On Monday 4/29/24, I filed a formal claim due to damage to my vehicle discovered the day prior, Sunday 4/28/24 at 10:55am (I remember the exact time, as I was running late to 11am mass). Upon noticing the damage, I immediately reported it to the valet attendants so that they could note it in their records and to inquire as to whether anyone had any information on how it occurred (they did not volunteer any information). I also informed them that I was disconcerted that this was the 3rd time my car would have to be repaired due to damage incurred when valet staff were driving it in the past 6 months. After this, I went to mass and ran normal errands, returning the car at approximately 2:30pm that day, 4/29/24. After filing the formal claim the next day (4/29/24), I was immediately informed that my claim was denied and provided with a picture of my vehicle with the damage that was taken 4/29/24 at 2:30pm (3.5 hours after I reported the damage) and informed that Its a felony to submit a claim to an insurance company. I proceeded to call *******************, who assisted with my prior 2 damage claims. I reiterated that I reported the damage 3.5 hours prior to when the picture was taken, as specified in the report that was filed, and requested re-review of my application. *** said she would look into it and get back to me. After weeks of unanswered follow up emails, I finally received a message from ***************************** (Operations Manager) stating (correctly) that the picture of my car with damage was taken the day prior to the claim being submitted but failing to mention the fact that the picture was taken 3.5 hours after I reported the damage to the valet attendants, as stated in the claim. ***** also stated; You have submitted claims before with us, so you should fill up the claim before and not after leaving the premises. This is another reason your claim has been denied.I followed up repeatedly with ***** and *** after this and have received no response.

This claimant has filed multiple claims with Miami Parking, **** In various occasions his claims were approved, when justified. In the case he is referring to in his claim with the BBB, the claimant left the premises and filed a claim later.

Our claim forms are available in each podium easily. Each of our podiums on property have a visible disclaimer that states anyone that parks must submit a claim before leaving the premises, any claim received after they have left will be denied.  This is industry standard nationally, because, often, damage can occur to a vehicle elsewhere, while driving, when parked in a different location, when using valet at a restaurant, mall, or essentially anywhere.

However, this claim was investigated by the Operations Manager and the company CMO and Director of the ****************** and they found no liability, negligence or anything that would show that the damage was caused by the valet team.  The valet team also denies any wrongdoing or that the claimant notified them of any damage before leaving the premises.

The claimant made several threats to file a claim with the BBB because he wanted us to pay for the damage that was not a result of valet operations and was unhappy that his claim was denied.

I am rejecting this response because the response has a very blame the victim feel to it that needs to be addressed.  The response is correct that I have had to file several previous claims against this company, as this was the 4th time my car was damaged by ***************** in the past 18 months.  In each instance, the valet staff failed to alert me to the damage and denied any responsibility or knowledge of the incidents.

Requiring claims to be filed at the exact time of discovery of damage make sense at a venue, such as a restaurant but seems less practical in an apartment building such as this, when a large percentage of damages would be discovered when the owners are on their way to something (e.g., Church as in this instance), and potentially running late.  You cannot require that individuals ***************** to fill out an incident report.  I property notified the staff immediately and filed the report the next day.

The valet team denying knowledge of all incidents seems like it should be of concern, no?  My having to file a claim with the BBB in order to have the damages repaired also seems as though it should be of concern, no?  Finally, I am a little confused about this response and the concurrent decision to re-open the case and properly cover the damages; why is that?

      Sincerely,

      ***********************************

We are very sorry and we regret your frustration with this.  Please understand that we can not take responsibility of something without any sort of proof or admittance and without the rules that are standard to help us manage claims for damage properly.   The rules are standard in most scenarios.   Vehicles can be damaged anywhere without you noticing.

MIAMI PARKING aka MP PARKING, did $3,700.00+ of damage to my car. I need the entire bumper replaced per the body shop. The irrefutable evidence that MIami Parking wrecked my car is the message that I received from my OnStar app that my car was involved in an accident three minutes from the time that I gave my car to the valet.I filled out the claim form perfectly and provided tons of documentation. They told me to shove it.CLAIM DENIED!!!!NOW, I have to pay $3,700.00+ to have my car repaired because OF THEM!!!Beware of this company!!

      Good afternoon:

The claims process is managed by our insurance agents thoroughly.   Unfortunately some claims are sometimes denied, as no fault / negligence is found on ** employees.   Many customers believe that the company is responsible because it was under our custody, however proof of fault is necessary.

In this case, unfortunately it wasn't found and the garage we use is also used by the public,  Unfortunately the company can not be responsible for actions of 3rd parties within the garage.

I am rejecting this response because>>>>

The response from MP Parking is a total fabrication.

THEY wrecked my car - their was no "third party' involved.

I have provided photographic evidence and documentation from the

On Star computer in my car that they wrecked my car less than

five minutes after I gave it to them.

Are they claiming that a "third Party" - someone else - drove my car while it

      was in THEIR possession?  Ridiculous.

MP Parking took my car from me, and crashed it almost immediately - less than

five minutes - after. The On Star computer in my car PROVES THIS.

NO "third party" was involved. Simply not possible.

      Sincerely,

      Good afternoon:

We regret the inconvenience and we understand that unfortunately customers get upset when a repair is not done, if the conclusion is that no fault on the part of the valet drivers or company is found.  By third parties in the garage it could have been another car that came in contact with this one, it could have been preexisting damage, it could have been various other cases.

      Complaint: 18669305

I am rejecting this response because>>>>>

      1)  MP Parking's claim that my car came into contact with another car may be

true - WHEN THEIR EMPLOYEE WAS DRIVING MY CAR!!  OR - their

employee drove my car into something else.

      2) Preexisting damage? NO! My On Star computer showed that the crash

occurred within five minutes of their taking possession of my car.

      3)  My On Star computer provides IRREFUTABLE PROOF that the crash

occurred while their employee was driving my car.

      4)  Various other cases? What in the world is MP Parking talking about?

Can they provide scenarios? For instance???

Bottom line>>> The On Star computer in my car PROVES that an MP

Parking employee was driving my car when the crash occurred.

There is no other plausible explanation.

      Sincerely,
