We signed a contract with Gallery Homes in Sept. 2020. I owned the property but they would not put the pad on for the house but Brett K from Gallery signed on contract that he would help with process and if I used his excavating company that would be best. I agreed and he told me they were about 5 weeks out. They finally showed up to property on March 10th 2021. First day of work was March 24th and their last day was August 18th as they had only worked 10 days till this time and I fired them and brought in another excavation company. They started on Sept 26th and had all 3 pads completed by the first part of Dec. 2021. The new excavation company had to take out all excavation that was done by first excavation company because they did not take out organics from pads. Brett terminated contract on April 26,2022 even though his contract said he does not close on property until the pads were ready but he closed the loans in May of 2021. He said we defaulted on contract because pads were not ready even though we had passing compaction reports on all properties before April 26,2022. Their is a huge disagreement about these testings and how his engineering company tested the property. We have moved on from this but we have recently found out that Gallery Homes put a notice of commencement on the property on Nov.24,2021 and will not release the notice of commencement. They have kept a lot of money and have never given it back and now will not release this notice. I will not sign a mutual agreement notice just so they can blackball me into telling people about this terrible company and how they have treated my wife and I.
