The business was hired to find a resolution for tax problems . The business only gave me three options to pay in full to take out a heloc and to settle for installment payments of 1490 a month for literally life. I was not offered any programs that I am eligible from *** and never mentioned any programs - once I hired another business I was still being contacted- the power of attorney I thought should have taken care of that - I feel that I am owed a refund because I paid 5000 dollars for my taxes including back years to be filed . The advertising is false my choices were ludicrous.Business Response

I hired J David Tax to help with tax issues I got myself into. During that time (years) I hired them to do my taxes. When the 2019 taxes were filed (during Covid) they were filed on time (because there was an extension for everyone) but the State and the *** said they were filed late. Jdavid Tax requested the late fee be refunded. The *** refunded but the State did not. There has been many communications to get it back but still nothing. Now Jdavid Tax no longer is monitoring the situation and I am left on my own to deal with it. I feel like since I hired them that they need to follow it all the way through. I no longer use their services.Business Response

************** is correct that we had to re-submit the penalty abatement request to ********** and they are processing it, so, he is correct, it is not resolved yet. However, we have re-submitted for processing again and expect the penalty abatement to be successful once processed. We appreciate his patience as we wait for ********** to process our re-submission.Initial Complaint

DO NOT TRUST THEM. They took $3500 from me and did ABSOLUTELY NOTHING. I could have used that money to pay my taxes. The paralegal and lawyer was changed without my knowledge because they quit or got fired. I was emailing someone who no longer worked there because I was not notified until I called the office. After not doing anything, my case was closed and now I have to pay to reopen my case... this is insane. They stated they would reopen it for free but I already called the State myself and figured out a payment plan. Not one phone call or letter was sent on my behalf and I need a FULL REFUND ASAP!!! DO NOT TRUST THIS LAW FIRM!!!Business Response

J. David Tax Law is disappointed to receive such a defamatory complaint and feel the need to provide essential facts. The legal assistant did change during ************************ case, but the new legal assistant was quick to introduce themselves to ********************* In doing so they asked for needed documents to move her case forward. The attorney assigned to her file did change in March 2022. However, ************************ claim that she was not notified is incorrect. She was emailed about the change on 3/16/22 and she replied acknowledging the change the next day. The new attorney after reviewing the file contacted ******************** and asked for the documents the prior attorney was seeking. Fast forward to 5/25/22 and the firm still does not have the needed documents. In a reply email on 5/25/22 ******************** tells the legal assistant she will send the documents. Over the next several months legal assistants left voicemails and sent emails asking for the needed documents. ******************** finally responds to a letter mailed to her asking for the documents on 12/12/22. She sent one of the needed documents on 12/14/22 and was replied to with a list of remaining needed documents. When the needed documents were not received by the deadline her case was closed in December 2022. The firm does not have a record of ******************** contacting the firm again until 10/24/23. At this time she is updated as to her case's standing, again is informed of the needed documents that would allow her case to resume, and tells the legal assistant she will send the documents. On 11/16/23 ******************** was informed the state would send her a letter regarding documents the firm sent the state. She said ok and indicated she would wait for the letter. Therefore, her claim nothing was sent on her behalf is incorrect. We did not hear from ******************** again until 12/27/23 and in this email she did not supply the needed documents. Unfortunately, to this day the firm has not received all the needed documents to move the case forward. The billable time on this ************************ case is above and beyond what she has paid the firm therefore there is no refund due to ********************. We are at impasse and are ready to move forward with the BBB arbitration process.Customer Answer

Complaint: 21159171
I am rejecting this response because: I did submit the power of attorney and requested several times to send me the documents to remove my hysband from this as he is not liable. I did not have a job at the moment and they requested paystub. They never got back to me about the paperwork regarding my husband until later. Nothing was done for me even though I submitted a power of attorney. I see several complaints on the BBB against this law firm regarding the same issues and it needs to be stopped. For someone who is looking for help fixing a tax issue and to pay this law firm $3500 to do nothing is insane. This money could have gone to my taxes, not to a law firm that did nothing.

I hired J David over 2 years ago and was told by what I assume to be the salesman hired to sell you on their services that "we can almost always get the fees removed it's the interest we can't help with....etc" I was told this process is long and "can take up to 6 months" We are now at 2 years and $6k later that I paid them and they have done absolutely nothing for me to help me get some fees removed which it what I was let to believe they could do. This has cost me more money than I could have just calling the IRS myself. After my file was sitting and being tossed around multiple times to attorneys who never worked on (they see to take on way more work than they can handle) them I finally got at least something to happen after speaking to a partner. After finally speaking to the person who was handling my paperwork for the 4-5 time i find out that the IRS doesn't care to assist you unless you're a FIRST TIME OFFENDER - I had never not paid taxes before BUT I had been late a couple times. Which in the IRS eyes I AM NOT a first time offender. You can pay your taxes ONE DAY LATE and you are an offender. Had this company been fully transparent they ASKED QUALIFYING QUESTIONS to people seeking their services and I would have then known had they not misled me into believing that they could help me with my $27k in fees. My ex who is an attorney said he unfortunately thinks this company is scam and that I got played by the salesman whom you speak to when you call in. They are dishonest and will tell you what it takes to get your $$$. STAY AWAY FROM THIS PLACE AND TALK TO The IRS DIRECTLY. I spent $6k to have them submit a couple forms for me (form the IRS could have given me to fil out) and that's about the gist of what they have done for me in 2 years. Frankly I believe they can't keep up with their volume due to the all the extra people the IRS is going after now so they just take your money and they forget about it.Business Response

