      I am writing to inform you that the credit report for the business Local Finance LLC is inaccurately associated with my name. I have no contractual relationship with this business and have never engaged in any financial transactions with them. Additionally, I own my car outright and have no outstanding loans or financial obligations related to it. I request that this error be corrected promptly to reflect my true credit history.Supposedly I opened an account with them in March 2024, this place is located in a different State and I have never been to ***** let alone stepped foot in *******. I have no way of knowing how they got my information, this might be fraud or identity theft. All I am asking is for this business to fix my credit report and cease and desist any personal information they have incorporating my personal and private information.

      Dear Mr. ***************** are sorry to hear of the confusion regarding Local Finance, LLC and your credit history.  After reviewing our customer files we can find no record of an account in your name with our company.  Additionally we can find no data with any personally identifying data including your information passing from our organization to the credit bureaus.  Could you please provide some additional information such as the bureau or the report where you are seeing an account in your name with our Company?  If we can locate the source of the issue it will be our pleasure to attempt to assist you in correcting the report.   The more specific the data you can provide, such as a screen shot of the report, the better we will be able to serve you. Please do not include any sensitive information such as a social security number or drivers' license number.

      Dear Mr. ******************** you for providing us with the additional information in the screenshot attached.  You have contacted the BBB and directed your inquiry to the correct Organization, we are the Local Finance Company listed on the screenshot.  Unfortunately, we do not report credit to Transunion, so this is not a tradeline that we can actively manage, address or delete as TransUnion is the bureau reporting this information.  We do report credit files to Experian and Equifax, but not to Transunion so it is beyond my understanding how Transunion could be appending this tradeline to your report.

      As Local Finance is not a Transunion subscriber, our company is not able to delete this tradeline directly in Transunion.  That said, there is a remedy available to you as a consumer which will serve the same purpose of deleting an erroneous tradeline from your file.  You may file a dispute with Transunion directly over inaccurate data directly using the following channel:

      Download the dispute form at  files.consumerfinance.gov/f/documents/092016_ cfpb_CreditReportingDisputeLetter.docx. Mail the dispute form with your letter to: TransUnion LLC *********************** P.O. ********************* 19016.  Alternatively, you can file online or call Transunion directly at: transunion.com/personal-credit/creditdisputes-alerts-freezes.page  By phone: **************.  We are also attaching the official CFPB guide to disputes to this response for your convenience and if you would like to know more about how the process works.

      I purchased a vehicle with this company's financing. I was dealing personal issues and my insurance lapse. Once I concluded my issues, I purchased insurance and the insurance company sent over the paperwork on 12.28.23 12.29.23, I called local finance and informed them I wanted to make a payment. I was informed by the company they would not accept a payment until I undated my insurance. I informed the company rep that this was done already and I only wanted to make a payment.I was told that it was the company's policy that I needed to have valid insurance before I can make a payment. I asked ******* to point out where in my contract does that show that. He said it wasn't in the contract it was their company's policy. I told them it was against the law to refuse a payment, while I'm voluntarily trying to make a payment for the month on December 29, 2023 of $860.00. I'm at this point incurring addiction interest and late fees, which I refuse to be responsible for.I would like my payment accepted towards my signed car loan, the incurred interest and late fees removed.I've had several cars and I have never had a car loan company refuse a payment, dur to lapsed insurance.

      I purchased a vehicle and used Local Finance as the alleged lender. For the past several weeks, I have sent out various letters demanding validation of this alleged debt and have been unsuccessful. When I did my research, I further learned the **** *** ********** *** Manager was also the registered agent, named *********************y have not been professional and have deprived me of my consumer rights. I invested $60K on my ******** AMG and have requested validation of debt in which they have not sent. ***y mailed me a copy of the contract however That is not a validation of debt. I requested a full accounting of the off ledger account. *** entire contract was found to be fraudulent for non disclosure and other violations pursuant to federal laws. . ***y have defaulted by not providing proof of claims and violating my cease and desist order. I had a perfect payment history with them up until the day I put them on notice to provide proof of the alleged debt. ***y came to pick up my vehicle which is another violation on my person as this third party was not on the contract to be able to come pick up a vehicle that I did not give consent to. I responded to the notice and clearly stated , I do not give permission to these proceedings. LOCAL FINANCE LLC also did not provide me with a remedy to get my vehicle from the tow yard. ***y lied and said I needed to pay the FULL BALANCE of $69K to get my vehicle back. This company conducts fraudulent business and charge consumers with excessive fees and kept the negotiable instrument I sent them to satisfy the debt without applying it to the principle balance on the principle account. I am demanding the release of the lien on my vehicle, the title to the vehicle immediately. I intend to *** in federal courts if this matter gets overlooked.

