$14k couch set that doesn't match. It was sold to us as a set. One was on the floor the other was to be ordered. Michael S**** is telling me there is nothing he will do for us. $1,200 restocking fee on the new one that doesn't match, and we are stuck with the first one. Specifically asked sales agent Judy before purchase if there would be any matching issues, specifically to avoid this situation. Owner Michael S**** is denying what she said. Would you pay $14k for couches that don't match? All of their showrooms matching couches matched. This is not representative of what their showroom matched couches look like. $13,416 paid in two parts. $9416 for the first couch and the deposit for the second couch were paid on 2-18-22. Second payment of $4,000 was paid about 8-19-22.Business response

Business Response /* (1000, 5, 2022/08/23) */ On February 19, 2022 the client made a purchase of a 3 piece modular sofa as a floor sample clearance item off our showroom floor at a reduced, discounted price. Please note, the client initialed on sales order ****** confirming that it was understood the clearance piece is a floor sample and sold as is, all sales final. The client states in their written claim, "It was sold to us as a set. One was on the floor the other was to be ordered." The only way something could be sold as a "matching set" would be for the two pieces to be special ordered at the same time as new OR to come directly from our stock which was manufactured originally at the same time. It would be impossible to sell the pieces as a "matching set" when the sofa was a floor sample clearance (in stock) item and the loveseat had to be special ordered from the manufacturer as per the clients request. Slone Brothers Furniture or its representatives would not be able to make the claim (oral or written) that the pieces were being sold as a matching set when the pieces were not available at the same time. It is of reasonable expectation, if any period of time exists between the manufacturing date of two leather pieces; even of the same leather color and grade, there would be a distinct possibility that a dye lot difference could occur. Further the client accepted delivery of the 3 piece modular sofa on February 24, 2022 to their home. The special ordered 2 piece modular loveseat was then delivered later on August 20, 2022. With a 6 month lapse in time between deliveries of the pieces, this transaction could not be construed as a "matching set" without the expectation that a color variation could exist between the clearance piece and the special ordered piece. In good faith to the customer, Slone Brothers Furniture will take the special ordered, 2 piece modular loveseat delivered on August 20, 2022 back for a full refund. Furthermore, we will waive the 20% restocking fee as per our written policy (please see attached). A $149 pick- up fee will apply and the 2 piece modular loveseat must be in the same "new" conditioned as it was delivered on August 20, 20022 free of any defects and/or soilage.
