when my fiance first hired this company to dig a small swale on our property and it seemed like we would finally get what we needed done. **** requested a deposit for the job up front. almost $460 was paid. **** came, did the job without pulling a permit and outside of our property line, in his words, "bc inspectors aren't out on Saturdays". well an inspector happened to drive down our road and shut the whole job down! facing fines from the city, **** filled the swale back in and indicated he would be back to complete the job *properly* and legally, but the city will not approve the work. so now we are out $460 that **** and his business are refusing to refund (although he never indicated it was nonrefundable and it was only paid with the anticipated of a COMPLETED job). we have no swale, no work done, and no refund. poor business practice. customer should not have to take the financial loss bc your company made a mistake. definitely do not recommend to others out of fear that they could end ** in a similar situation .Business response

This response was provided verbally to BBB:
This contract was between me and the customer and had nothing to do with my business as the scope of work performed is not what my business offers. The job was shut down by the county as they required a permit for this job however a license was not required. The deposit made was non-refundable as it was to assist in covering costs associated with the job. We did not pursue the remaining balance as the job was not completed due to the interruption of the county.

I am rejecting this response because: everything you said was already stated or discussed besides the deposit being NON refundable. You indicated a deposit was required for SOD and a machine. We did not even get the **** You state the job required a permit - in which you did not pull - so the job was shut down. YOU were supposed to pull the permit which would have resulted in the permit being denied and the job never being started. Why should be have to pay a deposit for illegal work, shut down by the city, AND not even getting what our deposit was for? Please refund the deposit as it was NEVER discussed as non refundable and we did NOT receive the work the deposit is for.
