On 03/03/2022 I placed a down payment of $750.00 on a moped from Wild Hogs Scooters & Motorsports LLC that originally cost $1499.00. On 3/4/2022 I went to my financial institution to get a loan for the remainder balance of $750.00. Subsequently I had a medical issue 03/05/2022 in which I was hospitalized for several days appx. 5 days. When I was released I found out the moped had been delivered to my step sister ************************************* at the address *************. DeLand, FL *****. ****** ******* informed me while I was still in the hospital that the moped was delivered to her. She went into the office at ********* and had my down payment assessed to her account. I never gave her permission to do this. I never received my moped or the refund of my $750.00 down payment. I am writing to say Wild Hogs Scooters & Motorsports has never returned my money or provided me with my moped for transportation. I have been walking for the past 2 years trying to get this resolved I have contacted them numerous times and I've been told absolutely nothing in regards to my account. I went to the office and I called the police to make a report to show this was a valid situation however the manager asked me to leave the property.

The customer alleges that a down payment was paid for an item at a licensed location of our business in 2022. The customer has refused to provide any sort of bill of sale or receipt from that location stating a deposit was paid or that she purchased something, and there is zero record of her in that locations computer system or credit card system. We attempted to figure out what we could on this matter, but have found zero records or paper trail to corroborate the customers claim. Furthermore the licensed location closed down at the end of 2022, and we advised the customer that if there is a legal issue it needs to be taken up with the licensee as Wild Hogs Scooters & Motorsports did not have involvement in the day to day operations of that location.

The customer refused to listen to this advice and instead resorted to berating and cursing at multiple different of our employees, even while we were trying to assist her. She and her husband reportedly called us all thieves and said we should all be in jail (and still has not provided a receipt or anything to prove so) while customers were in store. The customer herself called the police, who advised her to proceed to small claims court against the licensee and asked her to leave the property after observing her disruptiveness.

We did try to look into this matter for the customer, but they cannot provide a record of anything at all from our formerly licensed location. We have also looked in her name and her sisters name. At this time we advise going after the licensee for further restitution.

On 3/8/2023 I bought a Jonway Solana 49cc scooter. I had the scooter delivered that evening to my home by a Wild Hog employee from Lake Mary FL. When the delivery was made the employee has a very hard time starting the scooter, took about 5 min to finally start. On 3/9/2023 I also tried to start it and it took over 20 min to get the scooter started. I was able to ride it around the block a couple times. I went to crank it again on Saturday 3/11/2023 and worked to get it cranked for 10 min to no avail. I then tried to crank i ton Sunday 3/12/2023 and again tried to crank it for 10 min to no avail. The scooter is defective and should have been fully operational prior to delivery, mentioning again the Wild Hog employee who delivered it had a very hard time cranking it, which shows me the scooter was not serviced prior to delivery. I want a full refund of this defective product.

The owner of this scooter has been spoken with a few times. He has alleged multiple times that the scooter did not run when it was dropped off, but we have video footage and a statement from the delivery driver that the scooter was dropped off and the owner started up the scooter and test rode it before the delivery driver left. Around approximately 10 days later the customer called our location and stated that the scooter does not run and has not run since he got it, to which we mentioned that we have record that it was running when dropped off. In accordance to the warranty policy he signed he is responsible for arranging transportation back to our store for the scooter if it is not ridable, and then we will take care of any necessary warranty repairs from there. The customer refused to accept what he signed, and said he would then commit fraud by requesting a chargeback on his credit card while still being in possession of the scooter, which he refuses to bring by for us to even see if there is anything wrong with it.

The owner has been offered a solution in accordance to the paperwork he signed and agreed to at purchase, and has refused what he has been offered.

      Complaint: ********

I am rejecting this response because:

As stated in my original complaint it took the delivery driver over 5 min of continually trying to start the scooter before it started at around 6:45pm March 8, 2023. He said since the scooter was new it takes time for it to crank.  I did ride the scooter after it was started however it was late at night, after 6:50pm and was dark outside therefore I rode it down the street and back a couple of times before I put it in the garage for the night.

I was unable to ride it again until Friday evening due to work, again it was extremely hard to start,  I had to leave it and come back and try over a 2 hour period.  Finally it started and I again rode it around the block and back.  I worked on Saturday and did not have time to try to crank it again.  I tried to crank it again on Sunday, March 12, 2023 and it would not start after 30 min of trying.  I did not want to run the battery down so I stopped trying.  The shop is closed on Sunday so I could not contact the them.  I phoned them Monday  March 13, 2023 at 10:15 am and told them of my troubles and that the bike was defective and I didn't want it.

Wild Hogs is a lie when they state I didn't contact them until 10 days later.  The scooter was purchased on March 8, 2023 and the BBB complaint was filed on March 13, 2023, a direct conflict of Wild Hogs stating it took approx. 10 days to contact them. Sunday March 12, 2023 does not count since they were not open. This lie shows the type of business they are and how they regard their customers.

This scooter was not serviced before it was delivered and I have proof of that.  The scooter has been sitting in my garage since the filing of this complaint on March 13, 2023 covered up.  The bike is in pristine condition cosmetically but will not crank or run.  I have also disputed this charge with my bank card and expect Wild Hogs to come pick up the scooter for a full refund.

      Sincerely,

      ******* *******
