Email was sent to business and failed to receive a response: My name is ******* *******. I am the wife of ****** *******, who had his vehicle transported today and dropped off by your company. Upon the pickup of the vehicle, we noticed a large slash in the front passenger **** tire (see photos attached). This was discovered approximately one hour after pickup as the tire emitted a slow leak. The vehicle was sold to us with brand new tires. It was also professionally inspected (see attached inspection, which clearly states on page 5, "no issues on any of the tires"). We had the tire immediately inspected by a professional, who concluded the tire slashing resulted through the incorrect tie-down of the vehicle and several day transport of this tie-down pressure against the tire. As an attorney, it costs my partner and I nothing to file a claim against Big Red Auto Transport Corp (US DOT *******************) with the FMCSA and US DOT for incompetent carriage. Furthermore, a small claims filing as well would cost us nothing. Thus, I kindly ask for reimbursement of $350 for the tire replacement, time wasted, alongside the mechanic's opinion we had to obtain today. Business Response /* (1000, 7, 2022/03/18) */ Hello, We have check on this claim and vehicle was delivered in the same conditions that it was loaded, your husband made a detailed inspection with our driver upon delivery when he received the vehicle and he signed in or BOL ( inspection sheet ) as no issues found on the vehicle. Like you said after an hour of driving the vehicle you noticed that vehicle had something on one of the tires which unfortunately we ca not take responsibility for that. We understand that you or your husband bought this vehicle online and probably is not what you were expecting but you can't blame us just because we were the wants who deliver the vehicle to you. The tire wall had damage from it being improperly strapped on the transport vehicle. The truck was inspected less than 24 hours before pick up by the auto transport company - with photo proof of the tires having no damages. The flat tire from the tire slash damages that occurred during transport are visible in the photos the driver took but this company still refuses to acknowledge it. This could've have been resolved amicably and was not a expensive fix. It is the principal of the matter that is at hand here. The tire was improperly strapped and the tire wall was slashed, it is impossible to slash a tire wall driving a vehicle. I contacted the company less than 30 minutes after delivery to tell him of the damages and refused to take responsibility and sent me a photo the driver took at that shows the tire flat from being slashed, it was ultimate slap in the face for him to be able to see the damages but gaslight me into believing that I somehow slashed the tirewall myself. Like we already said vehicle was properly inspected for the receiver and driver at delivery and there was not noted any tire wall damage. I have filed a lawsuit and a police report against the business owner, they have failed to acknowledge that the crack in the tire was not visible to the average user unless the car was driven. He has a court date where we are seeking several thousands in damages (plus a pending criminal complaint) - or he can simply refund the amount. They have every right to file lawsuit and a police report or or whatever they think is right but our position remains firm, we are not taking the responsibility for this claim for the reasons we have explained before.
