      On January 15, 2024 I arranged to purchase a GV70 for business purposes. I completed my due diligence and selected the specific SUV, received approval for the car loan at an amount 10K above the purchase price, and scheduled an appointment to have the particulars (of the vehicle demonstrated) and sign the documents to have the dealership paid for said SUV. Upon arrival, it was explained that the salesman scheduled to meet me was not scheduled for work for at least 4 more hours. The supervisor explaining the error, shook my hand and asked if Delray could offer me a better interest rate than the aforementioned approved rate. I explained that it was a business vehicle and I would not be interested in purchasIng the car under my name for personal use. The salesman gave me paperwork to sign explaining they had to verify my identity for the purchase. The planned two hour transaction took six hours and when I returned home, Genesis of Delray used the verification information to solicit additional lenders for the car. Three hard inquiries were made: Genesis of Delray, *************** and ***************** *****. I have a fraud alert on file with the credit bureaus because I was a past victim of fraud abuse. A call has to be made to my land line to authorize any application for credit - it is the reason I negotiated the loan prior to going to the dealership. The experience was less than pleasant, but the added duplicity (trying to ****** more business when I specifically explained it was a business loan) is gross - at best.I now have three hard inquiries on my credit report because of Genesis of Delray. No one assumes responsibility, no one returns calls to address the infractions, and no one has any idea how to repeal the inquiries. I was basically told the inquiries couldnt be made without me providing information. I continue to explain that it was information given to verify my identity, I already secured my financing. I do not understand how this is allowable.

      To respond to the complaint filed from ************************* to Delray Genesis.

      The issue in question were the two credit inquires made, **** and *****************. ******* was presented and signed a release form allowing Delray Genesis to pull their credit, with the attempts in getting a better rate. The signed form is attached.  

      We welcome the opportunity to call or come in and speak our finance manager or GSM to go over the item in question.

      I am rejecting this response because:
      As stated, the information was solicited under the guise of verifying my identity, I refused additional financing because I already had financing for the vehicle. The information to run additional credit was solicited and acquired under false pretenses. Rather, than own this, the business is presenting a form I was assured was necessary to verify my identity. I was intentionally misled and misinformed, the glib manner in which Delray presents proof that I provided information to allow additional financial institutes to compete for the business would be funny if it were not detrimental. At best their practices are deceptive. 

      I reiterate that it makes no sense to walk into a dealership with an approved business loan and to turn around and seek additional funding. I did not request additional financing; when asked if I was interested in a possible lower interest rate I explained that the vehicle was a business car and kindly refused. Delray lied, ran my credit while I sat waiting for my vehicle, and now presents the document (I was told was required for verification of my identity) as evidence for their bad practices. I am not satisfied with their response, there is no remorse, or care that their actions impact how I attain financing for the next two years. This businesss disregard is all that is apparent. I ask once more that they do the right thing - remove the inquiries that were not authorized.

      While we understand your request, Delray Genesis did nothing wrong. On your actual *************** documentation you provided, under Important next steps, if you look and point #2, it states, 

      "The dealership will request your Social Security number and may request permission to run a credit bureau report
      through their system, if required for regulatory purposes."   

      In addition, prior to running your credit, it was discussed with you and you signed a credit intention, clearly stating we would be doing this.  Both of these items are attached.

      Delray Genesis followed all rules and regulations set forth by BOA and what was clearly provided to you. We are not able to remove any credit inquiries on your account.

      I am rejecting this response because:

      Genesis of Delray agrees that the information was provided to verify my identity it fails to address or acknowledge the rationale or requests for additional financing that was initiated by ************** and ***************** *****. I did not ask for a lower interest rates or additional financing options. Genesis of Delray tried to make some extra money, while I do not begrudge the hustle, I do begrudge the duplicity and negative impact additional hard inquiries have made to my credit report. It is a significant wrong, to state that they did nothing wrong is veering towards delusional.

      In August 2023 we purchased Genesis GV70 from this dealership, we paid title fee, so dealership would take care of the title and provide permanent plates. Car was shipped to **.Car arrived with temporary ******* plates in August. Now it is end of December 2023 we still don't have the title, no permanent plates. Every month we are forced to call this dealership multiple times to obtain new set of temp ******* plates and inquire about our title and permanent plates. Every month it takes multiple call, with multiple voice mails. No one in title department can give us straight answer when are our title and plates will arrive. Head of the dealership, "******" is unreachable, despite multiple voicemails and multiple messages sent via their official web page. At this point our temp ******* plates are expired again. We already got pulled over once before because Delray Genesis was late sending us another set of temp plates, we can't apply for parking permit in our town, we can't sell the car.It is very stressful and it is starting to impact our health and mental wellbeing. At this point we are considering to file in court for services not delivered and to compensate mental distress and emotional damage.

      ******************* purchased a new Genesis GV70 from Delray Genesis in Delray Beach. As a resident of **********, they requested the vehicle to be registered in that state. It was explained to them that it can be done and went through the timeframe and procedure.

      Delray Genesis sent the paperwork and confirmed that the title agency, OPUS, and the ** DMV have all the paperwork needed for registration. Any delays are between the title clerk agency and the **** Delray Genesis is not responsible for this. We have been in full contact with *******************. She has spoken to our internal title person, been provided a tracking number and has the contact information to OPUS the title agency.

      We have done everything as instructed and have communicated all this to ********************

      On August 6, 2021 I signed a 36 month lease for a Genesis G80 for $999.63 with "3 Yr / 36K ********************* Valet".I was informed that: "Your new Genesis comes with a complimentary three-year subscription to Service Valet. That means never dropping off, picking up or wasting time. With Service Valet, you can schedule service online or via the mobile app and have your vehicle picked up wherever and whenever you choose. Youll also receive a loaner vehicle and select when and where your Genesis will be returned, all at your convenience."When the first scheduled maintenance came due, I was told that ************* was not available. I protested, citing the above. After being put on hold for an inordinate length of time, I was informed that valet service had suddenly become available.Some time later I called the ****************** for a flat tire. After being kept on hold for a long while, I was told that assistance was not available for a flat tire because tires are not under warranty!When the second scheduled maintenance became due, I asked again for Service Valet. My request was denied even after repeated complaints. I had to bring the car in for service and wait at the dealership.Lastly, this past November 15th, the cars infotainment system started to behave erratically. I called for service, asked again for a loaner and again I was told that one was not available. After my insistence and after consulting with a manager the operator informed me that a loaner would be available but only on December 8, 23 days later!I find the dealerships behavior unprofessional, reprehensible and disregarding the contractual commitment taken at the time of sale and the explicit Genesis policy. Obviously the cost of the Service Valet subscription is factored into the price I am paying, so, why am I not receiving the service I am paying for?I am attaching copy of the first invoice as well as copy of my November 19, 2022 letter, to Genesis to which I received no reply.

      This is pertaining to ****************** comments.

      The vehicle was purchased in 2021, when the dealership was under different ownership. All Genesis models do come with complimentary Valet and service loaners. This is based on availability and inventory. Unfortunately, at the time of the initial compliant, Genesis vehicles were on back order, do to supply chain issues. This was out of the dealerships control. As for the current issue of the infotainment system, the vehicle is at the dealership for service and ************** has been given a Genesis loaner while it is being repaired. Both the Service Manager and Customer Relations ******** ****** are monitoring the repair daily and have been in communication with *************** 

      Again, ************** has a Genesis loaner, while his car is being serviced.
