Dear ********************,
Due to attorney-client privilege concerns, I am limited as to what I may say in this response.
First and foremost, I find ******************** allegation that I stole money from him, as outrageous and actionable. **************** retained my services to handle a legal matter for him and signed a retainer agreement which had very specific terms. I am an attorney that specializes in the area of Consumer Bankruptcy. **************** signed the retainer agreement acknowledging that he understood the terms and conditions of the retainer agreement in April 2023. Please know that **************** failed to abide by the terms of the retainer agreement and breached the same.
I began working on his case in April 2023, the retainer agreement expired in August 2023. In September 2023, **************** indicated that he wanted to pause moving forward with his case. In October 2023, **************** indicated that he wanted a refund after speaking with my staff due to personal reasons that I am not able to disclose. I spoke with **************** and explained that we began working on his case when he retained my services and that he had other benefits that I am not able to disclose. I further explained that the fees were non-refundable as specifically laid out in the retainer agreement. I offered him the opportunity to continue with his case which would require a new retainer agreement since the original retainer agreement expired. I explained to **************** that I would be willing to give him full credit for the legal fees he had previously paid under the new retainer agreement. **************** indicated that he wanted a refund and I explained to him that the contract we entered into specifically stated that the fees were non-refundable once work had begun, among other provisions. **************** understood the same and stated that he would get back to me as to whether or not he wished to move forward with his case. Please note that I have all the documentation that **************** provided to us by and through our secured portal. **************** was required to upload his required documents into a secured portal so I do not know what he is talking about in terms of dropping documents off at my office, as that would also be a breach of the retainer agreement.
In sum, ******************** case did not move forward because he did not pay all of the attorney's fees and costs owed as laid out in the retainer agreement. I am more than glad to help **************** should he wish to move forward with his case and provide him with a credit for what he has previously paid. The choice is up to him as to whether or not he wishes to do so.
Should you have any additional questions or concerns, please don't hesitate to contact me.

I received the above letter Saturday and I still have not received any phone calls return from sacks and sacks since the original complaint so I still don't know what is going on since they're not she's not calling me and the only thing I can figure out is she may be in some trouble because she messed up and the first bankruptcy session she had messed up about not adding the mortgage on the chapter 13 so then the money changed as to what I owed but I didn't have any clue as to what I owed at that point in time and it was due the next day so I had to call TFS who I send the money to and tell them that that amount that they had at that point in time was incorrect so I don't know if it's still going on I sent you the letter I got Saturday from the trustee that was sent to ******* ***** so I have no clue as if I'm still in court or if I'm not in court or what I need to pay it's very nerve-wracking the lack of communication with ******* ***** not responding to my phone calls.Business response

I was wrongfully terminated, drove me to bankruptcy… Recently had a chapter 13 dismissed with * ***** as my attorney ..I gave heads up of my upcoming dismissal… I never heard another word .. not even to close out, what to expect… deptors adding fees after the dismissal , I don’t know if they are legal or not…I reached out, no help… but she took that initial call to consult right away.. had another attorney at my first meeting w debtors, I had to file everything, clerk only kicks back or accepts….so many disappointments, especially when comparing to a 13 I filed previous to this that was also dismissed… I could have done this by myself… but those aren’t even my complaints… just another experience of mine with people being ok w mediocre performance… my issue is…. I paid to have a debtor added. $500.00. To my knowledge this never happened. I asked for documentation it was filed or a refund. No response … maybe the exceptional work only extends to others, I’m sure Ms ******* is underpaid
