      Business response

      03/22/2024

*************************** was a prior coworker that decided to invest in vehicles to purchase and sell with us. He invested oin a 2020 Lexus from the auction that had major mechanical issues with the intention of selling it back. He paid for the vehicle, we paid for shipping and thousands in repairs thus far, and it still not functional. He also contributed to a tow truck that we purchased. We flew to ******* to purchase the tow truck and drove it back to *******. While driving the tow truck back to *******, the engine overheated and caught on fire within 12 hours of the sale. Immediately, we tried getting a refund from the seller, but they refused and said we signed a bill of sale purchasing the tow truck as-is, even though it checked out mechanically. We spent several thousand trying to fix the vehicles we both invested in, and the entire situation is very unfortunate. We have been working to repair the vehicles and pay ****** back the money invested. We also gave him a personal vehicle in which he had no payments on to drive when he left his job that gave him access to a personal vehicle. Unfortunately, there is risk when it comes to investments, and these did not work out the way we all hoped it would. We do not intend for ****** to lose on his investment, and we will continue to try to fix things for both parties.

      Customer response

      03/23/2024

      Complaint: 21420726

I am rejecting this response because the answer is vague, superficial, unprofessional and totally unacceptable. I clearly provided evidence of all the payments, the dates and the purposes. Pablo and ***'s Auto confirmed everything but, as usual, they didn't set any deadline to return me the money.

I was totally unaware of the problems with the Lexus and I want to remind them that I paid the Lexus at the end of 2022. Basically, they're saying that they have been trying to fix a 2020 Lexus for more than a year! It's clearly a pathetic excuse and it doesn't make any sense.
I have been hearing these excuses for months and months. As I said before I decided to help them with the Lexus because I considered them friends. Before starting I clearly asked what the timing would be, and they confirmed a couple of months maximum. I gave them a lot of time and opportunities to return me what they owe but in response I only got excuses and now I consider their behavior a fraud attempt.

For the truck I was aware that apparently there was a problem with the engine when they were arriving in ******* but they didn't mention that it happened in January 2023.
I don't want to write here the list of excuses that I had to listen to, without considering that it happened during a difficult time in my life as I was divorcing. In June 2023 the truck was fixed and in August, I clearly told them that I wanted my money back. They confirmed that they were selling the truck and repaying everything. I was patient for the entire ********************************************************************************************************************************* December they made two small payments to keep me quiet for a while but after that they stopped with the repayments, and they didn't answer phone calls and messages.
Despite everything with this complaint I'm giving them another chance to end everything in a friendly manner because they are probably not aware of the legal implications of their behavior.

I request Pablo and Son's Auto Body LLC and ********* Management LLC to set a clear and reasonable deadline (considering that 1 year has passed) within which to send me the money that they owe.

I reserve the possibility of reporting them to other Authorities and requesting an additional reimbursement for the psychological and emotional injuries that this stressful situation has caused.
      Sincerely,

      ***************************
