We don't know who this person is. If there was a $1000 deposit we'd like the transaction details. Any deposit we take is typically non refundable. That's how any dealership operates. If the deposit was refundable there would be no function for it.

On 5/23/24 looked and drove a 2012 **** escape. Asked multiple times if the transmission was ok and every time said it was. Test drove vehicle and all seemed fine. Decided to get the suv. Not after 10 minutes the transmission started to shudder and start to slip. Turn right around and brought it back. ***** insisted on going for a test driave and confirmed that there was an issue. Solution was to get me in a more expensive vehicle. Explaind that i only came there for that one vehicle. Was given to run around and was told to wait for **** and *****. After about an hour they show up and try to tell me oh well. After going back and forth for 2 hours their solution was to only give me back $1600 and keep the rest for "taxes". In a time crunch to get a vehicle for my wife i had no option other then to leave $600 short. Business is shady and they should not have one.Initial Complaint

Bought a *** ******* one week ago for $3500 cash plus $300 in monthly payments and the *** is already having transmission problems, won't shift into 3rd gear, won't go over 40mph. Visited the Deland store, where I bought it, in person yesterday and the salesman said he would have the owners call me, but they have not. Over the weekend of 11/11/23 I saw a 2006 ***** Odyssey for sale at Car Factory ******. I messaged them on Monday November 13 inquiring as to availability. I was advised the vehicle was "popular" and for them to hold it until I could get there to see it, I was advised I could pay $500 via Zelle. I sent the $500 and was able to find someone to drive me the more than 1.5 hours to their location. When I arrived Manny was with another client so I looked at the van and noticed a few things that I was concerned about, but decided to test drive it to see how it did. For a "popular" vehicle...it would not start and had to be jumped. I was also advised it had been sitting for a while. The drivers side back door did not open, the seat behind the drivers door was in very bad shape. Once they jumped the vehicle, I put it in reverse and their was a very distinct grinding noise. I got it on the road and immediately the vehicle had loud banging noise coming from the rear end of the van. I turned right back around and took it back to Car Factory. I advised ***** that I did not feel the vehicle was safe and that I would have to pass on it. He took the key and said he understood, and I asked about the $500 and he told me to call ***** and he would take care of it. Attached are the conversations between Car Factory (*****?) and I. I am the sole caregiver for both of my parents, and this was a vehicle to take them to and from doctor ************ and hospital visits. When I did not get a response from them after 48 hours, I wrote a review on their website 11/15. Approximately, an hour later I was advised that the refund was "under review". Almost immediately after receiving that text, I received a text "You left a bad review after refunding it? Wow. I'm canceling that refund." After advising review was posted prior to refund notice being sent response was "I'm 100% canceling it if that review is there in 5 mins" I deleted review. 11/17-still no refund.Initial Complaint

This business is nothing but scams and fraud. Not to mention they falsely advertise. I initially messaged this company through ** marketplace looking to purchase a 1999 Honda CR-V. The ad stated that the car has 200k miles and had a negotiable price and seemed worth it. I was out of town and couldn't come that same day and really wanted this vehicle based on the description so I ask if they could reserve till I arrive (was coming from west palm beach and they're around orlando). They said I can't reserve it unless i put a deposit and i said i dont mind as long as it's refundable if i dont buy the car. The seller "Tom" said yes so i proceeded to send the $500 and waited until the next day to see the car. I finally arrive after several hours of traveling and immediately i notice that i was scammed. The car was advertised at 200k yet upon arrival the car's odometer literally read 271k. The ad was 71k miles off!!!!! Additionally the car was smoking upon starting and test driving and the smoke was so bad i was having difficulty breathing. The ad was also incorrect about several other factors such as: It stated the suspension/handling were a 10/10 but it was more like a 2/10, stated no smoke and no leaks yet the car was leaking oil and burning it too, said extremely reliable but literally left me and a worker there stranded on 2nd test drive, stated keyless entry yet that didn't even work, and stated that it runs and drives perfect despite that it left us stranded, smokes, leaks, and can't even drive straight. After all this I tell them I'm not interested in buying the car as I was blatantly lied to. They took my $500 deposit, told me it was refundable if the car wasn't to my liking, and then proceeded to refuse to give me my $500 after blatantly lying about all of that as well as lying about the car's information from the odometer reading to the handling. I'm in the process of getting my $500 back. I was scammed by fraudsters who're also liars. I need my money back.Business Response

