      Tarsis SA , on my representation as the purchase responsable person ( ******** ******* - Purchase Manager TARSIS SA ) acquired some machinery in the amount of $139,633 with estimate number 1576 dated 01/12/2022 and paid 90% of the amount with invoices ****** and ****** (last payment) dated June 29, 2022 for machinery prove of payments with swift from 29 of June from year 2022 on the amount of $85,853.2 and swift from 09 of march year 2022 on the amount of $107,316,5 until delivery of machinery. INVOICE ****** (50%) PAID $69816.5 EQUIPMENT HAS NOT BEEN DELIVERED, PARTIAL ON TRANSIT INVOICE ****** (40%) PAID $55853.2 EQUIPMENT HAS NOT BEEN DELIVERED, PARTIAL ON TRANSIT According some emails, delivery has been delayed several times since year 2022 for some issues on factory and external conditions like covid19 delays on parts, factory issues, or other excuses, finally on March 2024 referring to order 1576 Maxpack LLC mentioned that they will be delivering a partial shipment on equipment from order 1576, EXCLUDING the capping system.According to Maxpack LLC and Tarsis SA the incomplete automatic line will receive a credit of $44,131.90 on reference to the equipment capping system.We are sincerely concern on the partial equipment because after two years from last payment issued to built the equipment from Maxpack LLC, the line is incomplete that will NOT perform the promises from sale with Maxpack LLC. We are recurring to BBB for some mediation since for two years we have not even installed the incomplete line causing unacceptable quantities or timelines due to the lack of new equipment. At the present time Maxpack Machinery LLC and their representative has NOT credit our account with the amount agreed for $44,131.90 and the reason of this complaint and mediation with BBB.       Tarsis SA on my representation as the purchase person responsable ( *******************************) acquire some machinery on the amount of $214833 with invoices 1520-3 and 1520-13 (last payment) dated march 7, 2022 for machinery including MFR 3 superfood, MXZJ-**** Rotary Infeed , Conveyors ,MCSP Servo 10, MCSP Piston , MFXZ 160B pump, MFX-6 Capping machine , MDLM A labeling machine, and some other parts . Invoice was paid 90% on full ( we have prove of payments with swift 29 June 2022 $85853,2 and swift 09 march 2022 $107316,5 ) until delivery of machinery for the last payment of 10% pending. According some emails delivery has been delayed several times for some issues on factory and external conditions, the last one was issue for December 2022, It is April ***************************************************************************** advances (reports). We are sincerely concern on equipment because of delays on schedule and silence from distributor Maxpack **** We are recurring to BBB for some assistance, and mediation since our providers, freight forward company, technicians, lender, clients, sales , etc are on waiting for those machines, also we hired an installation company, paying in advance for their services and they already have moved their schedule 3 times, furthermore our lender has been requesting reports without an answer from Maxpack *** or their sales people or managers.       A company representative has been in contact with the customer to address their concern regarding their order delay within that past 10 days. Orders are being scheduled for delivery. Orders placed during 2022 have experienced delays due to COVID-19 lockdowns and restrictions that affected normal operations due to supply chain disruptions, sourcing of components, labour shortages, transportation. Maxpack has sent customers multiple communications in this regard and regrets delays caused by COVID-19 force majeure. As it has been historically, Maxpack strives to create, maintain, and follow high-quality standards across all product and service categories. Should the customer have any follow-up questions or concerns, we encourage them to contact our representative directly.

      I am rejecting this response because:
      Maxpack LLC has not delivered final report called FAT on Maxpack MFMR-200 Rotary Doypack with Piston Filler to Pack Shampoo in Doypack Pouches with Side Spout , provider just sent a packing list ( see attached file ) , in addition to response from representative , we still waiting on final report (FAT) on our Maxpack MBL Filling & ******** machines to fill PET Bottles with various personal care products 
      FYI, Maxpack LLC rejected our Pre Purchase Shipment Inspection in lieu of their FAT final report since they mentioned our confidentiality agreement on contract . Please note a partial FAT report dated on January 2023 on our filling & labeling machines included on attachments. 
      Please ask provider delivery of FAT reports on equipment and machines require to be ready on facility for pick up, we are paying a freight company and we require documents like packing list ,COD, comercial invoices and port requirements.
