      *************** advertises on ******** to provide online coaching with a personalized daily meal and fitness plan. He charged me $75 dollars for the plan. It was nothing more than a Generic plan in template form with your name posted on each page. Nothing looked personal about; similar info is readily available online for free but *** charged me $75 for it. *** also stated that he would need an additional $215 to begin coaching. I asked him to move the start date since I had an unexpected relocation, and the move resulted in an injury, therefore after going to the ** twice and being sent to a specialist, I was not medically cleared to join a fitness program. I have handed over all paperwork to ***. I've asked him to return my $215. I also informed him that I was unhappy because I didn't notice anything personal in the exercise and nutrition plan. *** did all in his ability not to return the money, and I also offered to let him keep his $75 if he felt he deserved it. He ignored me, always made an excuse to keep my money, and he also had the audacity to offer other programs. I have to repeat that I am not medically cleared. He then blocked and erased me from his app, keeping my $215 without delivering any service to me! He is only ******************************************* the interim, I performed a ****** search: *** Wachs scam; to my surprise, *** Wachs targeted the **** community; I took screen photos for documentation and sent him a copy as well. He worked as a model in the adult industry, "ONLY FANS" he apparently scammed that community by claiming to provide videos to his fans of adult content. These people were too scared to report him. When I confronted *** about this scam and how he had no reviews on ********. The next day, approximately 20 reviews were placed on his ******** account, which were all of the similar content, with a handful the following day and month that I feel were fraudulent. Reports will continue until justice is served, and to raise awareness.

      To whom it may concern

      I am reaching out regarding a complaint reported by ***********************************.

      I have reached out to ******* in attempt to make a resolution to no prevail. ******* has denied my resolution. With this, I wanted to send a detailed description and documentation proof of false accusations made by ***********************************.

      I wanted to first thank you for your time on investigating this matter thoroughly.

      ******* had applied to my coaching Via Application June of 2023. Shortly after she applied we planned a time to chat about her goals. The initial coaching consultation happened via phone call.

      ******* was not initially ready to start right away and I told her if this is something she wanted to start in the near future, I could take a deposit to hold her spot on my roster. This deposit would go towards her total first months payment. The total cost of first month payment would be $100 set up fee(this is for making the program) + the monthly cost of coaching at  $190 totaling $290 FIRST MONTH. Every month after that her monthly payment would be $190. The deposit she paid was $75 which agreed and paid that deposit on June 13th 2023. Please see below for deposit paid on June, 13 2023. 

      ******* initially wanted to begin June 25th ******************************* prior to that date asking to push out her remaining payment of $215 to August and I agreed! Fast forward to August, ******* was ready to begin her weight loss journey with me. Because she had already paid $75 to hold her spot on my roster I subtracted that from her total first month of $290 she then owed $215 to begin. This was paid of August 10th 2023. Please see below payment.

      From the deposit date of June 13th 2023 to July 8th 2023 I had sent 17 detailed videos on the program, what to expect, how to succeed in this ect. I had also checked in multiple times with no response. On July 8th she had requested to push out her start date. See below!

      A few weeks later she requested another push out date of August  11th.

      I then got confirmation to start on August 10th and for payment in the remaining $215 for the first month of payment.

      In the above payment screenshot it shows the remaining balance was paid on her end On August 10th 2023 in the amount of $215!

      She then states she will start August 21st 2023. See below.

      On August 21st 2023 you will see she received numerous documentations for her coaching where services were provided. I also attached each document that was sent to her!
       
      On August 22nd 2023 ******* notified me she hurt her back during her move. I told her she could prioritize walking and nutrition until she is good to go to the gym!

      After this conversation ******* tried to postpone her start date again. I had already sent her the program I created, therefor she received what she paid for whether she chose to start or not!

      Since ******* had her first remaining payment on August 10th, that runs every 30 days for the term of her coaching(6 month agreement). On September 11th, she was charged her monthly coaching rate of $190.

      This should have been her payment regardless if she chose to do the work on her end or not after plans were posted.

