      Back in March of 2022 I was looking at buying a mobile home in a Umatilla park. I talked to Bob and he said nothing was available so I gave him my card and asked him to call me back (he never did) when something became available. I went back in June and there were several homes for sale. I put a deposit of $4,000. on the one I liked to lower the price at the day of closing. My realtor was with me with I signed the contract and Bob said I wouldn't need to have an inspection because there had been 2 and they both passed. Everytime I went over to see the house I would find more and more problems. So I contacted SunBelt asking for a refund and I was told by the office manager that my 10 days had expired and I couldn't get my money back. I asked that the owner call me so I could talk to him and he wouldn't call me. I also continued to call and I couldn't get anyone to listen to me. The first inspection was done by SunBelts own inspector so of course there was nothing wrong. The second inspection was not passed. I feel that this company lied to me and and I am due my refund. I would NEVER recommend SunBelt.

      This situation took place over a year ago.  **** ****** canceled her inspection with our company.  She said our agent showed her previous inspections.  Our manager spoke to her and documented this on 5-19-2023.  Our agent would never advise that she not get one. He showed her so she could compare the inspection.  If it was not satisfactory and she had concerns why would she cancel hers?  The buyer was very difficult and bucked the system in every way she could.  She even showed up at sellers house without an agent on multiple occasions.  She was constantly wanting to adjust the contract after being at the house and seeing items that interested her or would changed.   This was after she had signed an "as is contract".    As far as the owner not calling her back,  I absolutely did, she went through the entire staff, when she did not get her way.  The home was off the market for nearly a month and the seller did not want to return the deposit. The decision to return the deposit is strictly up to the seller, not SunBelt Home Sales.  This again was after she had signed a contract with SunBelt Home Sales.  On the contract number 2. states default by buyer, the deposits are forfeited.

      I reject the response from this person as it is untrue and feel this person may even be confused, as this did happen over a year ago.  We never gave her the key.  The office manager, myself or the agent.  She may be referring to the park manager who doesn't work for  SunBelt Home Sales.  I am not sure I understand the friendship click that is going around at that park.  You stated that you had a realtor with you when you signed the purchase agreement.  The realtor would have advised to get an inspection.  Getting your own inspection would have given the chance to compare with the past inspections and would have been best. You called and cancelled the WDO  inspection with our office manager, said you didn't need it on May 19th, 2022.  We sent closing and wire instructions to you and didn't hear from you until May 25th, 2022 that you were backing out of the deal.  Unfortunately management of SunBelt Home Sales was not there.  We rely on the contract.  We have the buyer, seller and agent sign so we know what is included and agreed upon.

      I am rejecting this response because: This man is lying through his teeth. I have a witness that was with me when the agent said there were 2 good inspections and he suggested that I don't need a third one. And yes, there were many, many things wrong with this mobile. It would not have passed inspection due to many problems. Again, David NEVER called me. I can't stand all this lying. There are other people in the park that are not happy with SunBelt. We are considering a joint lawsuit with this company and we all have proof. I just want my $4,000. deposit back. 

      And why in the world does he care if I went to the house without an Agent. Buying a mobile home is like buying a car, I can look at it all I want to. Also your agents are not REAL ESTATE AGENTS. I was a REALTOR and had to go to school and pass a tough course, these folks don't know all the laws.

      We had signed a contract that mentioned nothing about titles being held as collateral and wanted to fire said agent and sunbelt home. they held our titles to our home for ransom asking us to pay 1000.00 to have them returned. In the first place I was not ever required to give title. Agent never brought one person to show home in fourteen days won't release listing. Asked us to sell to a man who had no funds to buy and remove listing for 30 days. Costing us lot rent and promising to sell home for 59999;99 her first visit then dropped price 10000.00 and conveniently her commission goes up 2 percent for anything under 50000.00. We were lied to about people seeing home and not liking outside and showings because several clients called us directly and said she said she couldn't get ahold of us to show home. Comps say that a 1052 square foot sold in area for 59999.99. At 1082 square feet but ours was only worth 30 a square foot and that a HVAC unit was to blame. We have the HVAC and made a 2000 concession for repair by dropping price 10000.00? No. She lied to us on several occasions and refused any and all communications. We will also file a state comparint with the dealers license next

