Aviator College performed acts and omissions that constitute breach of contract, misrepresentation and fraud which caused financial harm. Upon my enrollment to Aviator College the course catalog states that when a student passed *** Part 141 course curriculum they would be eligible to apply for FAA licensure. After passing *** Ground Courses and preforming all flight curriculum to Federal Aviation Administration standards; ACS (Airman Certification Standards). This also included passing *** end of course oral and flight exam; a successful end of course certificate was received. The school refused to associate my application in the Integrated Airman Certification and Rating Application (IACRA) system. Ultimately refusing to endorse my application for licensure. In layman's terms this intentional action blocked me from applying to take perform my check ride (drivers test).Business response

Business Response /* (1000, 6, 2021/11/09) */ Contact Name and Title: Alex Lopez Chief Flight I Contact Phone: XXX-XXX-XXXX Contact Email: **********@aviator.edu As a well established 141 flight school and company it saddens us to see that we were not able to meet the personal demands of Mr *****. However, it is important to understand that Aviator College has to operate under the scope of the FAA and comply with 141 regulations, policies and best common practices in the aviation industry. From what our records show, Mr ***** was explained that Aviator College was willing to associate the IACRA form if Mr. ***** received an endorsement from a recommending Certified Flight Instructor that was considered to be a worker at Aviator College. Mr. Lloyed was attempting to perform the FAA practical test outside of school and receive an endorsement from a recommending Certified Flight Instructor that did not work at Aviator College. It was explained by our company's Chief Flight Instructor, at the time, that Mr. ***** has two options. First option was that Mr.***** took the FAA practical test with DPE on Aviator College's schedule and received the endorsement from a recommending Certified Flight Instructor that worked for Aviator College after having the IACRA form associated and being able to take the FAA practical test as 141. The second option given to Mr. ***** was that if he wishes to take the FAA practical test with a DPE outside of Aviator College's schedule, he was more than welcome, however, if Mr. ***** desired to receive the endorsement from a recommending Certified Flight Instructor outside of Avator College he would have to take the FAA practical test under part 61 rather than part 141. As a company we strive to successfully train professional pilots and we understand the ramifications of providing the best possible training, with the highest quality of flight instructing at a competitive price. If any actions taken by Aviator College seemed to be inappropriate for Mr. Lloyed we encourage him to meet with our school representatives so that we have have a cordial and fruitful conversation to address any issues and clear any misunderstanding. Mr. Lopez clearly admits to the Breach of Contract, Misrepresentation, & Fraud in his response. The attached document will clearly explain why Aviator College in the wrong. If the school has a policy that conflicts with the FAA it must be clearly disclosed in writing. I challenge the school to provide any documentation signed by me that clearly states that I forfeited my rights to choose a DPE.
