  We hired Top Notch Concrete on Friday, October 20th to tear up our current asphalt and concrete driveway. We were sent an invoice/contract for a total of $8027.00 which would include 23 yards of Concrete, tear out of old concrete and asphalt, hall away of the debris and labor. They requested a deposit of $4000.00 to be paid upfront which we did. They were to begin on Monday, October 23rd and was told it would be completed by Friday, October 27th. We were advised that he, the owner of Top Notch would be there Monday between 8:30-9:00am. He did not show up till 10:45…We were advised not to worry that the concrete would be poured and finished by Friday, October 27th…We kept getting excuses of why the concrete was not being poured. The owner of Top Notch did not show up each day to finish preparing the driveway and communication was very poor. My husband ***** advised ***** * that we would be ok with it being done by the following Friday Nov 3rd as long as she could guarantee it would be. We were promised multiple times that the concrete would be poured. We caught Betsy D giving us false information about the concrete company. The last straw was that we were promised the concrete would be poured on Thursday, Nov 2nd at 11:00. When the concrete company did not show we tried to reach Betsy and after many attempts we were adv the concrete company had cxled. My husband took it upon himself to call the concrete company and we were advised that Betsy D cxled. We then asked her why and she gave more excuses. I reached out to our sheriff’s dept and spoke to a deputy regarding our rights. We then advised Betsy that either we need the concrete poured by 1:30 on Nov 2nd or our money back. If we did not have either we would have their equipment towed off our property. We were again given many excuses and with no other option had their equipment towed. They have refused to refund us and now we are out of $4000.00 and a driveway that is not even ready for concrete.

  Thomas D****** was the one who showed up on the job site when he was supposed to. He done the job as he normally does there was a day that his tractor wasn’t working so yes he had to get it going or he couldn’t finish tearing up the driveway, but it wasn’t in the frame time frames or even dates that they’re saying And as Us not showing up or canceling concert concrete I had a family emergency which I tried to explain to them. They didn’t care they didn’t wanna hear anything. They told us that we were trespassed off of their property not to come back to their property so we cannot finish work if they tell us that we trespassed on their property our equipment was still on their property because they had told us that we were trespassed. We were trying to figure out how we were going to get it, which was the same day that, I had we had family emergency. I told them where I was which was in Polk county which is an hour and a half away from where they were. I told them I would be later. I would be home later on that afternoon and we would come get the stuff off of their property. They demanded us at Pacific time knowing that we couldn’t meet it that’s why they said the time that they did knowing that we was already an hour and a half away I’m dealing with the family emergency and they knew that we wouldn’t be able to make it back in time so that was why they set the time when they did . That was also why they had our equipment hold because again they knew that we were coming back, but we wouldn’t be there in the time that they were giving us so it was all about what they wanted. They said they done and there was a time set up for the third and not the second the third set up for concrete and , they got mad because I pushed it off to the third and I told them still I could make it and they told me no I told them that morning we would still have it poured on the third. They said no so tell them to tell the truth and not just try to get the stuff back now there was $4000 worth of work done. The other thing they owed left was for the concrete  And the driveway is ready to go. They still have our floorboards up there on their driveway on their property they have all of our metal pins. They have all of our stuff they did not send back anything because we did not receive no boards back or no metal pins back only thing we retrieved and we had to pay for Was $2000 to get our tractor and our trailer out of impound because they impounded our tractor so therefore they made us spend $2000 because they were impatient and couldn’t wait till the third which was the fight which was the original date . I had text messages so the original date was actually the third not the second and when I told them that we would still be there on the third, I still had time set for that they were just they were adamant about now, so with them being adamant about no that is when we just went and got our tractor, and they called us threatening us telling us that we only had this amount of time to do this and blah blah blah that and you know when people get mad that the threat they make now they’ve also went after us through a court trying to get $4000 back while my husband went over there and worked , he worked more than just what they’re saying they’re saying he wasn’t there while he was if he wasn’t then how did he have all of it done the only thing he had left to do was pull up the apron, and then that would be all done which he was waiting to pull up the apron after he poured so much of the concrete, the first part of the concrete because without that he wouldn’t stay in uniform as it was supposed to be they’re not concrete people so they don’t know how the job is supposed to be done. They’re just going off of what