Our Landlord (Checkers Enterprise LLC) has decided to use a portion of our deposit to update her property. After speaking with former HOA president, we discovered that this is a trend she uses against her tenants to upgrade her rental homes even when property is left in excellent condition. According to over 40 minutes of before and after walk-through videos, we are confident that our deposit should be returned. We were not given advanced notice of the purported damages, but rather only after the fact, even though we requested her via text (which has been our normal method of communication for 3 years) to notify us so we could make the necessary corrections just in case we overlooked something. We wanted to make sure we received our full refund. Instead, we had no response from her until she sent us receipts of her bills and deducted her upgrades / maintenance from our deposit. We have over 45 minutes of video walk through when we signed the least in 2019 and when we left on Oct 7th, 2022. She is charging us to replace the carpet on the steps. Carpet is approx 17y/o and so worn that the cleaning company that I was contractedly obligated to use, refused to waste his time cleaning it due to the age of the carpet. He took pictures and reached out to her, but we did not hear anything further until I received her estimate showing that she used another company(who also noted excessive fiber breakdown) and replaced the worst portions that the prior company would not clean and charged me for the replacement. She is also charging us for the garage to be painted, video clearly shows we left it in the same condition we received it. There is also a cleaning fee, however, we have videos of how exceptionally clean we left the house. We also made sure that we had a neighbor walk through with us as a witness. After numerous negotiating via texts with her realtor as the middleman, she is willing to refund only $869.31. We are still owed $1,422.42 of the $2291.73 that she withheld.Business response

Consumer Response /* (2000, 9, 2022/12/13) */ After receiving the email from the BBB and my lawyer reaching out the owner, she finally settled the matter and paid me the remainder of the security deposit. Thank you BBB for your assistance in this matter. This has been resolved.
