I vacationed in Destin, Florida from Feb 1, 2023 to Feb 28, 2023, and during that time period I made an agreement with the F45 in Destin to attend their training facility for a month and agreed to pay them $200.00, which was more than the typical $140.00 per month that I paid on my St. Louis membership. They told me it would be more because it was one- month membership. I agreed to pay and handed them my credit card in person at the facility. I used it for a month and was happy and went home on March 1, 2023. On my most recent credit card statement, In noticed they had been charging me the $200 every month since I left. I immediately called the owner to request a refund of $1,400 for all the months that I did not attend. He refused and said it was not his problem. It was my problem to cancel the membership. I did cancel the membership the day I worked out last and the manager at their location acknowledged it. He tried to tell me that I should have emailed them. He acknowledged that I have not been back since Feb 28, but refused to refund me. So he admitted that he charged me $1400 and never rendered any services. I told him that this was a very dishonest business practice and that an honest businessman would acknowledge this was wrong and refund the money. I told him I own a business and would never extort money out of a client like he was trying to do. He is clearly not an honest businessman. I told him I planned to dispute the charge with Capital One and he told me good luck and he would fight it. This type of dishonest business practices are what give honest businesspeople a bad name.

      To whom it may concern,

I have attached the signed contract as well as invoices that were sent to Jeff on a monthly basis. Not only did he fail to follow very simple instructions from the signed agreement he waited 7 months to bring the problem to my attention. I offered to split to cost with him but he refuses to take any responsibility his self when he has signed an agreement, been provided emails on a monthly basis, and failed to review his credit card statements on a monthly basis. If I don't turn my my TV on for a month I still have a bill associated with it and I don't go back to the cable company demanding money saying I didn't use it.

Our contract is very simple, send an email terminating your contract to ********************** and Jeff has refused to do this. This dispute has been turned into the credit card companies and I have submitted all the documentation for them for review.

Jeff cannot produce an email terminating the agreement, if he can I will gladly issue a refund.

      Thank you,

      Eric *******
