rectify their negligence, and provide a just resolution for the considerable inconvenience and financial burden they have caused me.

Thank you for your attention to this matter, and I look forward to your continued assistance in resolving this pressing issue.

      Sincerely,

      *******************************

      - July 18, 2022: I purchased/financed a brand new **** unit from an All Year Cooling salesperson for the total amount of $5609. - August 9, 2022: An All Year Cooling installer came out to install the unit. - April 23, 2023, almost 1 YEAR AFTER I purchased the **** unit, a man left a non-descript box at my front door. Upon opening the box, I deduced from the enclosed manual that the contents were an **** heat element and its respective breaker. I realized at that precise moment that these components had NEVER been installed back in August, 2022. I contacted All Year to inquire what the heck happened. At first, no rep I spoke to knew what had happened. Finally, the installation manager advised me that she would pull all the records regarding my purchase and "installation" and get back to me. When she finally responded to me, she stated that the installer had written "complete" on the installation work order although the heat element was actually on backorder at time of installation.I was NEVER informed that the heating element was on backorder by the salesperson OR the installer. I would have NEVER purchased the **** unit from All Year Cooling if I had known that one of the components was on backorder. It seems that this information was CONCEALED so I would not be deterred from purchasing the unit from them.Since I did NOT receive 100% of the goods I purchased i.e. missing heating element and breaker, I believed that All Year processing a partial refund would be fair. The president of the company responded to me with an insulting resolution at which time I decided to dispute the charge with Synchrony Bank.I would like for All Year to retrieve the unit and refund me my money! Because of my experience with them thus far, I would NEVER trust them to operate in good faith even if I kept the unit.

      Hello,
During the time of installation there were supply chain issues and the heater for unit was on back order. The heater has been installed since 4/13 and the customer refuses to have the final inspection completed. The customer is requesting $2300 of a reimbursement for a heater that she would not have used in the summer months. In the state of Florida, a heater is considered an accessory and sold separately from the air conditioning system. We have offered her $1,000 for the inconvenience in which she declined. We apologize that ***************** felt misled however, she has a fully functioning AC system and has since the day of installation.

      Complaint: 20212701

I am rejecting this response because: During the installation, All Year Cooling neglected to advise me that there were supply chain issues and that the heating element was on backorder. If I had known this, I would have NEVER purchased the **** unit from their company. To date, the heating element has NEVER been installed. As a matter of fact, the heater and its respective breaker are STILL in the box that was dropped off on my porch on 4/23/2023, 1 year AFTER I purchased the **** unit! (See attachments) Why are they LYING about an installation that never transpired? Additionally, how is it possible that I refused a final inspection if the heater was NEVER installed? Why are they LYING about a refusal that never transpired? By the way, I purchased the unit back in July of 2022 and had NO heater in the winter months of 2022/early 2023. The fact that I live in Florida and may not need a heater is IRRELEVANT. This is an argument that only a fraudster would use to avoid recompensating a customer for the **********************'s malicious concealment and neglect. I purchased a HEATING, ventilation, and air conditioning (****) unit and did NOT get everything I paid for - the HEATING element is STILL MISSING. The president of the company, *****************, offered me $500 NOT $1,000 - ANOTHER LIE. It is clear that All Year Cooling has NOT been honest regarding my experience with them. Apparently this is not the first time All Year Cooling has deceived its customers regarding missing heating elements - there are similar complaints to mine that have been submitted to the BBB. A fair resolution at this point would be for All Year Cooling to retrieve the **** unit and refund me the ***** purchase amount OR recompense me $2000 for its malicious concealment of facts regarding the heater which I paid for in July 18, 2022.

      Sincerely,

      Better Business Bureau:

In order to simplify what has already been a mismanaged, complicated, and stressful experience, I agree to receive a $1,000 MONETARY recompense from All Year Cooling instead of having the whole unit removed. All Year Cooling also needs to commit to INSTALLING the heating element/respective breaker that were NEVER installed. Once the monies are received and the heating element installed, I'll gladly schedule an inspection in order to finalize this ordeal.

Please advise what payment method All Year Cooling will use to recompense me.

We had a brand new AC installed two years ago. Just recently, we had an issue with our drain line from our handler in our attic to outside our home. It was duct taped to the rafters and had dropped due to the heat. The coupler between the pieces of PVC had come loose and was leaking through our ceiling. It took over 24 hours for a technician to come to our home and assess the situation. It took over a week, after multiple missed appointments, for a technician to come to our home home and strap the drain line properly. We are now ending week two and still have had nobody at home to repair the water damaged drywall on ceiling. We have made phone calls every day to AYC, and they repeatedly have told use that someone will be there today or someone will be there tomorrow. We have have been given multiple time frames with nobody showing up. We do not receive return phone calls when trying to contact. This is terrible customer service and Im sorry I used this **********************. I would not recommend them to anyone.

May 2021 I contacted All Year Cooling to have my AC replaced. This has been a nightmare since day 1. It took the tech over 8hrs to install the unit. An hour after leaving, we noticed the dripping water. Another Tech was sent out to fix the leak which resulted in replacing the piping. He was surprised at the work the original tech had done and kept apologizing after inspecting the entire unit. We have since had to call on numerous occasions to have the unit repaired as it stops cooling and the fan on the outside part of the unit does not work. The unit is only 2yrs old. My old unit lasted 15yrs with only calling for service 2x total. I have repeatedly asked to speak with the owner and have never heard back. If the company cannot properly install ******** the unit I am requesting a full refund and expenses for a new unit from another company.

I recently had my AC unit replaced with the request specifically for a Rheem 3 ton unit. My contract indicated Rheem Make etc. However, after installation I see that there is a RUUD AC unit with stickers indicating Rheem sales. I called and spoke with sales who adamantly stated that the units are the same, he asked me to ****** the model number to show that the unit is Rheem which is the same as RUUD. Apparently, the parts are interchangeable and very similar, but the brands are different. The sales agent went as far as to say that RUUD/Rheem is the same company. However, RUUD and Rheem are not the same company. The offered solution was to add the Rheem emblem. Is this what is done??? Just add a Rheem emblem to a random brand. This is just poor customer service. The solution is to have a Rheem manufactured product installed as requested. I am very disappointed, especially seeing as I had a long conversation with the salesperson regarding quality service prior to the installation.

April 2023 i requested an appointment for air ducts. I was told I needed an AC and insulation. ****** that i paid in cash..The next day they were there to blow in insulation and install a new ac. The new insulation blew through the air ducts. They sent a specialist and said the duct work was rotten, he patched them so the insulation wouldn't come through and said he would speak to his manager about this. I have made several calls and spoken to many people at this company that said they would talk to management and call me back. No one has called.. I still have no resolution as to why I was lied to about my air ducts and scammed into a large purchase that was not warranted. The purposeful avoidance of resolution speaks volumes. I initially had them do an FPL loan and quickly tried to cancel it. I spoke to ****** to cancel the loan and contract. I have been given the run around since the first encounter. I involved my daughter (since I feel i was scammed) to help me resolve this and she is the one that said speak to ******, she will take care of it. No one has. I am hoping all year cooling will resolve this issue. I will also be filing a complaint with the attorney General on scamming senior citizens. Your prompt attention in this matter would be greatly appreciated. Thank you.
