      A full summary of my complaint is provided in the attached PDF as it was too long to fit here. 12/19/22 - entered into an agreement for a ****************** program offered by Tara Mullarkey called High Ticket Empress (HTE). As part of my contract I received a 100% money back guarantee if I did not recoup my investment of $11,800 during the 90 day program. While the details of the guarantee were shared with me during the sales call, I had concerns about the requirement of attending all live calls (due to work). When I brought my concerns about the language of the guarantee to the sales rep he stated that it was not strictly enforced and unfortunately I chose to trust that he was telling me the truth, so I signed the agreement. After completing the 90 days, I wasn't able to make my investment back and I messaged HTE to ask for a refund based on the guarantee in my contract. They responded by saying that I initially qualified, but because I didn't satisfy the requirements for the guarantee I was no longer eligible for a refund. They then listed additional requirements that were not in the agreement or shared with me verbally or otherwise (apparently, attendance at all live calls not only meant being there live, but also submitting questions & being coached on all calls - not stated in my contract). This was a complete ********************************************************************* to sign the agreement. Not to mention the requirements are so rigorous that they are impossible to meet as it included 3 weekly coaching calls plus another coaching call that met biweekly. There are 6 elements of fraudulent misrepresentation which I have attached in a PDF and this business has met all of them. Due to the company's fraudulent misrepresentation of their guarantee I am left with a huge financial investment lost. That is why I'm asking for a full refund.

      I purchased the *** program on 7/17/2022 and deliverables werent provided. I attended or watched coaching calls for 6 consecutive weeks. At this point, approximately halfway through the program, on a coaching call when I asked for support, I was refused coaching and told I was uncoachable. After this happened, I did not receive any further support to achieve the outcomes explained in the initial sales call on 7/17/2022 . As a brand new coach, I should not have been invited into the program if *** was not going to be able to successfully coach me. This is in violation of *** guidelines because *** failed to fully deliver the product sold to me. Section 12 of the *** Act, 15 U.S.C. 52, prohibits the dissemination of any false advertisement that is likely to induce the purchase of food, drugs, devices, services, or cosmetics. Section 5(a) of the ************************ Act (*** Act) (15 USC 45) prohibits unfair or deceptive acts or practices in or affecting commerce. In addition, *** offered incentives for reviews during my time in the program, which is in direct violation of *** guidelines and TrustPilot guidelines. *** guidelines states If you offer an incentive for a review, dont condition it, explicitly or implicitly, on the review being positive. Even without that condition, the review should disclose the incentive, because its offer may introduce bias or change the weight and credibility that readers give the review. TrustPilot guidelines states You shouldnt provide incentives like discounts, monetary rewards, loyalty points, gifts, coupons, referral bonuses and the like when asking for reviews. I requested a refund from *** on 3/1/2023. I was gaslighted and bullied during my enrollment, and denied my refund on 3/7/2023. I responded to the denial request on 3/20/2023 citing the *** violations and further explained the reason I deserved a refund. I gave *** until 3/24/2023 to respond however they did not respond. I am hereby asking for a refund.

      Tell us why here..As you know, we cant guarantee a clients results, because we dont know the skills, mindset, and capacity they come into the program with.
      We have hundreds of students whove gotten to 6 and 7 figure run rates in High Ticket Empress so we know the curriculum and program works.
      To reply to your points specifically:
      As you can review from the screenshots below, our team delivered every aspect of the program that was promised. Your accusation that we have violated *** regulations is completely false. 

      Not only did we deliver, but you took advantage of every deliverable: downloading HTE proprietary funnel, accessing Kajabi material over 20 times, attending dozens of live coaching calls, and using your very own private Slack channel with instant coaching access! (see below)

      We cant promise that you will like the coaches feedback, but we did deliver every aspect that was promised.

      We are not able to guarantee or promise any students specific results (unless they qualify for this type of guarantee based on the level of their business), but when they are so new to online marketing like yourself, we cannot know how well a client will implement.

      While $5k sales are totally possible and they happen every week inside the program (in fact someone who enrolled around your time just hit their first $40k month!), its clear that you struggled to implement the material. We never promised you would make those sales by a certain time in the program - we would never be able to do that, as that would be unethical. Weve reviewed your call with Rad and that was never promised.

      Running an online business (or any business for that matter) does require nominal extra fees for software. For example, any business owner knows they must pay extra for operations, CRMs, web pages, calendar software, and the like.


      We are sorry that your form didnt reach coach ******, but if we didnt have your form, we cant proceed with coaching you on the live call. This is the same guideline for everyone and in no way were you singled out. All students must follow our process and guidelines, as outlined in the contract you signed (also attached). We would never deny coaching unless the request is outside the rules and guidelines of the program.


      Offering an incentive for a review is not outside the *** guidelines, in fact. It is only illegal if you bribe a client for a positive review. Therefore, our offer to supply additional training to those clients who took time to submit a review is well within the *** regulations.


      Your enrollment in the program was over ********************************************************************** full is illegal, unethical and immoral.


      So whatever you wish that others would do to you, do also to them, for this is the Law and the Prophets. - ******* 7:12


      Again, we as a team are very sorry that you dont feel happy with the results you got in the program, but we stand by that you received all proprietary training and live coaching in return for the fee you paid.

