On 8/7/21 I met with Juan, the owner of Pura Vida Tropical Gardens, LLC. We discussed relandscaping the entire yard. the price was $15,000.00. He said when I sent the deposit of half ($7500.00) I would be put on the schedule which was about 4 weeks out. On August 9, 2021 I sent him check ***** in the amount of $7500.00. The check was posted 8/12/2021. Juan at Pura Vida has taken my money without doing the work for more than 4 months now. We kept in contact on a weekly basis by text and he kept reassuring me that he would start work soon. He never showed to start the work. I wouldn't know what happened until I contacted him. We met again in person 10/11/2021 to go over details since he said he would be starting on October 18 or 25. On Monday Nov. 29, in a text he stated he would be there the next Monday, December 6. He did not show Dec. 6 and there was no explanation until I contacted him by text which he said he will be there now on Monday December 13. This is the same thing he has been saying almost on a weekly basis. I do not believe him anymore. I asked for a refund of my deposit. He said it would be 45 days to get my money back, but he will definitely be there on Monday Dec. 13 or I could void the contract. I told him I will give him until Monday Dec. 13 to start the job or pay me $3500 on Monday Dec. 13 and the remaining deposit by 12/31/2021. I told him that I want the job completed in 3 weeks. I am concerned that he would rip out the existing landscaping and then not finish the job and there would be dirt in my yard until he feels like getting to it. Please help me to get my money back by December 31, 2021. I really would prefer to get my money back because all trust is broken. I have photos of text messages if you need them. I am at my wits end with this company that has been holding my $7000 interest free for months. I have asked for a refund multiple times.Business response