      You will see below that I had charged her on September 10th 2023 for her monthly subscription of coaching. She requested a refund  because she didnt start the program until September 5th. Per our agreement, she was not entitled to a refund for failure to start on her end. She had the plans she needed to start her fitness Journey. Out of kindness and understanding I refunded her September monthly cost. That refunded was in the amount of $190 went back to her on September 15th 2023.

      On September 13th 2023 ******* requested to chat on the phone because she was still confused as to what she needed to do! We scheduled a call on September 15th.

      On September 15th 2023, she requested a new meal plan based on foods she liked better!

      That new meal plan was sent shortly after. See below:

      Confirmation on food and refund of $190 for September coaching payment.

      She responded and said she received the $190 but was also looking for a refund of $75 for the deposit. That $75 went towards her first month total cost of coaching. $100 set up fee + $190 coaching monthly cost!

      The voice message was stating how the payment was broken down and how the $75 will not be refunded. I had also explained more on her program and how she needs to execute in order to be successful.

      My response to this message.

      I went ahead and cancelled her membership and she no longer has access to my app(*****).

      To sum all of this communication up, here is the breakdown of pay and summary of events!

      ******** first month of payment would be in the amount of $290. Broken down as $100 set up fee(on month one only), $190/month coaching for a 6 month commitment.

      ******* paid $75 to hold her spot on my roster on June 13th 2023, that would be subtracted from the total owed for her first month of payment(when plans were sent) in the amount of $290.

      When putting her information into my app, she agreed to terms and conditions of my coaching program. That is the only way to proceed to receive access to my app. See attached agreement sent to her when submitting her information.

      On August 10th 2023 she said she was ready to start and her card was charged the remaining $215 owed for first month payment. She requested to push out her start numerous times.

      On August 21st  her fitness and nutrition plans were ready and sent to her. They were viewable on the app and sent to her email.

      Although she had her plans and they were accessible, she chose not to start executing any of them until September 5th 2023.  She confirms she started meal prepping.

      On September 11th 2023, ******* notifies me that I had charged her the monthly rate of $190. Which should have been her monthly billing date and amount since she paid on August 10th 2023. Coaching is due every 30 days.

      ******* requested a refund of September billing because she said she didnt start trying to execute until September 5th 2023. This does not fall on me. Her plans were ready and she had then in hand.

      On September 15th I gave her the requested refund of $190. This was not owed to her. I was doing my part on coaching, she chose not to execute her plans.

      Out of kindness and understanding I refunded her the September monthly bill. She confirmed on September 18th 2023 that she received the refund.

      She then requested $75 more back for her deposit. Again, that $75 she paid on June 13th ****************************************** the amount of $290 in including the set up fee.

      I declined her request for that and notified her that I would be ending her membership.

      She paid one month of coaching plus her set up fee and received one month of coaching. With the discontinuation of her subscription, she loses access to my app *****.

      ******* continued to harass me after ending her subscription requesting the money back. I did not respond to any more of her messages. There was nothing else that needed to be said about the situation. ******* now is coming after my character out of feeling instead of fact.

      ******* is claiming no services were provided and I gave her a generic nutrition and training outline. As you can see I did provide coaching services to her. As far as the nutrition and training, everything I did is individualized person to person based on body weight, goals, activity capability, ect.

      When I received the letter from The *********************** of *******, I reached out to ******* by email trying to make a resolution on our own.  That was unsuccessful. I have attached that email thread to this email as an attachment.

      Thank you for your time on this matter and please do not hesitate to reach out if you need any additional information from me! I am hopeful that with this extensive documentation and explanation of the matter this will be cleared up soon!