      Dates: 5/16/22 and 6/16/22 Cost: $9,800 total split over two payments (they tried to charge $10,800, but my credit card company recognized the fraud & granted me a refund of $1,000)Business Commitments: Below are the Program Deliverables that are listed in the contract. Past Coaching Calls Nature of dispute: I've uploaded the document, "High Ticket Empress - Refund Request, Details of Fraud," describing the details of why I am requesting a full refund. In sum, HTE didn't offer the contractual Program Deliverables after 1 month into the 3-month long program (the incident that provoked me being iced out of the program was after I won a credit card dispute for their fraudulent $1,000 charge. I've uploaded the details of this dispute as well). Not only did it not deliver on the contractual Program Deliverables, but also, according to the ************************ (***), their sales tactics to get me to buy the program was fraudulent misrepresentation (the details of which I go into in my uploaded document). The *** shows that there are 6 bars to clear to be considered fraudulent misrepresentation:1 A representation was made 2 The representation was false 3 The defendant knew at the time that the representation was false, or recklessly made the statement without knowledge of its truth 4 The representation was made with the intention that the plaintiff would rely on it 5 The plaintiff did rely on the false representation 6 The plaintiff suffered harm by relying on the false representation HTE engaged in all the fraudulent misrepresentations above.       A full summary is provided in the attached PDF (as its WAY longer than **** characters).Fundamentally, what happened was that I entered into an agreement concerning a marketing course this company offers called High Ticket Empress (here on referred to as HTE). This agreement included a 100% money back guarantee if I did not recoup my $12,500 investment during the 90 day program. The details of this guarantee were not shared with me prior to collecting my first payment, and the sales rep completely misrepresented the requirements when I asked him about the verbiage of the guarantee when I was finally able to see it (after submitting my 1st payment). The sales rep made assurances to me that the requirements for redeeming the guarantee weren't strictly enforced, and I chose to trust him and sign the agreement. 90 days later, I wasn't able to make my investment back, so I approached HTE about redeeming the guarantee. Their response was that I didn't satisfy the requirements for the guarantee, but listed requirements that were neither stated in the agreement or shared with me verbally or otherwise. And went completely against what the sales rep told me to get me comfortable signing the agreement. On top of that, the requirements they wanted me to meet were literally impossible. The marketing course included 3 coaching calls a week for 12 weeks, including about 6-ish floating coaching calls. Not only was I supposed to attend 100% of the calls, but according to HTE "attended" was supposed to mean "submitted questions to and got coached on every single call". Which based on the way the program is set up, the number of students in the program, and how many students could possible GET coaching during 1 particular coaching call type - based on all that, the requirements are literally impossible.I'm requesting a full refund of the $12,500 that I paid for this program, as per the guarantee I agreed to as it was presented to me by their sales representative.

      I made a purchase on 12/22/22, payment was made at 9:27 am $5800 and 9:34 am $5000, for a total of $10,800 and contract was received at 9:38 am. Their sponsored ads on Facebook state " We GUARANTEE you will make $20,000 in just 30 days after working with us or you'll get your money back". On 1/26/23 I sent an email requesting a refund based on the guarantee as I followed their guidance however I did not make any money. I was denied. They are in violation of the FTC laws, state laws, the Uniform Commercial Code and the Magnuson-Moss Warranty Act in regards to their "guarantee".

      Shara Gabaldon signed up for the High Ticket Empress program on 12/22/22. 

      This is a 90-day program and under the terms of her contract, she is able to receive a money back guarantee based on criteria set forth in the contract. 

      She reached out on 1/26/23 requesting a refund for the payment and program siting that she was due the refund based on the money back guarantee. However, she in fact did not meet the criteria due to the fact that she did not attend all coaching calls, did not submit the form for coaching on all provided coaching calls, provide proof of all organic marketing materials nor provide financial statements proving that she did not meet the income levels for the guarantee to be valid. 

      Furthermore, after some conversation back and forth, we issued her a refund to settle this request. The screenshot of the refund is attached as well as a copy of her contract.

      Their sponsored ads on Facebook state " We GUARANTEE you will make $20,000 in just 30 days after working with us or you'll get your money back". LIES! They do not provide a copy of their contract until AFTER your payment is collected.

      After 30 days, multiple submissions, countless coaching call attendances, over 300 members in my group, 3 webinars, 16+ strategy sessions, and ZERO dollars made, I requested a refund based on their guarantee. Unbeknownst to me, it came with stipulations not communicated prior to my request.

      While they originally denied my request for a refund, I was able to respond and not only provide proof of every effort made, but clearly articulate the requirements they should follow when making such guarantees. One must follow the FTC laws, state laws, the Uniform Commercial Code and the Magnuson-Moss Warranty Act.

      Here's a detailed list of items their business has failed to do in regards to their "guarantee":

      1. In the U.S., there is no law that requires businesses to offer money-back guarantees, but if companies advertise one, they must fully refund the purchase and make all requirements and limitations clear.  If you do make any guarantees, the basic tenets of FTC and state advertising law need to be followed
      2. Making guarantees are just like any other advertisement or claim. You can’t refuse to honor or follow through with any guarantee or misrepresent the nature of any guarantee, as stated on your website, terms of sale or elsewhere. Do what you say you will without limitations.
      3. If you use the terms “money back guarantee” on your website or advertising, your business must provide any customers with a refund of the full purchase price upon request. You can provide some mechanism for processing refunds and make your customers go through that process. But, it can’t be burdensome or unreasonable and you should always refund the purchase price immediately after the customer has requested the refund
      4. Like any other disclosure, any guarantee must be clear, conspicuous and easy to understand. Do not try to conceal or mislead the nature of any limitation on any warranties your business may provide
      5. Inform your customers how to get a copy of any warranty your business provides before they purchase any products
      6. Always Honor Your Warranties! Under state laws, it can be an unfair or deceptive act or practice to fail to honor a warranty 

      I gave them until Monday January 30th at 5pm PST to provide a resolution to my problem before seeking help from a consumer protection agency or other assistance. Unfortunately, they did not respond even though they revoked access to the training portal along with the private Facebook group and Slack channels. Potential Buyers, you've been warned!

      Refund was provided only AFTER I left a review on their website and made a formal complaint with BBB.
