    Government Action: BBB reports on known government actions involving business’ marketplace conduct:

    OFFICE OF THE ATTORNEY GENERAL, STATE OF FLORIDA, DEPARTMENT OF LEGAL AFFAIRS v. KINNECORPS, LLC, a Florida Limited Liability Company; and ROGER VAN DEN BOSCH, JR., individually and as manager of Kinnecorps, LLC

    Attorney General Ashley Moody’s Consumer Protection Division filed a complaint against Kinnecorps, LLC on March 5, 2019 for scamming Floridians in need of roofing repairs. The complaint alleges that Kinnecorps, LLC, and manager, Roger Van Den Bosch, Jr., violated Florida’s Deceptive and Unfair Trade Practices Act by taking money from consumers for roofing construction and then failing to finish the work. Many of the consumers victimized by this deceptive behavior include senior citizens and Floridians whose property suffered hurricane damage. 

    The complaint alleges that the defendants violated the Florida Deceptive and Unfair Trade Practices Act by: 

    •?Soliciting roofing jobs from homeowners when the defendants lacked the funds to begin or complete work; 
    •?Taking payments from homeowners for roofing jobs with no intention to perform the work; 
    •?Accepting homeowners’ insurance proceeds for roofing jobs without completing the work; and ultimately, 
    •?Failing to perform the promised roofing work. 

    Additionally, the complaint alleges that the manager of the construction company used company bank accounts to fund personal expenses. The defendants also unfairly penalized homeowners for trying to hire a new contractor or request a refund because the defendants’ contract requires customers to pay 30 percent of their insurance proceeds or $3,000.00, whichever is greater, if the customers cancel. 

    The complaint seeks temporary, preliminary and permanent injunctive relief, restitution, disgorgement of ill-gotten monies and civil penalties.  The matter is still pending as of 10/01/2019.

     

     

    Government Action: BBB reports on known government actions involving business’ marketplace conduct:

    State of Florida v. Roger Van Den Bosch

    On May 24, 2019 the State of Florida filed felony charges in Clay County, Florida. Charges filed allege Kinnecorps manager Roger Van den Bosch committed the following: Insurance Fraud, Money's Received by Contractors, Uttering Forged Instrument, Grand Theft. The matter is still pending as of 10/01/2019. 

    Pattern of Complaint

    Based on BBB files, Kinnecorps, LLC has a pattern of complaints alleging non-completion of roof repair or replacement work after payment has been secured by the business. In addition, BBB files indicate that consumers also allege the business encourages consumers to sign an “Assignment of Benefits” contract, and tries to make claims to the consumers insurance benefits months later, though Kinnecorps, LLC did not complete the necessary repairs on the home.  

    On April 17, 2018,  BBB sent correspondence to Kinnecorps, LLC requesting their voluntary cooperation in resolving complaints on file with BBB and providing steps it will implement to eliminate the pattern of customer complaints. 

    On May 29, 2018, Kinneporps, LLC COO, Roger van den Bosch responded with the following statement: 

    I wanted to speak to you personally and address the pattern of complaints listed. I do see the eight complaints in my file and these were done as a malicious attempt, by former employees, to discredit our company. We recently went through a “house cleaning” of several individuals due to taking advantage of the company and my generous nature. Lesson learned. Some of these prior employees have been contacting our customers and telling them to complain to BBB and others to try and get them out of our contract and sign them up with their new company. If you would look at the past few years of BBB and our company, we have helped nearly a thousand happy customers and will continue to do so. There are only eight complaints out of so many happy customers. I hope the numbers speak for themselves. If you look further into the complaints you will see that all of them have been addressed and that most of the customers are again happy with us and have dropped their respective complaint.  As an aside, in the industry right now there have been two hurricanes that we are all dealing with and they contribute to the tardiness of most roofing contractors. Not an excuse, just the facts. We are currently working to get back to the 3 to 4 weeks turn around and we do see this coming to fruition in the very near future. Please do not hesitate to call and speak with me personally if you have any questions or concerns, or feel free to come to the office anytime and meet with me. I do my absolute best to be available to all of my clients. Thank you for your time and consideration in this matter and I hope I have put your mind at ease with regards to these few complaints.

    In April 2018, BBB investigated Kinnecorps, LLC’s business practices. This investigation was prompted by an increase in consumer complaints and inquiries where consumers alleged the business encouraged consumers to sign an “Assignment of Benefits” for roof repairs and storm remediation however, after securing funds the business did not perform the work in a timely manner. Consumers could not hire a different company to perform the services contracted to prevent further damage to their homes as their insurance funds were either already paid or due to be paid to Kinnecorps, LLC. In addition, consumers allege that the business only completes portions of the contracted work, but bills the consumers homeowners insurance company for the full balance of repairs, preventing consumers from seeking additional repairs elsewhere. Further, complaints against Kinnecorps, LLC allege that the business bills consumers homeowners insurance company for home repairs not needed or not included in the original contract. *See public complaints for specific complaint allegations.

    On April 4, 2018, BBB sent an email to Kinnecorps, LLC requesting specific information regarding their practices. 

    The business replied to this communication on May 10, 2018 and supplied all of the documentation requested. BBB asked for and was able to obtain a copy of the contract Kinnecorps, LLC presents to its customers.

    The terms of the assignment of benefit are clearly laid out on the first page of the Kinnecorps, LLC contract. The following statement appears as shown in this section.

    I/We also herby authorize my insurance company to make direct payment of any benefits and proceeds to Kinnecorps, LLC. Payments shall either be mailed directly to Kinnecorps, LLC office or hand-delivered to its representative only.
    On the second page of the contract in the ‘Terms and Conditions of Service’ sections the following statement is made.

    If this contract is cancelled by the Property Owner(s) later than midnight on the 3rd business day from execution, customer shall pay Kinnecorps, LLC thirty percent (30%) of the insurance proceeds, or $3,000.00 whichever is greater, as liquidated damages, not as a penalty, and Kinnecorps, LLC agrees to accept such as a reasonable just compensation for said cancellation to be effective, notice must be sent via certified mail to Kinnecorps, LLC. Property Owner(s) understand this 30% is for estimation, inspection services and travel expenses.”

    The contract spells out the conditions the customers are agreeing to. However, there seems to be no way for the customer to negotiate out of this contract without paying a large sum of money to Kinnecorps, LLC if the job that is contracted is not started within a reasonable amount of time. 

    Florida Statutes specify: A contractor who receives, as initial payment, money totaling more than 10 percent of the contract price for repair, restoration, improvement, or construction to residential real property must:
    (a) Apply for permits necessary to do work within 30 days after the date payment is made, except where the work does not require a permit under the applicable codes and ordinances, and
    (b) Start the work within 90 days after the date all necessary permits for work, if any, are issued,
    unless the person who made the payment agreed, in writing, to a longer period to apply for the necessary permits or start the work or to longer periods for both.

    There is no start date or estimated completion date on Kinnecorps, LLC’s contract. 

    BBB contacted Kinnecorps, LLC on April, 17, 2018,  regarding the content of the complaints that it has received. COO Robert Van Den Bosch responded on May 29, 2018 apologizing for the pattern of the complaints. BBB has continued to receive complaints regarding delays in completion of repairs and lack of communication from the business.
