      On July 27,2022 I entered a contract agreement with Mac construction and Development to have some work done on the property the contract is included in a PDF. As of this date September 13,2023 it has not been completed and all calls and messages are being ignored. All I am is requesting is for the work to be completed and if not refund and compensation for the hiring of another contractor to compensate for the balance of any future price increase due to time lapse. Malcom the company owner has ignored all my calls emails phone calls and text messages. Malcom has abandoned the job site and never completed the contract. Malcom was paid upfront $10k to begin the project and he never completed the shed 4x5 entrance slap. As for the patio I have minor leaks. the 14x16 slap and driveway was not completed to date. Malcom was given an additional $5k which cover $1000.00 for and extra window and extra work and materials for the patio per out verbal agreement. The balance of $4k was to be used as a down payment to continue the project and balance to be paid when all work is completed. As of today 9/15/23 the work has not been completed and Malcom does not return calls or text messages. There he has abandoned the project and has not for fill the contract. All I want is for him to comply by the contract and finish the project or refund my money plus what the difference will be to have another contractor finish the project.

      Mac Construction has 2 permits that were signed off by the building inspector that everything was built to code and passed final inspection. The project was 3 phases, shed, replace a patio roof and demo and repour a concrete driveway. The shed was the first of the projects we completed. Next, we extended the slab for the patio so we could extend the screen porch 10. The previous owner didnt pull a permit for the screen room, and it wasnt built to code. It was buillt with 2x2 uprights instead of 2x3. Instead of replacing the roof on a project that wasnt up to code, we suggested to replace the uprights with the proper 2x3 posts. We only charged material $900 (verbal) to rebuild the entire patio. We installed new kick-plate and re screened the whole patio. We were only contracted to do a 10x12 extension but while we were there we decided to bring the whole porch up to code and build it correctly.

      Once the shed and patio were completed, next up was to demo the driveway and re pour it. Along with a 10x16 slab for a grill area. My concrete sub sold his excavator and dump trailer. So I told the the homeowner I was going to have trouble demoing a driveway without a machine to do so. As we discussed verbally, the work that had been done so far was paid in full $15k. What was remaining was 10x12 grill area (120 sqft) and a 9x34 driveway (306 sqft) totaling 426 sqft. We charge $10/sqft to form and pour concrete. That would be $4,260. Im still owed over $6,000 per the contract. I completed the first 2 phases and discussed with the homeowner that I could no longer complete the third phase per our conversation. He was not charged for any of the concrete or driveway work. If anything I took less for the trouble.

      All I wanted was for him to continue the project and finish the project but he fail to do so and till day he has not called and in good faith finish the grill area add the door slab to the entrance of the shed fix the leaks on the patio. As for the driveway it up to him to tackle it if he wants to.  He broke the contract not finishing the project and not responding to voice calls or texts message. I reported him the BBB and the *************) ********** of ******** and Professional Regulation.
      Mac Construction abandon the jobsite and refuse to complete the contract and as for his response to BBB it is false statement have him show you all my ignore calls and text messages.

      As for me owing him money lets be realistic the project was never completed and he abandon the job. I gave $10k to begin the project the balance was to be paid when the project was completed and as for the $5k I gave that was in good faith to keep the project going and he never finished completely ignore all communication via text and calls and even message that stated I will file a complaint with the BBB and the ********** of ******** and Professional Regulation.  Which he has not responded to them most likely the only reason he decided to respond to the BBB was because he realized I moved on and file a complaint.
      If he wants to settle this he needs to send me a notarize letter stating he will terminate the contract and the $15k  will be full payment for the work that has been done and a letter of completion for the two notice of commencement for both permits.  

      I am done dealing with him and lost trust in this company if he does not agree then I will proceed taking legal actions since I done all I could in good faith and he is the one that abandon the job and is breaking the contract by not finishing the job.

      The results are he is a ***** and did not honor the contract or settlement I offered to his company cannot be trusted and please make sure my complaint is not private and that he lied about the agreement of the $15k and i never agreed on it he made that up. As for the old patio it was to code and it was build when the house was constructed as it was in the deed. To conclude he abandoned the job and failed to honor the contract and walked away never communicated with and failed to respond to all my calls and messages. 

      He is a fraud and should not be allowed to run a business.