      Attached are  the copies of the Contract and the buyers order along with the Cease and Desist  order and the request to speak to her regarding the Recovery of our vehicle the vehicle she agreed to re pay us for at the time of Financing , she paid a $20,000.00 directly to H **** ****** of ****** ,  we approved her financing the remain balance as mention in the Signed Contract . . Please find the attached money order in the amount of $1.25 ,with Ms ******** offer along with a hand written note  .  ***************** is in breach of Contract  and was explained this during her calls to Local Finance LLC ., the Pay off in full was required to redeem the vehicle by the stated date . Attached is also a payment history showing ***************** was making her payments to Local Finance LLC up until May 2023.

      I am rejecting this response because:********************** ,Beneficiary of this account DID NOT breach the contract agreement with LOCAL FINANCE.

      ***************************** had an outstanding perfect payment history on the vehicle she had entered into contract to. ***************************** gave her goof faith and credit along with $20,000.00 in federal reserve notes. *** dealership, HG **************** advised the consumer, *****************************, that LOCAL FINANCE demanded $20K in order to extend HER OWN CREDIT she had to give a downpayment of $20,000.00 which is a direct violation to the consumers rights pursuant to 15 USC ********************************************************************** connection with any extension of consumer credit unless the creditor arranges that amount in which LOCAL FINANCE has openly admitted in their response, that they did not request nor receive the $20,000.00 ***************************** put down towards her conract. *** contract is deceptive and both parties , the dealership and the finance company took advantage of consumers lack of knowledge and failed to provide full disclosure of the contract which is what led ***************************** to look into her contract deeper. Communication between LOCAL FINANCE has been has the worst and the customer service for the beneficiary of this account has been disgusting and disrespectful. ***************************** attempted to communicate her concerns with LOCAL FINANCE via postal mail and telephone. For two weeks, the attempt to speak with someone in regards to locating the vehicle and the personal property that was in ***************************** vessel. ***************************** has been waiting on ***************** to return her call after failed multiple attempts to reach him as he is the Registered Agent, *** ********** *** **** *** General Manager. He operates from different capacites as he sees fit for the company and not fullfilling its fidicuary duties to the beneficary of the account who entered this fraudulent inconsciaonble contract an was unprofessional and did not care to provide resolution to this matter which is why it has led us to contact the ************************** the BBB and other agencies to bring awareness to this situation. 

       

      A Cease and Desist order was sen out requesting proof of claims of the alleged debt. We requested validation of debt, audit trails, statement of accounts, off ledger accounting information pertaining to where the loan originated  from. *** Cease and Desist order also mentioned that they were not to attempt to tow MY VEHICLE  while the Cease and Desist order was still active. LOCAL FINANCE has failed to send the proper documents as requested by the corporation of *****************************, Upon further investigation as the attorney general ***** advised consumers to research to find deceptive practice within the violations with several South ******* dealerships, I discovered they are also in violation of 15 USC **** which states the finance charge is the sum of all charges payable directly or indirectly by the person to whom the credit is extended. 

      When the notice to sell the vehicle arrived, ***************************** sent it back stating " I DO NOT GIVE CONSENT TO THE **** OF MY VEHICLE." That is another violation to my person ***************************** pursuant to 15 USC **** f(6)(c) and they have assessed very high fees on my vehicle that has been paid for in full pursuant to 18 USC 8. LOCAL FINANCE did not give me notice of my rights to rescind the contract which is a violation to 15 USC *************************************************** credit not both , but in the contract they also saw they down payment that was collected . On the paperwork they have LOCAL FINANCE as the lien holder , when ***************************** holds all the rights, titles, interest  and securities over ***************************** and her  property.. LOCAL FINANCE has sent over documents that ***************************** did not request.

