      On April 4, 2024, Watertight Roofing completed a roof replacement, leaving a large orange stain from the top of the roof to the gutters, necessitating further replacement. Improper gutter reinstallation impaired water flow, and severely damaged leaf guards were reinstalled without informing me. *****, the owner, inspected and admitted the damages exceeded minor wear, promising full corrections. On May 6th, the roofing company provided the scope of work to ve proposed offering inferior .027 gauge gutters instead of the original .032 gauge, including replacing gutters and guards on the first story and attempting to re-pitch and replace damaged guards on the second story, remove ***** and trash in my gutters left behind by his crew and full payment will not be required until completion of all repairs. On May 15, 2024, ***** threatened to place a lien on my property for unpaid balances unless his new terms were accepted by May 16. New terms offered was replacement of 1st story gutters and leaf guards only. Despite agreeing to a scope of work to rectify all issues, including replacing and realigning gutters, cleaning debris, and reinstalling the rain sensor. I requested to meet with him to discuss an agreement.On May 16, 2024, ***** visited my home, explicitly stating he decided he would not complete any of the repairs, demanded $14,000, (actual cost was $13,651) and threatened a lien if I didn't pay him that same day, which he did enforce the following morning, forcing me to pay $12,051 after a $1,600 good faith discount. This discount does not cover the damages totalling $5,732. The damage that Watertight Roofing caused to my property remains unresolved. Their actions reflect poorly on their professional standards and commitment to customers. I remain committed to finding a resolution that rectifies the damages sustained.

      When the customer came into the office to pay the amount due for the re-roof he accepted a discount of $1600 as this was the price quoted to Watertight Roofing for the necessary repairs by a licensed gutter company.  It was Watertight Roofing's understanding that those funds would go towards making any repairs that the customer felt necessary and was the amount of a reputable quote provided by a reputable company.  Not sure why the customer is now stating repairs are in excess of $5000 as clearly more work is being done than was originally pointed out.  Watertight Roofing did compensate the appropriate amount for the repairs and the customer refused to accept *******************************************'s proposal for repairs.  In lieu of repairs being made he accepted a cash discount.

      I am rejecting this response because: 

      Initially, Watertight Roofing provided a detailed "Scope of Work" which included:
      Here is the ***** OF WORK Watertight Roofing provided as their plan to resolve the issues (copied and pasted from an email from them):
      First Story:
      Replace front gutters: We will remove and replace the existing gutters in front of your house with new gutters in two lengths: 1 section of 23 feet and 1 section of 12 feet.
      Replace rear gutters: We will remove and replace the existing gutters at the rear of your house with new gutters in two lengths: 2 sections of 12 feet and 1 section of 23 feet.
      Install leaf guards: Both the front and rear new gutters will have new standard leaf guards installed.
      Connect to existing downspouts: The new gutters will be tied into your existing downspouts.
      Color of new gutters: Please note that the new gutters will be standard white and will not match the color of your existing painted gutters. You can choose to have them painted to match or keep the white color.

      Upstairs Gutters:
      Re-pitching: Our installers will attempt to adjust the existing gutters upstairs to improve water flow towards the existing downspouts.
      Leaf guard replacement: We will replace any damaged leaf guards on the upstairs gutters that are beyond repair and remove any salvageable leaf guards.

      Debris removal: We will remove any existing debris from the upstairs gutters and take pictures to document a clean installation.

      Payment:
      As agreed upon in the roofing contract, full payment will be due upon completion of all repairs.

      This plan would have adequately addressed the damages. However, when I questioned whether the new gutters would match the quality of my existing ones, *****'s demeanor changed from professional to dismissive, refusing to proceed with the promised repairs.

      ***** then presented a significantly downgraded proposal from MD *******, covering only first-story gutters and gutter guards with a lower quality product, entirely omitting the second story, which was part of the original damage assessment. ***** attempted to justify his reasoning for no longer wanting to fix the second story on the basis that no one can see that damage, so it doesn't matter. He didn't care that the gutters now hold water or that the gutter guards no longer are efficient to prevent obstacles from going into the gutters and drainage system. When I informed him that the gutters need realignment and the entire gutter guard system is unusable and that I cannot accept the diminished proposal, ***** provided me with an ultimatum: accept the reduced scope for the first story or forego any repairs.

      Despite our agreement that full payment would be deferred until after the completion of all repairs, ***** abruptly demanded immediate payment of $14,000 and threatened to place a lien on my property if the amount was not paid that same day. He executed this threat the following morning, which compelled me to settle the payment under duress. This coerced payment, accompanied by a minor $1,600 discount, in no way represents adequate compensation or my acceptance of the incomplete repairs.

      For a complete assessment based on the above scope of work, I reached out to the installers of the original gutters "Rhino Gutters", whose subsequent assessment of the damage resulted in a quote of $5,732. This quote reflects all damages detailed in the original scope and contrasts sharply with Watertight Roofing's limited and inadequate proposal.

      The customer did not accept those proposed repairs that he is mentioning in his response.  Watertight Roofing was happy to provide those proposed repairs.  The only difference was using standard gutters.  ***** was not dismissive by any means, however it was clear that the customer was never going to be happy so he offered $1600 off the total bill.  It is clear that the price obtained is for more extensive repairs.

      Approximately 19 months ago WaterTight put a new roof on my condo. As soon as it rained water started to leak into my garage wall. After months of the management company trying to get WaterTight back out they finally did and said they fixed the leak. After 5 months it started to leak again. It has now been months again and WaterTight has no-showed time after time to repair it. I have 64 pages of empty email promises.

      Business Response /* (1000, 8, 2022/08/22) */ This is not a roofing issue and we are contracted to work with his HOA and his property management company. This is a stucco issue that we offered to assist with and since it is outside our scope we are dependent on other contractors to get the work done. This has since been completed. Consumer Response /* (3000, 10, 2022/08/22) */ (The consumer indicated he/she DID NOT accept the response from the business.) It's very simple. The roof was old but not leaking. You put a new roof on and it started leaking. You cracked the stucco while installing the new roof. It's a roofing company's responsibility to fix what they break. Just because it's not "roofing" it's still WaterTight's responsibility. That is why I don't agree with WaterTight's answer. That said, Mike from WaterTight came out and took off the cracked stucco. Another crew stucco'd the area and Mike came back to replace the soffit and gutter splash but is missing a triangular piece to finish the job. He said he would be back to finish the job but that was a week ago. Consumer Response /* (2000, 13, 2022/08/25) */ WaterTight roofing came out on 8/25 and completed the repairs. I now consider this issue complete.