We told her we could do that if we follow the legal contract she has signed and agreed with. We have brought her a full offer contract and deposit to sell her home and she didn't want to agree to the offer. She then stated comments about the agent which are not true. Her home has been shown and people are just not interested in it due to appearance. She did agree to pay the fee owed to Sunbelt for canceling the contract on Friday 10-14-2022 both verbal and email. I am not sure what has changed since then. I have attached a contract, emails and some very disturbing text messages, we have received from said client. She appears that she is unstable and possibly under the influence of something. She is very back and forth with this issue and we have not reached out to provoke any change in the situation. We have done nothing wrong in this situation. We may be reaching out to the authorities and reporting this as terrorism and damage of property. She should not be able to bad mouth a company for holding to a contract she signed because she changed her mind. She honestly owes us full commission, fees and possibly legal fees if we go the next step to settle this issue. Thank you for your time. I had already dealt with that client who was unable to secure funding. In two weeks no one not one client was brought to see home. I never called them and threatened. Then you accuse me off being under the influence which would then make my contract null and void anyway. I simply asked for my home to be released from listing and you can see that's not my phone number. On the documents provided. I have only ever spoke through email to have listing removed. The buyer agreed to offer full price but we were not able to communicate with her for the counter offer. She did not want to work with this buyer. Again nobody told her she HAD to take the offer. The issue we have is that she has a contract with us and did not follow through. I explained to her she could cancel the contract, we would need to follow the procedure to end the contract. She agreed in an email as well as a phone call, she would be at the office to pay fees owed on 10-21-2022 because she went over the contract with me on the phone so she knew what the fees and terms were. She signed and agreed to the contract. We at no point in time asked for her titles, she insisted the agent take them as well as signed them. Our office policy states the titles are presented at closing we do not request them. We also didn't refuse any request from her to pick them up, we only received threats. Again we cant make people interested in a home. There was no interest out there for the home to be shown often. Our agent did show the home a few times but did not get any offers. The text and pictures came from her son, who at this point had nothing to do with this, she apparently got him involved. I do not know if she or her son damaged the sign, which is property of Sunbelt Home Sales. This complaint is not valid, she got upset she owed money and was looking for a way out. That is the reason she transferred the title into the name of someone else. She did this in the time we addressed the contract and the day she filed this complaint. Doing what she could to avoid us and sending an email saying she would be in with a check, the email alone shows she is aware of what is owed and she knew she was responsible for the fees. She was trying to buy herself time. We have a legal contract with her as we have already submitted. The outrage and threats were not needed. We are just following procedure for the situation. This is a good example as to why we have these contracts. It was signed by all parties in agreement to the terms. The contract states what she is responsible for. I do not understand the complaint? Again is it because she owes money? She agreed to and signed the contract, or is it backlash because the owner of the company simply stated we will move forward with legal.       On Mar, 24th 2022 Emily Smith from Sunbelt Home Sales Inc., listed my home ******************** for sale and had a buyer the same day, The listing agreement was drawn up at a price of $57,900 and we were to close on May 15, 2022. But we have a big problem. Going back to Nov 2021, I sent in checks for my 2022 trailer tags and they were returned to me in Jan 2022 saying my house had already been sold! I immediately notified Emily and she said she would look into it. It is now mid July and we still have not closed. The titles were sent to DMV evidently "miss-matched" by Sunbelt.. When Emily accepted my listing she was aware of this mix-match of the titles and had told me on numerous occasions that, 1) it won't be long 2) we're working on it 3) couple of more days... I contacted her or her office manager Sherry at least twice a week requesting updates.. When I told Emily how unhappy the buyer and I were because of this delay, The buyer packed his house on May 15th and it's still packed and they are waiting to move in. The husband tells me his wife is ready to divorce him if this goes on much longer. When Emily told me she had finally SOLVED the problem, I started looking for an apartment and found one and moved there in early May. I cut the electric, phone and moved into the apartment. When Emily admitted to me that it was not fixed, I had to cut the power back on at the house I sold and I have been paying $340 lot rent per month and $25 a week to cut the grass, for the house I sold.... . Emily charges 10% commission. I don't believe she earned it in that from Jan to July she has been unable to fix the title problem. It gets worse. Emily sold my house at $57,900 and the buyer is financing the home. The bank that is financing the home say they had it appraised at only $51,000 which means the buyer has to come up with more cash down which he does not have which means I have to cut my price so he can qualify., Sunbelt should cut their $5700 commission by $2950.00