We are disappointed to read this feedback after the work that went into this case. This client came to us with unfiled returns with the IRS and an outstanding balance in collections with the IRS. We kept her safe from collections while we worked to prepare her unfiled tax returns. We completed her missing returns and filed them getting her compliant and eventually got her into an affordable payment plan. We submitted for penalty abatement and her case was closed with us on 9-14-22 and now we see this complaint made nearly a year later. The billable time spent on her case goes above and beyond what she has paid the firm and therefore no refund is due.Business Response

We hired this law firm back in 2019 to handle our federal and state taxes which were from Virginia. Where do I start it was potentially going well but it went down hill. Recently I file with them for our 2021 taxes which I won money from two casinos one from Virginia I know from past you have to claim money to irs. I sent all necessary documents showing what I won but I was told our taxes was done properly how. That’s one issue the other is we received a letter stating our taxes are being sent to collections and when I looked it up it’s states the reason is non communication from a third party. Which means they haven’t been in touch I am very upset now our credit will be ruin. Another reason also they let state of Virginia put a lien on our accounts if I haven’t gone to bank to withdraw our money it would have been gone. So I would like to see more done with our case we own well over 80,000 with no relief in sight.Business Response

Paid a $3500 retainer fee to JDavidTaxLaw with an associate by the name of ***** ******** I needed them to help settle a sales tax dispute in the state of Ohio. I was outsourced to a firm in FLORIDA and was given the run around for months on my case. In frustration, I called and requested my case be terminated and my retainer be refunded. I have not heard ANYTHING from anyone in the company since . When I tried to call the number ************ someone named ****** had a voicemail at that number , so I am fearful I have been scammed and my money stolen, which would explain why my case was not worked on or resolved .Business Response

This client did come to us with an Ohio sales tax dispute, and the firm has handled these types of disputes many times with great success. Ohio has estimated balances from estimated returns b/c she never filed. The attorney explained to her on several occasions how the issue would be handled. We simply need to file original sales tax returns to replace the estimates. Client finally sent documents with sale tax numbers, but not other needed documents. Even though the proper strategy was explained to her, she kept arguing with the attorney over how to handle the case. Before her decision to terminate the relationship with the firm she was kept in the loop with what was needed to move her case forward. The client simply refused to provide what was needed to get her resolved. Our billable time is over what she has even paid and while we would never ask for more than the contracted fee there is also no refund due per our contract and time spent on her case. We are happy to resolve the balances for this client if she provides us the necessary documents.Business Response

Complaint: 20105659
I am rejecting this response because:
There is NO WAY $3500 has been used to work on my case, as it never got off the ground ?? They self admittedly state they could not do the work because I failed to submit necessary paperwork for them to do so . I have not received ONE itemized bill from this firm EVER regarding my file/account . I had apx 3 voicemails less than 2 min long and 4 emails from this firm . I have never received ANY paperwork confirming that they have filed any kind of paperwork with the State of Ohio regarding my sales tax dispute . By MY calculations they have used no more than 1- 1 1/2 hours of “billable” time emailing me and leaving voice mails . It is outrageous that they say my deposit has been used up by them with their efforts ?? I will file a civil case against them and fight this in court if they are going to refuse to refund my deposit FAIRLY and in sync with work they actually did . I have nothing from them that furthers or helps my case in Ohio.

We have attached our billable time summary here for the client's reference. Per the signed and agreed upon contract for services that the client signed, if a client wishes to cancel then we will look at the billable time summary to determine whether a refund is due or not. The billable time is beyond what the client has paid to the firm therefore, as stated, we would not charge anymore than the contracted fee but no refund is due either. We are happy to proceed with the client's service. If the client wishes to not proceed with the completion of service then we are prepared to go through the arbitration process.Business Response

We have left the client a voicemail to discuss some of her understanding of what her options are and what a lien would or would not do and mean for her. The client's file was with IRS Exams and literally just got back to Collections which is where it can finally be resolved which has been explained to her so her claim of her case taking too long is without any merit as we have been waiting on the IRS to conclude their exam. The client wants an offer in compromise, however, she has significant equity in her home which would preclude her from being a good candidate for an offer in her case. This has been explained to her as well She does have a good option, we could likely get her into a $0 per month agreement called a hardship status/currently non collectible but she does not want a lien. The work on this case has been diligent and with proper timing and explanation of each step. The billable time we have spent on this case is above what the client has paid to the firm therefore there is no refund due.Business Response

