      We contracted Aloha to build a ~$140k pool in June 2021, pool remains unfinished June 11 2022. Aloha is demanding full and final payment before several outstanding contract items completed and a major issue left unresolved (wrong screen enclosure style installed - we contracted mansard they did a custom without consulting. The lack of communication throughout the entire project has resulted in very significant issues for us and decisions made by the contractor counter to the contract. There is one addendum with some changes we mutually agreed too and signed off on. No changes to the contract should have been made without our signoff but after that addendum, changes to contract were made by Aloha as a surprise to us. All the items we list below are on the contract/initialled selection sheet and we have backup emails and pictures to support each issue raised. Aloha Brian has also threatened that if he doesn't get it immediately he is going to put a lien on our home. These issues are: a screen enclosure installed that is not what was in contract, salt system, auto leveler and infloor cleaner not installed, pool gem finish done in the wrong color - opposite actually to what we choose and in contract, incomplete fire pit, no fire bowls installed, no handrail installed, There have been threats in emails from Brian, one - he will not connect the pool systems per the contract until he gets final payment. Two - anything that comes with their pool build service is no longer available to us and Brian wrote "balance chems, free pool service for the first month , waved service calls, pool school. At this point tough you will need to hire someone to do a proper start up to prevent voiding your warranty." Aloha says all left is fire pit on contract. Above is just a brief summary, please find attached the full explanation of all the outstanding contractual items as they are too numerous to explain here. For every issue raised we have supporting documentation/emails.

The only thing I am willing to address is the signed contract stated payment due upon pool being operational. Your outstanding balance is $18,000.00, and we simply will NOT continue to throw away money because of your threat. Now I would like to address the "BBB", I encourage all consumers to do their homework on the BBB and what BBB does for you as a contactor. I will testify that every complaint you have made against Aloha Custom Pools is false and will not settle. We have supplied documentation of contracts to prove our cases for this exact reason. They simply do not care because we do not pay over for their membership. I ALWAYS ask every customer to review everything in our office for themselves as well. The BBB is simply a trashy bathroom stall upon which anyone can claim anything to strong arm contractors into protecting their reputation by giving in to over initiated customers demanding more than they pay for. If the story has two sides than address which items we identified are incorrect. You fail to address any of the issues and they are significant, pick one even. We will pay the final amount as soon as you complete this long overdue job.