      I am rejecting this response because:

      First and foremost, I would like to express my gratitude to the Better Business Bureau (BBB) for reaching out to this business.  I am rejecting these resolution as I continue to feel intimidated and misled by this business after their response. This is why I filed a complaint to both the BBB and the ************************* in the first place. It is important to note that Mr. *** ********************** provided excerpts of our initial conversations, which happened on his personal gym app before he deleted me from it.  We also had additional conversations where I requested to change the start date due to unforeseen circumstances caused by a move and an injury (please see PDF).
      When I followed up with Mr. ********************** to explain my concerns about the injury and whether to put everything on hold, I also inquired about the meal plan. While I appreciated his efforts, I expressed concerns that the meal plan did not fit my dietary needs and it felt generic rather than personalized. Mr. *** ********************** responded with a few suggestions and said he would work on it and get back to me.However, when I went to check in, I discovered he had deleted me from his app without explanation, leaving me confused and concerned. I paid him $75 for the meal and workout plan and $215 for one-on-one coaching sessions, which he never provided after deleting me from the app.
      (Please note: I was also charged an additional $190, which he promptly returned after I contacted him. Mr. *** ********************** assured me this was an error in his system, as he forgot to adjust the start date of his program in the system; after the first payment of $215, the plan was that each additional month cost $190.)
       After Mr. *** ********************** deleted me from his app without providing the agreed-upon services, I tried reaching out to him via email, requesting a full refund of the $215 paid upfront, as services were not rendered (please see  PDF).  I informed him that he could keep the $75 for the meal and workout plans if he deemed it legitimate. However, he never responded.
      In his most recent response to my claim to the *************************, Mr. *** ********************** offered to refund only $100 of the $215, which I found concerning as no services were rendered. I understand that Mr. *** ********************** may have had his own reasons for his actions. However, he has wrongly accused me of trying to harm his reputation by formalizing my complaint. I want to clarify that this was not my intention to do so. My only goal was to seek a resolution to this unacceptable situation. I paid for certain services which were never provided to me, and hence I expect a full refund. I am disappointed with the lack of professionalism and customer service displayed by Mr. *** **********************. I hope this matter can be resolved promptly.

      Hello -

      As stated previously, the payment in the amount off $290 that you are requesting refund on was the payment of the first month of coaching, which coaching was provided. Due to coaching being provided, there will be no refund granted. The $190 payment in September of 2023 was for your second month of coaching. The second month of coaching in the amount of $190 was refunded. When you are no longer a paying customer, you do not have access to my gym app. I would again like to highlight that services were provided but there was a lack of utilization on the complaints side.

      I reject this offer, as I have already explained in a previous conversation. Mr. *** Wachs did not provide the coaching services he was hired for and continues to deny the facts, despite the evidence. I paid him $75 for a personalized workout and menu plan, but all I received was a generic plan. In addition, he charged me $215 for coaching services on August 11, 2023, which he did not provide. I moved on August 12 and had no access to a gym, as can be evidenced by the invoices provided by the movers. I will also provide my lease and board of health documents if needed to prove why I had to move. Moreover, I was injured after the move and had to go to the ** and was seen by my provider on several occasions throughout August into September. I also had to ask for an academic hold to complete my assignments due to the move and injury.

      On September 10, 2023, I noticed an unauthorized charge of $190 from *** Wachs, despite having already paid $215 for his coaching services.  I reached out to my bank and ***. *** was also away in late August/ September for his wedding. *** acknowledged the mistake, and my bank refunded the $190. During this time when I called him, I also took the opportunity to address the issue about the meal plan. I also inquired about the coaching services that I had already paid $215. *** promised to make changes to the meal plan, but unfortunately, after a day, he deleted me from the app and stopped responding to my messages. As a result, I was left without any coaching services, despite having paid $215 for them. I expressed my concerns to *** about his lack of response and informed him via email, that I would need to seek help from consumer services. However, even after doing so, I still received no response. ***, now claims, he provided services, during August and September, I don't understand how? I moved during this time and was injured, throughout August into September, as validated in my records. *** also was getting married during this time. Since September 10th, I have been trying to reach him. I believe that good communication and transparency are key to any successful business relationship. I had trusted *** to provide the coaching services he promised, and it has been disheartening to feel taken advantage of. I hope that by sharing my experience, others can be aware of potential issues and be treated with the fairness and respect that they deserve.