I was assigned ***** unfortunately there’s been quite a few missed steps with him. Starting first with missing our first appointment and following up with failing to fix one of my years tax returns to the point where my university found the error while doing FAFSA. I was told I would be assigned a new lawyer but it never happened and now six returns got kicked back. I waited a little bit and I asked Aamir for an update only to have him ask me what I wanted to do. This makes no sense I hired *** ***** tax law to fix my prior years taxes which ****** did not do completely for one year until it got caught by my school’s financial department doing fafsa and six others got kicked back by the irs. When I informed ***** of the six that got kicked back I sent him photos and verified that he received them and heard nothing. I sent an email to follow up only to have him ask me what I wanted to do. The only thing *** ***** has been prompt with is charging which I paid in full a long time ago. Their management is extra disrespectful including telling me that they were going to switch me out from ***** after dropping the ball on one whole year which they never did. I never know how to get a hold of him he’s had three different legal assistance since I’ve been there including the women that read me someone else’s information thinking I was them.Business Response

We have reached out to the client and addressed the issues. We previously offered to reassign a new attorney to *** ****** case but he declined at the time, he now wants a new attorney which we, of course, will do since he has now requested. There is also some significant confusion to be cleared up on this one. At the moment, *** **** believes that the IRS kicked the returns back because we did not include necessary information which actually is not the case. Upon review, it looks like the IRS has made some processing mistakes on 2015-2016, requested schedule 1s, which were not in use for those periods, and requested proof of withholding which should have been identifiable from the wage and income transcripts for all of those periods. This all points to IRS tactic to kick returns out so they do not have to count them toward the tax return processing back log. This is difficult on both taxpayers and on tax professionals and results in situations like this one where there is confusion and dissatisfaction due to IRS processing errors. Regardless, we will do what we need to do to get the returns filed and processed by the IRS no matter what it takes to do so.Business Response

We originally hired this firm as soon as we got an IRS notification of collection May 2022. As soon as we started paying them, all communication stopped. No one answered and/or returned email or phone calls. Turns out the attorney that was assigned to our case quit, which we were never informed of. The IRS has nothing on file that J. David Tax Law had ever contacted them on our behalf, putting us into further debt with the IRS. We are demanding refund for services that were never done. Multiple contacts requesting as refund has only demanded rights to sue us for 20K when we were to speak the truth about our experience.Business Response

We disagree on several points with this former client. We have offered her a refund to sign our termination agreement which is part of our process for terminating services before a contract has been completed. She has left 3 bad reviews and BBB complaints on 3 different tax companies all within a few hours including TaxRise Inc and Tax Hardship Center LLC. Clearly there is a pattern here, client hires a company and then posts bad reviews and makes bbb complaints. Despite this, we have left another voicemail for the client. Our billable time on her case is above and beyond what she contracted for and paid us yet we still offered a refund despite the fact that in our contract for services if you terminate services early we go based on the billable time on her case. We are waiting to hear back from the client to move forward with the termination agreement and $3,000 refund (even though it is not due based on our signed contract for services).Business Response

The last time we spoke to this former client trying to come to a resolution on this issue, she resorted to name calling and verbally abused our employees and we do not tolerate that from anyone. As pointed out in our prior response here, this former client, has hired 3 different tax firms and left all 3 companies bad reviews and complaints all on the same day at the same time. We pointed this out on our reply to her review and, low and behold, she has now hidden her reviews from being seen when you click on her google profile. I wonder why? This is plain and simple: 1) We signed a contract for services, 2) The client wanted to cancel and we go by our billable time as outlined in the signed contract for services. The billable time is beyond what she has even paid to the firm and we are not seeking the overage, however, we are not providing a refund either due to the amount of billable time we have spent on the case. Clearly, we are at impasse here with this former client. We have prepared all documents and are ready to show everything that we have outlined during the BBB arbitration process with this former client.Customer Answer

I hired (PIF) this law firm to help me regarding my back taxes debt last October. We have sent them all information requested numerous times and because of their high turnover we've had to submit Power of Attorney several times. We were hoping to get a resolution by now. Their response and communication is very poor at best. They take a long time to respond, if at all. Judging from all the complaints I regret choosing them. I would just like our money back as I could have done better at this by now. Poor customer oriented so call law firm! Your A+ rating is way over rated.Business Response

Businesses are under no obligation to seek BBB accreditation, and some businesses are not accredited because they have not sought BBB accreditation. BBB charges a fee for BBB Accreditation. This fee supports BBB's efforts to fulfill its mission of advancing marketplace trust.
