      This company was hired two are three years ago they couldn't do the work correct was very unprofessional had the windows in back order for over one year and said it was because of covid in the process of that they put a lien on a job that was not even completed just so they can get paid and installed the window with the no permit no inspection, now that building hoa and the *************** is asking for new up to date permit plus to finish the inspection now they have gone dark don't answer the phone and no response the city is going to fine me if there is not permit and inspection and they can care less please them need to finish the most simple task and be gone I'm about to report them to the **** and report them to the courts so they can go after their license **** and Cadillac are thief and have no compassion for people please

      The permits had to be resubmitted because they expired. They were resubmitted and all inspections were passed. Project is closed.

      I entered into contract ****** for windows and doors. 2nd of 3 payments made when work allegedly completed ******. Advised company on 0915, 1012, 1028, 1107, 012023 and ****** that the front door and window leaked. That I will pay balance $2346 once no longer getting water into the house. Received call **** and ****** threatening lien. The work isnt done, why would I have to pay when its still wrong?

      I sent my field manager to your house to walk through the project and any issues you may have before processing your final invoice. While he was there the only item mentioned to him was the door not any window so no window was inspected, therefore I have no response as to the window. As for the door your door is working and installed properly which was explained to you by ****. The problem is that during our initial contracting we offered you a high quality door that we prefer to install. You instead chose a low quality metal product which is the cheapest door we carry. This door doesn't have an extremely tight fit inside the frame. It is an impact rated door and does the job but there is a small gap between the door and frame which if you spray a hose directly at such as when you wash your door with a hose like you told my rep some water will push it's way through that space and sit against the inside seal of the door. There is no fix for this other than ordering and installing the premium door we suggested to you in the first place. When this was told to you by **** your response was that we needed to buy you a new door.

      I am going to guess that your prior door opened inward instead of outward as this was very common in doors before impact rating became a requirement. In doors that open inward the seal on the door presses against the door frame on the exterior so spraying water against it with a hose would hit the seal and there would be no possibility of water getting stuck against the seal. Now that the seal is against the other side unless the door has a very tight fit in the frame spraying the gap between the door and frame with a stream of water can cause some water to push through and rest against that inside seal either slowly seeping through or more commonly getting on the inside of the door when you open it. This doesn't happen when it rains only when someone is shooting a hard stream of water at the door. With the low cost door that you requested there is no fix for this other than purchasing and installing a higher quality door that is cut better for the frame and thus has less space for water to push in. Even with these doors if you spray the gap long enough water will push through and sit against that inside seal because with an outward opening door, as all except the most expensive impact doors are, the seal is on the inside. 

      I am happy to install the new door for you for free but you will have to purchase the door. The door you chose which is the low cost option is installed properly. This was explained to you by **** when he was at your house. 

      As for the lien issue you were not threatened by a lien you were invoiced as all of your windows and doors were installed properly and inspections were passed. We even painted your front door for you which was not in our original contract. You were informed that our software puts someone through to lien after a specific amount of time not paying their final invoice. This is standard and is the only way contractors can protect themselves when clients are unwilling to pay their bill after a completed install. 

      So what would you like to do? Purchase a better quality door and have us install it for free or maintain the current door that you ordered which was installed properly. Either way the final payment is owed at this point in time. We are here to help and want you to be happy but we are not in the business of providing free upgrades for clients who are not happy with the quality of product they chose. If there is an issue with your window we can have someone come by and check. Since this was not mentioned in your final walkthrough it becomes a warranty issue which is covered by the warranty section of your contract and has no bearing on final payment.

      see attachments. **** claims I ordered cheapest door. They initially brought a steel one and i refused install based on my contract. The door was painted because the first of 4 project managers offered. He felt bad that it took them 9 months to install. Followed by 2 failed inspections, resulting in city approval 6 months later. I am not looking for free. I am looking for quality windows and doors that water doesnt leak in.  It cant even handle a garden hose spray down for periodic cleaning; heaven knows what would happen in a storm and scarier yet.a hurricane.  My balance will be paid when the contractor finishes what they were hired to do. Provide windows and doors capable of withstanding a hurricane.

      OK so in your estimate you were billed $550 for a standard metal door which is the lowest cost impact door that we carry because that is what you requested. When your salesman was signing with you, you apparently rejected that door and got him to upgrade you to a fiberglass door again from our low cost supplier without a change in price. I was unaware of this change but we honored it in the field. Attached is an invoice for that door which materials cost is $463. $200 our cost for install plus paint puts our cost on that door at about $750, $200 more than you paid. Now this door as I stated is installed properly. However because you are unhappy with the door that you underpaid for you want me to purchase a door that we normally sell for $1500 to replace it. I am willing to install this door for free to make you happy but you will need to pay the materials cost for the door of around $800 and you think that this is unfair, we disagree. Please note that as my earlier email states and as my PM stated to you any standard impact rated 6 panel or flat door will be subject to water coming through the gap if you run a direct stream of water on it such as that from a hose because the seal for an impact door is on the inside edge of the door. This means there is nothing blocking water from coming through around the frame other than the fit of the door in the frame. There is always an air gap there or the door will not close. On the more expensive door it is a little tighter so water cannot get through as easily but it can still penetrate. This is a hose with a direct stream not rain as rain does not flow in a direct stream like a hose it will not push through. In the more modern aluminum and glass doors there is felt that seals the gap so water will not penetrate but this is not present in say a fiberglass door that would be purchased at ********** or from Therma Tru. 

