    I am seeking assistance in recovering $3,250 from Moncada Contractors LLC. Despite attempting to communicate with the company about the remodeling of a bathroom, there has been no response. My father made a $3,250 down payment for the bathroom remodeling project, which was delayed due to unforeseen circumstances. Unfortunately, my father passed away before the project could be completed. I contacted **** **********************, the point of contact on the contract, expressing my intention to proceed with the remodeling. I proposed modifying the project to remove tubs and add showers instead of completing the entire bathroom. After I had signed the project contract, **** and his crew arrived on December 15 and demolished both shower areas, leaving us with no facilities to take a bath. **************, the individual assigned to handle the shower work, measured the space during the evening of the demolition. He mentioned that he was assisting Mr. ********************** as a favor while wrapping up another job. The following day, ************** arrived at around 6 pm after his regular work hours and stayed until 9 pm. During this time, he installed green drywall, utilizing existing boards on the wall and adding two additional green boards. During this process, I asked Mr. ********************** to use tiles my father had at the house, and he agreed. However, on day two I was concerned when again ************** came in the evening, worked a couple hours, and started putting up tiles which were not professionally cut (a niche was added just using 2 x 4s). This prompted me to reach out to another contractor to inspect Moncada Contractors work. And as I suspected, this work was not acceptable. For one, they used a green drywall, which is commonly used in the house, not in the bathrooms. ********************** should have been using Durrock. Moreover, no lining was placed in the bottom of the shower area for the drain, and the replacement pipes featured on the original paperwork had not been put in. Prior to terminating the contract with Moncada Contractors, I contacted ****, with whom we had previous experience as he had laid the patio in my parents backyard. The entire situation seemed inconsistent with our past interactions. **** kept requesting photos and later claimed I was altering the contract. I replied in a text stating that my changes were made to use my fathers tiles, which had nothing to do with him using the wrong material, such as the drywall instead of Durrock in the bathroom. Using drywall in the bathroom will result in further damage caused by mold, and the job would have to be redone because failure to do so would aggravate my elderly mothers respiratory issues. **** acknowledged that I would have my money (less the cost of the demolition and work completed) back in three to four weeks. I asked **** to have ************** pick up his equipment. As the new contract company, ********************* Home Improvements, removed Mr. ****** completed shoddy work they took off the boards he had fixed on the wall and the tiles behind the wall. I took pictures and sent to **** **********************. His response was he would have to talk to the company. I am not sure what this means as he owns the company. Also, it looks like **** **********************s company specializes in concrete masonry work. I am not sure why he took this job on when he had to subcontract out to **************, who does not seem to have the expertise to do bathroom work. I assume **** was giving a friend business, but at my parents expense. As of today, I still do not know what **** was charging to demolish my parents two bathrooms. However, I am requesting my entire deposit back. Before writing this letter in good faith I reached out to **********************, but got no response from ****. Furthermore, I had to hire a new contractor to complete the job!! Having a subcontractor come in for four hours in the evening to demolish both bathrooms was highly inconvenient. Even if the subcontractor had been using the right material and doing a great job, working only four hours a day would have taken days to complete the job. It is unfortunate my father is no longer with us, but I cannot allow ********************** (which has not been responsive) to get away believing it is okay to take advantage of the elderly by providing shoddy work. I am the voice of my parents, especially my mother, who is still with me. My father paid the deposit in good faith and in a timely manner. Accordingly, it is only fair we receive our money back.
