I am currently getting a background check done through CSS, that was started on Nov 4, 2021. My original job start date was supposed to be on Nov 22. When Nov 17th came and my background check hasn't cleared, I reached out to CSS via phone and email and was told that the background check's eta is on the 22nd and that we were just waiting on Lubbock county because their county records are not electronic. I was fine with that. The check was not completed on the 22nd, so i emailed them back on the 22nd and they told me that the ETA has been changed again to the 29th and that they are waiting on the courts. So I called Lubbock county district court and the archives person told me that they could look into the delay if CSS could give me the name of the contact person they are using at the court. When I reached back out to CSS, they told me they don't go directly to the courts so the archives person at the court wouldn't know that a check is being ran. Since then, they have delayed the ETA twice more and can't give me an ETA now because they say the public access terminal is down since Dec 3rd and that the background has to be clerk assisted. When I called Lubbock court, they confirmed that the terminal is down, but stated that they have referred background check companies to go through the Texas DPS criminal history search website, which CSS has not done. The court has also stated that they don't do any clerk assisted searches. This has taken over a month and i've never had background checks take this long before. My start date at my new job has been pushed back numerous times and i have quit my old job because i figured the bg check should be completed by now. It's holiday time and they have no sense of urgency. Also if they knew they had to use the public access terminal from the get go, why did they wait until last week instead of doing this 3 weeks ago. Also, i've had other bg companies run my Lubbock county bg electronically with no issues like checkr and precheckBusiness response

Business Response /* (1000, 10, 2022/04/06) */ Global HR Research, LLC ("GHRR") is a consumer reporting agency governed by the federal Fair Credit Reporting Act ("FCRA") and furnishes consumer reports for employment purposes to its customers. GHRR's customers are current or prospective employers who order consumer reports on their current or prospective employees. Consumer reports (also known as 'background checks' or 'background reports') are ordered by employers, not consumers. Therefore, GHRR's business relationship is with the employer that ordered the consumer report, not with the consumer who has made the complaint with the BBB. Because federal and state consumer reporting laws already govern the rights and remedies of consumers under the FCRA, we respectfully submit that the BBB is not an appropriate forum for resolving any complaint a consumer may have with a consumer reporting agency. Regarding the time it takes to complete a background check, GHRR does not make any representations or promises to consumers regarding how long it will take to complete a consumer report. Further, GHRR does not control the hiring process, or the hiring decision made by its customer; it is the employer who decides when and how to proceed with an employment applicant. Finally, in this specific instance, the employer who ordered a consumer report has cancelled its order for a consumer report. GHRR recommends that the consumer contact the employer/prospective employer for more information about the status of the employment application, if necessary.
