      I singled a contract with Wiseman Pools in Oct 2020. On Jan 29, they told me they could not begin for 6-8 weeks. As I was having some other remodeling done, my general contractor spoke with my pool project manager and they agreed this time frame would work for both. The sod was removed early May then wait. 811 was contacted about utilities and missed the main electric line. Wiseman's was sent a picture but did not catch this oversight. It took ME until after the 4th of July to pay the county engineer and electric company to get the line moved. This would have been done months earlier if I had known this was a problem. From this point, Wiseman's has come whenever they choose to show up. I am sent texts that "someone" will be at my house the next day, or the end of the week or even the next week, but that NEVER happens. When they need a payment, they come and do some part of the construction that requires me to pay them, per the contract. I have reached out to the owner, Shawn W******, on many occasions. If he answers, it is in a demeaning way, acting like I am the only one with these concerns. I know this is not true having talked with other unhappy customers. On Sept 25, he told me if I "tried to file a lawsuit against them, we can go ahead and stop everything and get attorneys involved". I was finally told on Monday that they would be here tues or definitely Wed to form the concrete. This is thurs afternoon and no show-again. I don't know where to turn. I don't know what to do. I'm a widow and feel like I am being taken advantage of. My completion dates were given to me many times in 2021. It is now 2022 and I have an ugly, unsafe and overgrown mess in my backyard ( which is also a corner lot). I have paid a total amount of $44,550. Thank you for any help you can give me.

      Business Response /* (1000, 5, 2022/01/17) */ Contact Name and Title: Shawn W****** President Contact Phone: 3524313766 Contact Email: [email protected] I personally spoke with and emailed Mrs. **** multiple times explaining the extreme delays our entire industy has been having due to shortages in both materials and labor and delays due to the increase demand for pools which has in turn overly stressed an already short workforce. I have gone over this with her in depth as well as my office manager, Construction supervisor and Salesman have also spoke with her about this. No matter what we tell her she doesn't want to hear it and demands that something be done to complete her pool. She is in a social media group that has posted many derogatory and half truthful comments about us and emailed threatening to get an attorney involved. I also contacted my attorney regarding this and Mrs. ****, along with the others, were sent an email demanding to cease and desist the commentary on social media or we can stop all construction and file a law suit. This came only after she made the comment of getting an attorney involved. She even had her son that doesn't live here post a derogatory comment on our google review. This is just her next stop to make another complaint about the timeline and schedule which is something that we have been constantly telling her about and explaining what has been happening to the industry. Per her admission, we could not even think about starting or even scheduling her pool until her contractor completed the addition on her house which is directly adjacent to where her pool is going. We requested the locates in Februrary, properly as we always do and they came back with no conflict. The field super went to check them and there were no flags or painted lines in our pool area so that confirmed the locates. When the concern came up again about the locates due to the proximity of the power meter at the house we called them in a second time the end of May and at that time the power line was marked and it was in the way of the pool. It is always the responsibility of the homeowner to remove or relocate utility lines and this is addressed with the homeowner. The utility line was relocated the end of June and we made sure to fit her job in ASAP. We started the beginning of July, passed inspection and then the pool shell was shot by the beginning of August. Her pool has been tiled, plumbed and graded and the deck crew is actually at her house this very morning! We have been communicating with Mrs **** the entire time and have explained to her countless times that there are delays and shortages in or industry that we can't control but she refuses to acknowledge this. She continues to say that she is a widow and we are trying to take advantage of her which is a flat out lie and absurd! We have explained to her multiple times that it does us absolutely no good to drag out building her pool longer than we need to. We do not get paid unless a phase of construction has been completed per her contract with us. It only costs the company more money the longer it drags out. We have never given Mrs. **** any completion dates however we have given her time frames when the next phase of construction may start and yes those do change due to subcontractors and their workloads and we have had multiple subcontractors out due to testing positive with Covid and or exposures. It would make us more than happy to get Mrs. ****'s pool completed as soon as possible and we are doing what we can to make that happen. Once her deck is completed she will have another wait for her screen enclosure as well. We have also reached out to other screen contractors that have worked for us in the past and they are either not taking any addition work or they are 4 to 6 months out for screen enclosures. Unfortunately this is what the entire construction industry faces as a whole right now but no one seems to want to believe it. Mr. W****** responded to you with several things that are simply not the truth. I cannot let that go. I do not have a "social media group". I have Friends who have become my FL family. Whatever they, or my son (who is a teacher in Ohio), need my permission or encouragement to post ANYTHING on social media!! Mr. W****** told you he contacted his lawyer who sent us all cease and desist notices. This never happened! Wow! He also told you that I told him that I had spoken to a lawyer. Also not true. He accused me of plotting to bring a class action lawsuit against his company. Never did I ever speak a word to him in this regard. Early on, I requested a meeting with Mr. W****** so we could discuss my project. He ignored my request. He is trying to make excuses for the poor work ethic of his company. I just think people need to know before committing to such an expensive project. I have copies of all of our emails to prove the things I said above, if they are needed. Mrs. **** has got together with three or four others to bash me and my company on NEXTDOOR, a social media site. I was also called by one of my current customers stating that Mrs. **** approached him, came to his house, and told him that she had a list of all of my permits in the villages and is going to ask my customers to participate in a class action lawsuit against Wiseman Pools. I also have this in writing in the form of an email from the customer that she approached. I also have copies of all communications from and to you including all of the text messages. I have personally sent you two emails that I asked you to respond to but you never did. As I have stated numerous times before, we are doing all we can to complete your pool as quickly as we can but there will be delays in construction due to the industry wide delays. These delays are real and not made up, whether you want to believe that or not. Once your deck is poured there will be a 6 to 8 week delay waiting for your screen enclosure, just so we are all clear. Trust me, everyone wants you done as soon as possible, do you seriously think we want to drag your job out even longer? This process hasn't been enjoyable for anyone.