they think it should be done  so at the end of the day they their attitudes demanding, and their chopped up times is why we wasn’t able to get there to finish or do anything because they told us we were trespassed so again we couldn’t go back on the property too. We had to go pay $2000 to get our tractor back and now they’re trying to threaten us with everything else so the time that my husband did go over there and work that’s he’s not supposed to get paid for none of that  Think that’s for the $4000 comes to play because the only thing left to do is to pour the concrete. The rest of it was already done so at this case they are just trying to be bullies and I demand a time of place just like I got a letter in the mail stating that I had to pay them $4000 or else well I’m not gonna pay them $4000 because he worked  For he. We did demo the driveway. He did the driveway up and he hauled four trailer loads off of so we did everything that we said we were gonna do except for the concrete which they that’s their fault that we didn’t get to finish because again they kicked us off the property and told us we were trespassed and then cost us to $2000 to go get our equipment back from the impound yard. I also have  Paperwork from where we went and got the stuff back so if they’re worried about money, they shouldn’t have told us that we were trespassing not to come back to their property and we would’ve been there to finish the job on the third as we told them, and he told us, Mr. **** told us that as long as it was done by Friday, the third, he didn’t mind I have it in writing  And says she said in here they didn’t mind but because I was able to get it a day earlier and then something happened. I still left it to the third and they were not happy about it so that was a long story short actually a long story long but that’s a long story short  It’s all about who’s got more control over you and it’s not it’s not about that my husband did work they did cost us $2000 to go get our equipment back and they think it’s OK just have to turn around and give them $4000 when the only thing left to do now is to tear up the apron and to pour the concrete down, that’s it  They still have all of our metal pins which cost us money all of our boards which cost us money which they said that they sent all that back all that with the trailer and the tractor they lied they did not. They didn’t send any of that back. None of that was back with our stuff so they kept all of our stuff as well  so that’s my ending comment to that if people trespassing us and having big heads, I’m thinking that that’s how it works then that’s not how it works. When you trespass someone off your property we could no longer come on the property at that time rather to get our stuff or not because we don’t wanna go to jail just because they got mad , so sorry that you have to deal with this but this is part of only business and when people get hotheaded and they can just make demands if I’m an hour and a half away I told him it would be that time plus like 45 minutes I told me to be two hours I’d be home and it was literally 20 minutes. They just got our our equipment to the impound yard so it was only 20 minutes they had to wait if they would’ve been a little more patient we could’ve resolved this a whole different way, but instead it was on demand only.

  Good monring....I have not received any notification that they have responded. Our lawyer has also sent them a letter to try to settle out of court but we have not had a response from that as well. Our next step will be going to court. We ask that you please do not close this case. As i pray this does not happen to another family. This has really finacially hurt us right before Christmas.

  We got a quote/estimate from this company for a 40x40 slab. We paid a deposit and the rest was due when the job was finished. The company then reached out and said they did not have the money to pay for material, that we need to come up with the rest of the money before the job was finished. We agreed thinking it would all be done and finished nicely. Was not the case. They mis-measured the concrete, we had to come up with more money than we planned, then was insulted to another level, via text message. We finally got the rest of the concrete poured, they left all the chunks of concrete after telling us they would be back to get it and never showed up. We had a inspection done a few weeks later, the concrete was not squared for the building we was putting on it, we reached out to the company to see if they would be willing to fix it, they agreed after we sent to measurements showing the mistake they made, but then never showed up to fix it on the days stated. We had a deadline to meet and our job was not a priority to them even though it was their mistake that put us in this situation. When we asked about them showing up we was told we was about to "piss him off" because we was trying to get a time so we could be present when they showed up. We then told them to forget it, after being put off so many times with only days away from our deadline. We let them know we would be turning them into the BBB, State attorney office and getting a attorney for we have paid out $9,718 for a job that has been left unfinished. Also, wanted to mention the lines they cut into our concrete are not straight, the plumbing pipes are not straight, and we already have hairline cracks in the concrete. This company has no integrity in their work, at this point the way they talked to us/work they have done so far, we do not want them to finish the job and mess anything else up that they have already done. We just want the money back to pay to fix all the mistakes.

