      07/12/22 - I agreed to a $16000.00 bid submitted by Richard Dover, Door to Door Services (a/k/a 360 Concrete) to perform concrete/trenching services at our property located at **** ******** ***; a 50% deposit was paid to Mr. Dover the same day. 07/22/22 - I contacted Mr. Dover to ask when the project would be completed because although work had begun, the project had stalled. Mr. Dover responded the concrete would be delivered "next week". 08/02/22 - I informed Mr. Dover that the work done was incorrect as well as incomplete & did not meet city codes. I met onsite with Mr. Dover's subcontractor who had performed the work to discuss the issues with the work, but nothing was done to correct. I then met with Mr. Dover onsite to show him the issues with the project & the items that were still incomplete. He assured met that the work would be corrected and completed. Nothing further was done and the project stalled for over a month. Early Sept. - Met with Mr. Dover again onsite; the problems were pointed out & Mr. Dover agreed the job required corrections & addtional work needed to be completed. Again, nothing was done on the project. Sept 20 (AM) - Mr. Dover contacted me requesting the balance of $8000 on the project and stated if it was not paid, a lien would be put on the property. I responded that the work we had previously discussed and agreed to was still incomplete & needed to be finished. Sept 20 (PM) - I received a "Notice to Owner/Notice to Contractor" signed by McKinnie Masonry Contractors. (I assume this is a sub hired by Mr. Dover) threatening to lien my property. This project has been going on for 3 months and is still incorrect and incomplete. Mr. Dover has acknowledged the problems, but has yet to correct them. Final payment is being requested although the job is incomplete, incorrect and does not meet city codes.

      The contract states "that the scope of work was to cut out low area and install concrete trench drain system on both entrance/exit(s) for the amount of $8000 per side. $16000 total for the project. All concrete, wood, rebar, labor and equipment will be performed by A/C masonry company subcontractor of Door to Door Services. Grating will be provided by Bill **** for this project on **** ******** ***."

      A/C Masonry did install the trench drain system on both sides of the project on **** ******** *** and the project is complete and Mr. **** should pay the remaining balance. When we met Mr. **** stated that the trench drain needs to plumb to the ditch, which was not part of the contract. He also stated that we needed to repair the parking area that we did AT NO EXTRA COST and then concrete on top of growth for parking lot run off this too we did AT NO EXTRA COST which is above and beyond the contract agreement.
      As for the delays that Mr. **** is stating this was due to weather you can not safely install or due work during thunderstorms during Aug 2022 there was 18 days that had thunderstorms and in Sept 2022 there was 14 days with thunderstorms and rain. Rain would also wash out the concrete.

      No where in the contract signed by Mr. Bill **** does it state will comply and meet city codes. Even though the trench drain is working properly and channeling the rainwater to run toward the ditch.

      We are still waiting for payment from Mr. Bill ****. The job was done CORRECTLY. The trench drain is functioning properly and diverting the rainwater toward the ditch. We have pictures to prove that it is done.
      As that Mr. **** is insisting that he will not pay when work has been completed he leaves me no choice into getting a lawyer to obtain the money that is owed to me and my subcontractor AC Masonry. I have gotten a lawyer and I intend to get paid by Mr. ****.
      I do have a business license that is required to do this type of concrete work. According to 2022 Florida Statutes:
      489.1455(1). For purposes of this section, job scopes for which a local government may not require a license include, but are not limited to, painting; flooring; cabinetry; interior remodeling; driveway or tennis court installation; handyman services; decorative stone, tile, marble, granite, or terrazzo installation; plastering; stuccoing; caulking; and canvas awning and ornamental iron installation.

      I am rejecting this response because: 

      Regardless of licensing or anything else, the issue remains the same - the work is inferior and needs to be repaired or replaced before final payment will be made. We would ask that the contractor and any sub-contractors who performed work on the project meet us on site to see the issues and discuss solutions. If not, we will have our attorneys handle the matter going forward.
