    - I made a reservation with Gator Boat Rental for February 13 - February 17. - It was for me and six other friends who were staying at a VRBO in Marco in Island. - Dwayne said if we pay cash he would give a discount and we agreed over the phone. - He drop the boat off late morning on the 13th. I paid him cash for the entire week. He explain how to use the boat and left. - We took the boat out around 12 o’clock. The boat started to sputter as soon as we left the canal and the idle speed area. It was sporadic and light, so we didn’t think much of it, but it started getting worse as the day went on. - On our way back we all were discussing how the engine wasn’t right and we need to tell Dwayne so I texted Dwayne at 4:04 PM. (see attached image). I said, “ Do you have another boat coming available? The engine on this boat is choppy and clunky. The engine is out of tune.” He did not respond. - We returned to the house around 5 o’clock. - At about 5:45 Dwane and his son returned to get the boat. They said that when they were coming back to put bumpers along the seawall for the boat, the homeowner met them and told them they could not have the boat at the property. We told them we had no idea we weren’t allowed to have a boat at the property. - Dwayne paid me back all the cash minus one one day rental and left. - Later that night, Dwayne called me and angrily accused us of damaging his boat. He said, “what did you run into” and I said, “What are you talking about”. He said, “it’s not running right” I said, “I know it’s not running right, I texted you it wasn’t running right you’re not telling me it wasn’t running right, I’m telling you it wasn’t running right.” - I didn’t hear from him again. - Then, on Feb. 28, I noticed Gator Boat Rental actually charged my card $2,365. - When I asked, Dwayne claims we broke our renters agreement and damaged his boat. His son claims we put sand in the gas tank. All completely false. - I would like a full refund of the $2,365.
