I spoke with Mr. Michael Wynn to schedule an appt. and he will review all the debtor’s bankruptcy documents and give me his review on the date of the consultation. On 9/21/2022, he informed me that the debtor was currently two payments behind, and a motion of an Automatic Stay of Relief was the best option to pursue. I informed him to add that the debtor had not paid the 2020 and 2021 county property taxes and not given me proof of insurance. I signed a contract. and paid the $1,500 retainer fee. Upon receiving the document, it mentioned one payment behind and asked about the property taxes and proof of insurance that wasn’t added in motion document. He indicated after contacting the debtor’s attorney; was informed that the back taxes would be my responsibility due to the lease contract. So, a mortgage agreement would be a better option to pursue in which debtor’s attorney agreed. Will use remaining funds of $357.00 to help secure a mortgage agreement. I asked for an invoice. Upon reviewing the two invoices, I explained to him those debits look suspect and explained that my determining factor to hire him was the information given to me during the consultation that the debtor was two payments behind and to add unpaid property taxes and give proof of insurance. So,I asked for all funds to be returned. In invoice line of 9/26/22, Michael and attorney J.S. discussed various documents. However, on debtor’s payment scheduled dated 9/26/2022, a payment of $400.00 was posted to account. So therefore, on 9/26/2022, the attorneys knew or should have known that a payment posted on the debtor’s payment account. At this point, I should have been contacted and given the option to pursue motion. Also, in invoice line dated 9/29/2022, attorney J.S. started drafting motion which was after the debtor’s payment had posted on 9/26/2022. Again, the attorneys knew that only payment was received. On November 7, 2022, I received a check of $ 357.00 and not $1,500.00 I have invoices.
