      I was driving on Chickasaw on my way to work I was the only vehicle passing by at that time and one of the workers of this company was mowing the lawn right next to the road and his machine shoot a rock right to my vehicle and broke one of my windows and also damaged the metal below the window (a Brand new car) I stop my car right away and went to the guy and he called his manager ***************************** and this person came in to the place after 30 minutes of the incident and he looked around, he was expecting to find the rock that cracked my window on the road and he couldn't find it, so he said they will no pay for my damages and they will not be responsible for what they did. Here I attached pictures of what happened and pictures of this **** business card he gave me at that time and a picture of the truck they were using that day.

      One of our operations managers at ProGreen Services received a call from this gentleman stating that one of our landscape crews working around the ******* area had damaged his vehicle. He was directed to ***************************** who spoke with him on the phone and stated that he would meet him at the scene. **** was working across town and drove directly over. Once **** arrived and spoke with the individual who stated that our machine was working in the area as he drove by and something shot out of the side of our machine and hit his car casing damage. The first thing **** noticed was that our machines on this job all had mulching kits on them which does not allow for any side discharges. This would make it very unlikely that something can shoot out from the side. **** also spoke with all of the operators/employees that were operating machines and asked if they noticed hitting anything or anything shooting out of there machines. No-one could confirm that anything shot out. **** looked around the area and couldn't see anything that *** have hit the car. **** let the gentleman know that he could not verify the damage was caused by ProGreen or caused at that time. We understand that accidents happen which is why we will always go out and make our best effort to take responsibility if we can verify that we are in fact the responsible party. We are sorry that this individual received damage to his vehicle. However, we were unable to confirm it happened at this time or was caused by our company.

      Upon leaving the site **** called our corporate office explaining what had transpired and filled out a incident report detailing the events. We made every effort to try and ascertain what happened and were unable to determine any fault.

      I am rejecting this response because: the rock that damaged my vehicle came from their machine working that day, they just don't want to take responsibility for what they did. I was the only car driving by at that time and the lawn care guy was mowing the lawn right next to the road, and the machine had the covers up when I went to confront him and he gave his supervisor's phone number to call, and then their employee put that cover down so when the supervisor arrived to the incident place the machine had the cover in place. Of course he couldn't find the rock that damaged my car because when something like that happens the rock can go on any direction, not to mention the supervisor got to the place 30 minutes later. So, nothing of what they said make sense. It is clear to me that they just don't want to be liable for what they did.

      The mowers that our company operates are purchased with "mulch kits" this means that the discharge shoot is removed and a steel plate is bolted on the mower to cover the opening. We cannot open or close. So, based on what our manager observed and these latest comments we reaffirm that we are not responsible for the damage alleged. There have been many times over the years that damaged was caused by our compony we always take responsibility when we can confirm that we caused damage.

       

      We responded to the site and unfortunately we were not able to agree on this matter.
