On October 11, 2023, I was having some furniture delivered from Tampa Bay Furniture and Mattress, ********************************************** at approximately 11:15 a.m. The furniture was delivered dirty as ***** had removed the plastic off the furniture and was not wearing gloves before entering my home. I then called the Manager, ***************************** of the furniture store named Tampa Bay Furniture and Mattress located at **************************************. The furniture was purchased and paid by cash in full for the amount of $999 on September 23, 2023. . Both myself and ***** spoke with *******. ***** was instructed to forward pics to ******* and after she spoked with ***** she called me back. While on the phone and on speaker, she instructed ***** to bring the loveseat back to the warehouse. ******* informed me that they had no other loveseat available but she could offer me the display one they had in the furniture store which I accepted. ******* said she would call me back but instead she has her boss call me. ****** started his conversation by saying that these situations can happened. I assured him that I understood. I explained to ****** that I had spoken with ******* and the arrangements she made with me. ******* response was no thats not going to happened. I am not going to deliver any other furniture to your home and neither are you going to get any refunds back.I would greatly appreciate it if your agency can help me resolve this problem with this business establishment.Regards,******************************* ************Business response

We delivered *************************************************** power sofa and loveseat as we agreed when purchased and nothing was wrong with the set. We are willing to refund $800 which is the difference after delivery and restocking fees.Customer response

I am rejecting this response because:I paid $999 to purchase a love seat, a couch and $100 for delivery. Total owed me us $999.
The furniture, the loveseat arrived dirty and the couch was never brought into my home.
It is the companies responsibility to deliver clean furniture to any paid customer. It is not the responsibility of the customer to be charged $199 for delivery of dirty furniture and for not accepting dirty furniture that their manager Chrusta Thistle instructed their delivery person to bring back to the warehouse. The store is located 10 minutes from my residence.
I want a full refund of $999. or I will be taken them to Small Claims Court. If they refuse to oay me back my monies in ****, I will br asking the judge to have them reimburse me all legal and court filing expenses.
Please note, a certified letter was sent, delivered and signed by the store manager ***************************** on 10/25/23. That package included pictures of their dirty furniture. ******* also requested photos to be sent directly to her from ***** who was one of their delivery man who refused to put on gloves that I offered and took the plastic off the furniture before bringing the furniture inside my home. While I was on the phone with *******, she informed me of the pictures she received from *****. I had her on speaker phone and she instructed ***** to return the dirty furniture to the warehouse. ******* then made a comment stating that I barely paid anything for the furniture. She then offered me the loveseat display model in their showroom. She said she would call me back but she did not call me back. Instead owner ******************************* came on the phone very adamantly and rudely said no, you are not getting any other furniture or and of your refunds back. Three times he repeated himself during my conversation with this very unprofessional person.
I just trued attaching the dirty pics and fir some reason your system is not allowing me to attach pics.
Perhaps you could send a different email where I can send the pics.
