My car was towed on Sunday 11/26/23 in the morning, and when I called Elite Towing to retrieve my car they informed me that they were not open and that I would not be able to retrieve my car until the following day. They refused to give me my car for almost 12 hours, until after multiple phone calls with the police and lawyers they let me retrieve my car that Sunday night. I then informed them that per 2023 Florida Statue Chapter ******, they were in violation of the law in two places. First, "That site must be open for the purpose of redemption of vehicles on any day that the person or firm towing such vehicle or vessel is open for towing purposes" and second "When a vehicle or vessel has been towed or removed pursuant to this section, it must be released to its owner or person in control or custody within 1 hour after requested". They failed to keep their business open on a day they towed vehicles, and they failed to release my car back to me within one hour of requesting the car. They created undue distress and worry, which is why I want a refund back from Elite Towing in the amount I paid them. Elite Towing argued for early 12 hours about giving my car back, despite that they were legally in the wrong and this was pointed out to them many times. Additionally, they would only give me my car back if I paid in cash and they refused to give me a detailed receipt, so I am unsure whether I was scammed or charged a fair amount. This is in fact another violation of the 2023 Florida Statues Chapter ******, where it states "A detailed receipt showing the legal name of the company or person towing or removing the vehicle or vessel must be given to the person paying towing or storage charges at the time of payment, whether requested or not".