  Hi, yes I’m trying to get you copies of the text message that the homeowner sent to me about not wanting us to be back on their property and that they said they had they called us right before this and said they still had three weeks until the shed was to be put on the property we told them no problem we would get to it they only gave us two days to even try to give them a response or an answer to get back out there And then was on our phone cussing and calling us and telling us that we’re not sticking up for our in the deal because we weren’t just jumping right to what they asked for at the moment there was never an inspector out there and if it was the right, nothing to do with the slab it had to do with the shed they didn’t have any of it inspected. They said they didn’t have to, but that’s on them not me  And they just they’re trying to get money back for something that was not all my fault there her husband the homeowners husband came home and wanted us to move it after we already had his for the first time so we done so and then he’s everything was fine. They didn’t contact her after it was done. They paid the money. We did not get any money before it was completed. Everything was completed the day that we got the rest of the money is the day we completed the job  That’s how I do with everyone of my clients no problem and it as well. She did not put on there that for the extra concrete I paid for that the $1500 I paid for that not them so that’s where she didn’t put on there that week we did pay for it. We did try to work with them. We did try to  do everything we could but we just cannot make them happy no matter what we done we did not tell them that we would be back to get the crumbles of concrete and haul it off because that’s an extra charge and they told us they didn’t wanna pay any more money so that’s why that was left there as well . As for the one crickets talk at line OK you know things happen we still could have dealt with, but yeah, did you have to be able to give someone time of day to be able to do it? And we spoke with him on numerous occasions you know like I said we’ve worked at them hand-in-hand trying to get them happy but you cannot make the Mrs happy at all. She’s just very I don’t know she’s she’s all about being right inside about being right or wrong you know we try to get them to do recesses in the door as they called us back on that that that that that was our fault that it was in the plans the plans they gave us was not the right, but it was the right plans, but they want us to do things that weren’t on the plan. The pipe has nothing to do with us. We didn’t put pipe in there they put the pipe in there, we did not mean to do the pipe that’s her bathroom I guess but again it was never inspected and they said it doesn’t have to be cell. That’s rude to give a call and I have any questions. Please give me a call at ********* Geo if you need any proof of the text messages, I can get that to you as well. I just really would like this dealt with it off my page because what they’re saying is not all true facts are only telling their part which, of course makes  them look good they will send the ones that are cussing me and everything else in the text messages, but I’m gonna try and get them for you to our office. I will and in a text message they clearly stated it and and then they review at the Bug. They even stated that they did not want us back on the property per we are going to mess things up well we can’t fix things if they don’t let us back on the property and so it’s kind a hard for us to go down and do something when they’re telling us not to come or not to be on their property there they’re very undersizes they don’t let us know what’s going on for real they just say things that are on the top of their head that they’re mad at the moment  I understand they put out money for a sled that is fine that we still could help her, so can you get it straight to them and we told them the one corner yes it was a little bit off. I asked him to give them measurements they did we told them we would be there to do it but for two days straight whereas we were still busy on the other job that I could not just stop and leave because how professional would that be if I just stopped and left another client in the middle of doing your job because this plant says  that they had to have it done right then but that’s not what they told us. They told us at three weeks which are OK when we get there and get it all done before the Chi got there. They didn’t want to have patience with us to be able to get there, so it ended up in this result  again if we paid for the concrete, the extra concrete we are you paid for because I paid for that it’s just not fair not putting out the whole fax so as for a refund no I’m not doing a refi as for me no fixing it. I told him I would fix it, but they told us not to come back on the property so there will be no refund there will be no you know anything at this moment because they said they don’t want us back on the property and I’m not getting a refund when I put money out my own towels on the