      ***************************** demanded an audit trail that should also include their accounting ledger. Per 12 USC ****, LOCAL FINANCE is in fact the borrower in this transaction and that is the reason they have failed to provide proof of validation of debt.   Pursuant to 15 USC ****- liabilities of Assignees. LOCAL FINANCE had a fiduciary obligation to ***************************** as they are handling her personal credit information as well. This contract is consumer credit contract pursuant to 16 CFR ***** and LOCAL FINANCE failed to provide full disclosure of the agreement. Collecting a down payment where no cash should have been involved is a violation of TILA.  LOCAL FINANCE is in violation of 15 USC 1611(1)- Whoever willfully and knowingly give false or inaccurate information holds criminal liability . For the violations of TILA , 15 USC **** double the finance charges and does not include cash . *** equitable relief that is required for the damages  and misleading information alleging I owe this debt in which LOCAL FINANCE has not been able to provide validation  of debt . But rather sent a copy of an agreement which  is NOT  considered a validation of debt,

      This transaction was funded by a promissory note/ instrument. *** retail installment sale contract is misleading compared to a credit sale. LOCAL FINANCE has failed to prove that a loan was given, It was reported as a loan on a consumer report however an installament sales contract is not a loan. Late payments reported are inaccurate as well as the transaction was funded by the promissory note.

      I am demanding my title free and clear, the vehicle returned to me , recoupment of the payments that were made on this fraudulent contract no later than 3 days of this notice.

      We have asked the company for audit trials and validation of debt. I am also requesting to see the copy of the 1099C they used to discharge this .

       

      We have instructed LOCAL FINANCE LLC to apply the principle balance to the principle account .

      As *****************************, came before and accepted on behalf of *****************************/ Principle all the titles, rights, interest and equity owed to *****************************/ Principle.

       

      We instructed the *** of the company to apply the principle balance to the principle  account in full and the matter was overlooked. We intend to file a claim in federal courts if he does not perform the assignment that has been given to them for equity fraud.

      On 1/3/2022, I called Local Finance to make a payment on my car loan. I was able to afford a payment of ******, I am the sole income for my house hold. My husband had a massive stroke the beginning of December 2022. So, money has been tight. I had the complete displeasure of speaking with ******** owner of the company I attempted multiple times to make a payment on my loan, saying I could afford the 126 dollars and I needed to get my account back in good standing. Not only did ******** speak to me like I was lesser than, she also had an attitude from the time she answered the phone to the time she hung up on me and told me not to call again. During our unfortunate conversation, I asked for another management or supervisor and was told she didnt have a boss and that she was not going to be dealing with this today and hung up.

      Upon answer the phone *************** was verbally abusive and talking down to me as if we  are the blame of her personal issues , I asked her what what the issue was to assist her that apparently set her off saying we are stupid  and don't know what we are talking about when said ok I am looking at her payment history she became belligerent,  I  asked her if she was paying the past due amount the account was 80 days past due at the time on the October payment she continued to say we are wrong,  when I was attempting to go over the payments with her she continued to be rude and disrespectful. I advised her I would not be talking to her and wished her a  nice day  terminating the call .
      At no time did I state I own the Company ,  she was told I am the only one she can speak to regarding her account is what she was told .
      According to the payment history and the status of the account a partial payment of $126.00 will not resolve the recurring delinquency on the account , I attempted to speak to *************** and she was not giving me the opportunity to speak . This issue is recurring with derogatory comment left on the **** feature on our application  ,  her payment history indicates  poor payments and no contact with her , failure to comply with the Contractual obligation with making her payments on time since the beginning of the loan , failure to have the required deductible for the insurance , failure to update her personal information which includes addressing the return mail we have for her .

      She did schedule a payment of the $126.00  where it did decline as well ... again she will blame us for her banking records
