  We contacted Toole's Tractor Services & H2O Weed Control since they went to ***************** with us at the time to install a wooden farm fence around our property. They came out and gives us an estimate to install fence and it explained was explained they were licensed and insured in ******* for this type of contraction. We went with Toole's Tractor Services & H2O Weed Control for the installation of the fence. We discovery during the neighbors land survey the fence was installed incorrectly on the neighbors land appx eight to ten inches. Current survey for *************************** NE was sent to Toole's Tractor Services & H2O Weed Control via email. We contacted license on November 20, 2023, to discuss the issue with the owner ************************* was unwilling to assistance to relocate the fence. He then went on saying he grow up in the area and knows everyone and will use this against us if we tried to recoup the money for the repairs. We are unable to locate Toole's Tractor Services & H2O Weed Control contractor license or insurance information for these activities were over charge from original proposal and the fence was not install as agreed on the proposal. We can provide copies of paid invoices and checks, if needed. ***** still have issues they were not address and owner stated a few times, he would be back to fix them but havent returned to fix the issues.

  Tooles Tractor Services never sent the emails regarding the fence approval with approved proposal. We uploaded all the emails that were sent regarding the original approval and in Tooles Tractor Services response, nothing was uploaded or mentioned when questions were asked and reported towards over charging and not completing the work. 
  
  Its funny and kind of crazy that they did not want to send the approved proposal and approved emails over to BBB. Who they get caught in scamming people out of money, maybe. 
  
  All an approved agreements were made in writing and nothing outside of the documentation was approved.  
  
  I was outside of the house near the fence in front of the security cameras and **** made threats towards us on the behalf of hi company stating information along the lines of, i am going to get all your neighbors to testify against you if you *** me and i grow up here. This audio was capture on our ADT security system since I had him on speaker phone. 
  
  **** was aware of the sloppy work he did after completion and was kept promising us he will fix the fence. Screws were not screwed in correctly and gates do not close. Every time we talked with **** he stated he will fix it next time. 
  
  As showed in the uploaded documents, it included 550LF and gates. 
  
  Recently we discovered Tooles Tractor Services were NOT licensed in the **************** for this type of work and his insurance policy do not cover construction work. In the ****************, you need a contractor license for this this type of construction work and dollar amount. In addition, his insurance DO NOT cover this type of work. The insurance information was verified under the freedom of information act with the ****************. 
  
  Enhance the reason why he did not want to disclose his license and insurance information because he was acting outside the bounds. 
  
  Tooles Tractor Services used their ********* to scam a person. They quoted ********* ****** and a ********* ******** and pride ourselves Classic scam. Over 50% of poor-quality work, is***s, and scams were in correlation to a ******** who used their faith as a cover up. 
  
  All documentation were provided to BBB with the approved proposal. Tooles Tractor Services worked outside their license and insurance policy and now they want to use the faith card to get out of their mistake. 
  
  We are requesting a refund of 4300.00.

  Tooles Tractor Services also never uploaded pdf copies of the emails, I do not know if all or any of their statement is correct. Where are the actual emails? Its easy to print to pdf.  A person can make up whatever they want but print to pdf shows what is TRUE.

  I do not feel this customer is owed any money. I have attached the invoice showing the costs for his fence materials and installation. It also shows each payment that was made for the fence. There is also an email attached showing where the customer added additional work.

  Also, AFTER the fence was done and completely PAID for this customer had us come back in August and do additional dirt work for him. NOTHING was ever said about anything not being completed or that he was unhappy with anything regarding his fence, nor did he EVER at any time say anything about being over charged for any work.

  I am rejecting this response because:

  We are not happy with the business response. ******************* the owner of the business used his faith and the church we used to go to as a cover to a scam. According to **************************, 75 % of unprofessional and poor workmanship were performed by a person within a church to another member.

  
  The business was not insured for the construction of fence and out of scope for their state licenses. They were not licensed or insured for the construction of fence. We were taken advantage of through his church. The fence was not installed and constructed in a straight. Its company over eight weeks to install a fence that were promised to be completed with four days.  We contacted their insurance company, and they are not covered for anything of construction work and **************** informed ** they are not within their license. They both have started a fraud/unprofessional conduct investigation into the business for this activity.

  
  The business worked out of approved scope and over charge us. No other work should have been performed without approval of the homeowner.This is a classic scam. We only approved the scope within the approved scope.

  
  Phone records showed we contacted the business over 38 times to connection to the fence. We left voicemails and talked to ******************* via cell. **** was aware of the issues, and we were promised the issues would be correct. We hired him to deliver dirt and he were supposed to correct the issues with the fence but never did. This is a classic scam, always asking for more work and money but never complete the jobs.

  
  We had to terminate our monthly lake contract with the business due to work that were not performed. They sprayed the neighbors lake line but not ours. Video camera did not see anyone spraying our lake line but only the neighbors. We were also charge monthly fees after our contract ended.

  
  Our phone conversation to the were unprofessional and had the word scam all over it. Went we talk to **** regarding the phone, saying he grew up here and knows everyone and will get any lawsuit toss out. He will also contact all our neighbors and get them to testify against us. Phone conversation were capture on our ring cameras.

  
  We are requesting the cost of repairs with the unprofessional and poor workmanship of the fence. The business is unwilling to workout any form of agreement to bring the issue to a close. We have not been reached out to from the business after ********************* threated us via phone.