      My friend and I visited Florida to purchase a mobile home in a 55+ park, in the beginning of April 2022, we are from out of State so it became obvious that mobile homes were being sold as fast as they were listed. We contacted Tracy F****** from Sunbelt Mobile Home Resales. During our very brief visit, we were unable to connect, but we did give her our ideas of what we were looking, a vintage mobile home that had not been too ***********. When we were leaving Florida, she sent me some photos of a home that was just being listed, it seemed fine for us.......I contacted her from Wisconsin on April 19 via email and said we were interested in a property at ************************************.....Price $27500.00, I was concerned because I can only see the google maps and the location is not accurate. She assured me the property was on the street. So we went ahead with the deal, the same day I receive an email which I have attached voice to text, where she is telling me , I must act fast, because she already has a back up offer in hand, so offer was received and accepted April 19, meanwhile I am still looking at the photos she sent me, I see a white elephant on the left side.......I asked her to explain what that was, and she said she will send me a video of the house next door.......I told her with draw the offer, the house installed next door is literally over taking this original cool house. Meanwhile she said, fine I will lose the entire $2500 I gave as a down payment. She spent no time on this, other than to email an offer , gave to seller to sign. I have attached the voice to email conversation......and since I was in Florida 2 days ago, I was able to see the property in person as was able to photograph the set up of the house next door that literally towers over this original neighbor.

First, it is not up to Sunbelt Homes whether we keep a deposit or not. That decision is purely the sellers decision. It is not our home and we don't make the decisions for it. The seller made this decision but we support it and here is why: 1. The buyer was being gluttonous and wanted to block other people from getting the home. 2. The buyer and seller went into a legal and binding contract that states what happens to the deposit if the buyer changes their mind which is what happened. 3.The Home was taken off the market and had to be processed over again and reversed. This hurts the marketing of a home. 4. Her misconceptions of the work the agent and my company did are insulting. We are very busy trying to help everyone. My agent drove to the house twice to Face time the buyer, had to prepare contracts, had to meet with the seller, and our closing agent . Our office had to do double work in taking it off and putting it back on the market. We also provided a text saying Consumer Response /* (3000, 9, 2022/05/13) */ (The consumer indicated he/she DID NOT accept the response from the business.) Gluttonous would not be a word, I would use to describe the transaction, when I received the message that before my offer was written, the agent has a back up in the works, I sent an email ( attached ) explaining my concerns, with a follow up phone call, which was not accepted by agent on Monday, she said she could not remember what was next door, and would go over to house and facetime me with the set up, I do not do facetime, so she sent me a 12 second video, showing the space between both and another video showing all the surrounding flat roofed vintage homes that are similar. So the $$ is lost, but buyer beware of photos that use wide angle lenses. and google maps showing inaccurate locations when looking on line. The buyer then continued to shop for another home throughout that week and ended up purchasing another one in the community prior to withdrawing from our contract. Please don't be unwise, compulsive and indecisive and expect there be no consequences for your actions. SunBelt is not here to keep peoples small deposits. We are here to make sales. Yes, we did purchase another property, their earnest $$ was $100 compared to $2500 that required wiring.