      We want to help and we want to make you happy but what you are asking for is outside the scope of your contract. Please note your final invoice is due as all products requested were installed properly. We are willing to help you resolve any issues you have but you must work with us to resolve them.

      I am rejecting this response because:
      I ordered hurricane windows and doors. I did not order a specific type or brand. I expected them to prevent wind and rain from coming inside. The company claims that I ordered an inferior door at the lowest cost. That is not the case. I wasnt offered or explained different types. I merely wanted something to prevent my home from wind/rain/storm/etc.  There should not be any breakthrough. My old metal door that was in place for 20+ years didnt have leakages. Its obviously an installation issue, a seal issue.  I cant explain or understand it as I am not a door expert. Merely a customer that wants to protect her home from the outside elements.

      Transaction of the date of contract was October 7, 2021. The total contract with first amended added up to $44,674.81. I gave them $20,597.20 as a deposit. The only thing they have done with that deposit was an architectural plan which cost $1,350.00 because it was requested by the building department of ***************.It took them to the end of March to get the permit approved but it cannot be issued until the Electrician presents proof of Liability and ********* Comp. It is 2 months now I have been waiting for that. I try constantly to contact the owner who is working directly with me but he does not return my calls in a timely manner and has not completed his responsibility. I am entitled to have this work done by now. I want my money back minus the cost of the plans and terminate the contract. I have personally spent additional money for the permit and much of my materials to be used. The owner has not been truthful with me and I do not believe he can produce any work. He has made excuses since November for everything and has not any money out of his pocket.       I never received any copy of this complaint or I would have responded sooner. Permitting takes time, we paid a firm to complete the drawings for this project and worked with the city to complete the approval process. We are aware that this was not approved as fast as the client would have preferred but the permit was approved and we had every intention of completing the work. Upon commencing with the work the client was very combative and hired legal counsel even though there had been zero requests to me for any sort of contract cancellation, in order to avoid further hassle from this client who we believe located another contractor to do the work for a lower price we agreed to cancel the contract even though there was no default on our part of the contract. As of now the client is awaiting her partial refund for deposit less work performed which should be issued shortly.

      I am rejecting this response because:

      Besides putting me in a bad position living in my apartment since October 2021.  *********** did not submit permits correctly nor attempted to resolve the sub contractor issues with the building department until it became impossible to talk with Aacon. Nor did they answer my complaint to your office. Therefore I did get a lawyer to handle the negotiations to finish the job first and they still delayed by not showing up when verbally promising to do so. A Termination of Contract was issued to them on June 21, 2022 and not until August 12, 2022 did my lawyer receive a response as to how AAcon was going to refund the deposit money minus any expenses they incurred.. I agreed to the amount and they said as soon as I could show proof that they were not on the permit, a check would be issued. I showed themon August 15 that they were no longer the contractor. and  it would take 30 days to issue the check. They did not refund me the money in 30 days and today, September 23, 2022, my lawyer received a communication that they are waiting for another company to pay them to pay me. That money should be immediately available to me from their accounts.  They are undercapitalized and underfunded. Waiting for some other client  to pay them to pay a client that they owe money.

      Also I did not get another contractor for a lesser price. It cost me more because I had to pay more money for new permits and we had to start all over with a plan. However, to let the BBB know and anyone that reads this , the new contractor got the permits, did the work I requested extremely well and got all the inspections finalized in 2 months. Now that is a Better Business!!

      Now let us see how long they will take to refund my money. Hopefully you will not be hearing back from me and I can accept their reply. However, at this time I do not accept their response.

      We will have to agree to disagree here with ***************************. We had multiple deposits paid to subcontractors for work that was to be completed on her project which still have not been recouped as of today, as such she is being paid from our general fund which will include money from other closed projects. This is not due to us being underfunded but due to us not pulling money from other active projects to cover the deposits already paid out on her project as they should have been. The facts remain that because the permitting took too long the client did not want to work with us any longer. We agree that the Engineer that we provided did a poor job. Since we were the ones to refer him, we did not make a huge issue out of us parting ways even though it was in our right to do so. We provided a fair settlement to her contract even though we were never given the opportunity to actually perform once the permits were approved.