concrete and everything else to fix but anything had happened  so I’m sorry that you feel this way and I’m sorry that they feel this way. I’m sorry that they couldn’t be patient and that’s where his complex let me to fix and ask for that if I buy it that’s not on us again that’s a nurse, the line of concrete duck that he  can fix as well but they didn’t want to have patience so maybe in the future the line to have a little more patience and I’ll get more stuff done and get more bees with  honey then you do with vinegar  but lesson learned  not to trust that everybody will tell the truth or stand by there work we tried and was never give the chance to get down there as it is  hour and half to 2 hour drive one way that’s why it was hard to be able to give them the a time that soon and we even told the we would fix the doors that we done right  and we showed them they were also telling us we did them wrong but the blueprints showed them we was right so again sorry there not happy but we feel do not owe them no refund we paid for the extra concrete and did things exactly as we were told.sorry they feel we didn’t do are part .   i am going rto put this out here for the who world to see i not only have text messages but i have people that was around me  when things was said and done i have all the same things you have and more  . 1. your husband id the one that told us yall didnt need a permit and if he wil tell the truth he will tell you i even asked him to call and make sure that was right because we have done lots of sheds and i mean lots and everyone we have done has had to have a inspection before the concrete was poured  but not you all. so here is too you just repeating your self over and over i am not going to keep this up and  have a 4.5 review rate and repeat clints that are very happy and we never said we wouldn't fix the out of square mind you 6inc 3 each way  is not a huge deal and its a easy fix but i am gonna use your words trying to get through to a person standing with there back to a brick wall is  not something i have time to do we tried to fix it. even now you still have like 2  weeks left your making it sound good to whomever is reading this but as for us knowing the truth and living it its not the way you are trying to make it out to be so with everything we have said and everything we tried to do your just telling lies  and stitching the truth to get your money back when in all realistic . i have my paper work and the people  i need to show i had to do extra  foot work to even get the right me door sizes and where they where going to go and then u everything putting that mess up on us will that did work you just keep coming up with more things will this is the end for us we tried to do the right thing and now i have answered you back on my bbb page where everyone can see that i am trying and you just dont stop so i am going to be the one to stop it i am sorry ur not happy the moring you called up to the concrete plant was the last day we worked for you we finished  up the job and as you say yes i told you we didnt have the money to cover yuour concrete bill was cuz i gave u a invoice for u to pay half and them when done pay the other half and when i told you we was gonna be done that day you were in a mood and was acting like you wasn't going to finish paying us so no uyou dint pay us befor the job was over you pay us befor the jobe was done and you seaid it ur shelf up in top of ur stament that you paied for the concrete thats what we needed to get finish. you also told me you were sorry for the way u asked and told me its just a stressfull time do to yall not having the money do to your husbands truck being broke down and a new baby so i understand buy next time just addmit when you dont have it dont start all this trying to hurt someone else just to get you money back thats not away to get on in life on ya one last thing logan told me that the resaon yall didn't need an inspection was because its agriculture land  so thats just one other thing as to why you never showed us a permit cuz you didnt have one ...... i will not be writinmg back anymore u have my number if you need to contact me thanks and sorry your not happy  now but when you payied me in full we were done that day ..and grown up not so much cuz grown ups dont leaver ther best friend alone  2 hrs from home for the same thing you did not cool .

  I ATTACHED THE PERMIT!!!! What you are saying backs up absolutely nothing. Logan truck was never broke down, and having a baby has nothing to do it with it. STAY OUT OF MY PERSONAL BUSINESS LADY.  Your “company” did a crap job, didn’t finish, left a mess and that’s the bottom line. I attached you didn’t have the money to pay for the concrete. It was always something with you guys. I would be done too, but you have absolutely nothing but crap to say back that stands for nothing. No evidence to back anything up and even the concrete company can agree how crazy you are claiming they “shorted” y’all on concrete. No your “30 years” experience didn’t know how to measure. You’ll see the end result of this one way or another!!!