This complaint does not tell a truthful story. The customer did put down a $500 deposit on the vehicle in question. It was clearly explained that the deposit was "non refundable" as we would be holding the car for him and not selling it to other potential clients. When he arrived he immediately asked for a discount. Finding little things wrong with the vehicle. After some back and forth we agreed on a price. The customer then again changed his mind and proceeded to tell us the car needed things fixed. We agreed we would do the work prior to the sale. Our mechanic work on the CRV Saturday but did not finish everything until Monday. At which point the vehicle was ready to be sold. The customer was upset he had to wait and wanted his deposit back. Again changing his mind. Clearly after everything we did to satisfy the customer and potential sales we missed out on, the deposit remained non refundable. I bought a chevy Cruz on Monday 8/1/2022 from Car Factory in Debary FL. They gave me a $500 discount for the AC condenser which I bought and replaced a couple days after in which the mean the car was parked at my home since the AC didn't work. On Friday morning 8/5/2022 we started to drive the car towards our destination and in 16 mins the car started to over heat and smoke. We parked the car on the side of road and called a mechanic I had to get bring it back to the dealership in Debary. The mechanic from their shop confirmed the head gasket for the transmission blew. Meaning the transmission blew. They called the owners and they didn't want to do anything. I've gone to get my money back or even a trade up and pay the difference and the owner Vladimir said it wasn't his problem. I do have a paper the sells agent and the mechanic gave me when I left he car there. Theo papers at the office they alter them to be below $5,000 then they make you send them a****** to supposedly save on taxes. I have my picture of the****** transfer of $7,300. When I looked at the papers they were altered to 4,900. All I want is my money back. The miles on the car are the same as I took it out with the exception of the 28-35 miles I put on them taking the car home and back.Business Response

The vehicle was sold below it's market value because it had mechanical issues. Issues the customer was made aware of. In fact our mechanic explained those issues before purchase. The head gasket was not blown at the time of purchase. For clarification the head gasket has nothing to do with the transmission, it's a part of the engine which goes out when a vehicle is ran too long while overheating. The transmission is operational on the vehicle. We sold the vehicle AS IS with no warranty, and we are attaching documentation. We did reach out to the customer in hopes of resolving the situation but were met with hostility. I have the letter directly from the mechanic at those shop when we took the car back. The ONLY thing we were made aware of was an AC condenser. Which I have the receipt that I bought and installed. The car is still sitting on their lot and I do not want to repair their defective car. I drove 123 miles and the car started to go crazy AFTER I had fixed the AC condenser that was the ONLY thing that was specified. ALL the codes came up as soon as I drove the 100 miles. The head gasket cost way more than even the value of the car doesn't even make sense of me doing do. If I don't get my refund for the car I will escalate cause it was 4 DAYS of being in possession of the vehicle. There is no way that in 1 hour of driving a car head gasket would go out. As the customer stated they had the vehicle repaired for an AC issue. There is no way to know what exactly was done during that repair. For a car to start overheating any number of things can happen. Something as simple as a radiator hose clamp coming loose can cause then engine to reach temperatures high enough to blow a head gasket. We can not be responsible for what happens to a vehicle after it leaves our possession. It's pure speculation as to what happened and who's fault it is. Blame can not fall solely on the business, and contractually none of it can. However, as I stated in my initial response we offered work with the customer on a solution. Head gasket repair is not more expensive than the vehicle. It should be under $2000. We can assist in getting that number even lower. The business can not offer to pay for any repair because that would violate the AS IS agreement and open us up for further liability. If the customer contacts us directly we can attemp to find a fair resolution. There is no way a head gasket goes out without. But no problem I was doing as my lawyer stated before hand. Unless I get my refund for the car that has been in your lot since 8/5/2022 AFTER only 4 days and 123 miles back and forth I will just start the process that will cost the business much more more which is court appearance. We have documents and proof of their fraud with the department of review for avoiding sales taxes and also keeping their numbers on paper belies 5k to avoid a civil lawsuit for their frauds. But my lawyer and I will go beyond all means at this point because as business owners ourselves we do not like bad business people who take advantage of the consumers. I have picture of the sale prices on the car, and being that I process so many sales tax returns the FLORIDA DRS will soon be knocking ok your door doing a sales tax audit on all your sales. I tried to get his over with quickly and friendly. All I want if my money back cause I should not be going through this at all. I've lost business income for not having the car running right away when it needed which I will be suing to get my expenses and loss of income reimbursement in my civil lawsuit. I tried to get everything done with the owners when I was there the same day I brought it back and they ignored me and didn't want to settle or work with me at all. They have been avoiding their faults. I have researched and they have MANY other complaints at this locations for the same problems.
